WHEREAS, Section 67 of the Englewood City Charter
provides:
"6 7: SPECIAL COUNSEL
The Council may, on its own
motion, or upon the request
of the City Attorney, in special
cases, employ special counsel
to serve under the direction
• of the City Attorney .••• "

WHEREAS, John A. Criswell, as previous City Attorney
for the City of Englewood, was the City Attorney at the time
that previous Atchison Ranch litigation was instituted, and
during the ensuing years from 1967 Mr. Criswell became inti-
mately familar with the progress of the Atchison Ranch liti-
gation; and
WHEREAS, Bernard V. Berardini, the present City
Attorney has requested this Council to consider the appoint-
ment of Mr. Criswell as special counsel in this matter in view
of his familiarity with the prior proceedings in this action;
and
WHEREAS, it is the desire of the Council to grant
the request of the City Attorney and provide special counsel
on behalf of the City in the above captioned case •

NOW, TllElU~FORE, BE IT RESOLVED BY THE CITY COUNCIL
OF TifE CITY OF ENGLEWOOD, COLORADO:
1 . Thnt Mr. .lohn A. Cr:I swc 11, is he r e hy appolnted
special counsel pursuant to Section 67 of the City Charter
to re-enter his appearance in the above entitled case on
behalf of the City of Engl~wood and to work jointly with
the City Attorney's office in the proper presentation of
any and all lawful defenses available to the City of Engle-
wood.
2. 'nlat an initial retainer fee of $2,500.00 shall
be paid to the special counsel herein; and, that compensation
for said counsel shall be at the rate of $45.00 per hour and
$275.00 per diem in Court proceedings.
Payments to said special counsel shall be made
monthly pursuant to billings received therefor.
ADOPTED AND APPROVED this 21st day of January, 1974 .
