HomeMy WebLinkAbout1975 Resolution No. 038• • • RESOLUTION NO. f , SERIES OF 1975 ----- A RESOLUTION SUBMITTING TO THE VOTE OF THE QUALIFIED ELECTORS OF THE ClTY OF ENGLEWOOD, AT THE GENERAL MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 4, 1975, A PROPOSAL TO AUTllORIZE TllE ISSUANCE OF $2,225,000 in GENERAL OBLIGATION BONDS TO CONSTRUCT A 104 UNIT RESIDENCE FOR THE ELDERLY WITlllN TllE C:ITY OF ENla.EWOOll, COl.OltAUO. WHEREAS, the City Council of the City of Englewood is deeply committed to provide housing for the elderly within the City of Englewood; and WHEREAS, the Englewood Housing Authority, with the financial assistance of the City, has heretofore purchased real property at East Floyd Avenue at South Lincoln Street to provide a 104 unit residence for the elderly; and WHERF.AS, the City of Englewood has authority to con- struct said housing for the elderly pursuant to the provisions of the 'City Housing Law' and the 'Housing Authority Law', pursuant to C.R.S. 1973, Title 29, Article 4, Parts 1 and ; anJ WHEREAS, Section 104(1)(b), Colorado Revised Stat- utes 1973, authorizes the City to borrow money and to issue bonds to finance the construction of such units; and ,,, WHEREAS /.Part III entitled "Bonded Indebtedness", Sl•l_·tion 10 11 of th~ r.ity Charter pruviJcs in pertinent part, as f ollows: " .... Coun\:il shall have power to issue the general obligation bonds of the City for any pubJi c cu pitul purpose, upon mujorlty vote of the qualified electors of the City voting thereon at a special election. . . . The total outstanding general obligation indebtedness of the City, other than for water bonds, shall not at any time exceed three (3\) percent of the assessed valuation of the taxable property within the City as shown by the last preceding assessment for tax purposes". -.I - • • • ; n nd WIWIU.i AS, Section 14, entitled "Special Elections", authorizes " .... any proposal, question, or proposition to be submitted at any general or special municipal election . . . . "; and WHEREAS, in the event that the issue of general obligation bonds in a total amount of $2,225,000 is approved by the qualified voters, such indebtedness would not exceed the limitation expressed in Section 104 of the City Charter. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: Section 1. There is hereby submitted to the qualified electors o f the City at a General Municipal Election to be held November 4, 1975, a proposal, and ballot title, for the issuance of general obligation bonds as follows: Sectio n 2 . PROPOSAL SHALL THE CITY COUNCIL OF THE CITY OF ENGLE- WOOD AUTHORIZE THE ISSUANCE OF $2,225,000 OF GENERAL OBLIGATION BONDS OF THE CITY, THE PROCEEDS OF WHICH SHALL FINANCE THE CONSTRUCTION OF A 104 UNIT RESID f NCE STRUCTURE FOR THE ELDERLY? That each qualified elector voting at said election, a nd des i rous o f voting for or against said proposal, shall i nd i cate his or her choice by depressing the appropriate c ounter o f the voting machine, which indicates the word "For" o r "Agai nst", or by appropriate marking upon paper ballots, wh e r e u se d. Section 4. This Resolution shall be published in full in the Englewood-Herald Sentinel on September 4 and 11, 1975. ADOPTED AND APPROVED this 18th day of August, 1975.
