HomeMy WebLinkAbout1976 Resolution No. 049• • • RE.<30U11'IOO 00. 49_, Sl<liIES OI" 1976 A RESOWrI~ IN OPPOS1'1'1 ON m PROPOS1T1 0N 10 WHEREAS, Proposition 10 amems the constitution to require all / new or increased taxes of state or local governments be approved by a majority of the registered electors rather than by a majority of registered electors voting thereon; am WHmmAS, Proposition 10 siWlificantly alters the representative form or govei11uent which is a f'uOOamental pa.rt of the American system of self-gove1111ent; am WHEREAS, 'lhe amendment defines tax so broadly as to possibly include oon-tax items such as user fees am charges necessary to offset operating expenses for various governnent services; and WHEREAS, Placing additiaial. burdens on the power to tax would han1>er the ability of na.nicipalities to provide necessary services am iiq>rovements for their citizens arxl to f\tl.fUl the expeOOing obligations inposed on nunicipalities by federal am state governnent; and WHERFAS, 'lhe electioo requirement of Proposition 10 imposes unnecessary financial am administrative costs on governnent which the taxpayer ultinBtely nust absorb; am WHEREAS, Proposition 10 ney require an annual election on taxes Nhich are rein1)0sed each year; am WHEREAS, It is l.U1Clear whether the election requirement applies to increases 1n the tax levy, tax revenues or both; and ~.
