HomeMy WebLinkAbout1976 Resolution No. 053# • • RJo;SOLU'rION NO. 53 , SRRJRS OF 1976 A RESOLUTION RELATING TO THE DOUBLE TAXATION OF AN AREA WITHIN TBB CITY OP ENGLEWOOD RESULTING FRC»I THE OVERLAPPING OF SERVICES PROVIDED BY THB LOCAL GOVERNMENTS, AND BECAUSE OF ANNEXATION, AS IT RBLATBS TO THB SOUTH SUBURBAN METROPOLITAN RECREATION AND PARK DISTRICT. WHEREAS, in order to eliminate the overlapping of services provided by the South Suburban Metropolitan Recreation and Park District, and those to be provided by the City of Englewood, Colorado, and the double taxation which would occur, a Petition has been filed with t~e District Court in and for the County of Arapahoe, State of Colorado, for exclusion of certain territory lying and being within the City of Englewood, Colorado, and alao within the said South Suburban Metropolitan Recreation and Park Diatrict1 and WHBRBAS, the City of Englewood has provided, and doe• now provide, recreation and park services for the City of Englewood, and has funded these services by annual appro- priation• frOll genefal revenues of the City1 and WllBRBAS, the South Suburban Metropolitan Recreation and Park District own• no aaaeta located within the territory annexed to the City of Englewood. NOW, TRBRBFORB, BB IT RESOLVED BY THE CITY COUNCIL OP TllB CITY OP BMGLBMOOD, COLORADO, as follows: Section 1. That pursuant to the provisions of Section 32-1-304(1) (a), Colorado Revised Statutes, 1973, as amended, the City Council, as the 9overnin9 body of said municipality, hereby agrees to continue to provide the service provided by the South Suburban Metropolitan Recreation and Park District to the area described in th• afore .. ntioned Petition for Exclusion, within one (1) year from the effective date of the Exclusion Order.
