RESOLUTI ON NO. 2, SERIES 1972
A ~OUlr ION DECLARING THE INTENTION OF THE CITY COUNCIL OF THE CITY
OF ENGIEW OOD, COI.DRADO, TO CREATE AN IMPK>VEMENl' DISTRICT IN SAID
cm TO BE KNOWN AS PAVING DISTRICT NO. 21; ADOPTING DETAILS AND
SP£CIFICAT I ONS THEREFORi AND ORDERING PUBLICATION AND MAILING OF
tul'IC E OF HEARING TO THE CMNERS OF THE PK>PERI'Y TO BE ASSESSED FOR
IMPROVEME NTS IN SAID DISTRICT.
WHEREAS , the City Council of Englewood, Colorado, has detennined to create Paving
Distric t No . 21, in s aid City and to order the construction and installation of the street and
al l ey improvements therein as more particularly described in the fonn of Notice hereinafter
set forth; and
WHEREAS , the City Co uncil has heretofore adopted a preliminary order directing the City
Engineer to make the necessary preliminary surveys, estimates and maps as required by the pro-
v isions of the City Charter and Ordinance No. 14, Series of 1965, as amended; and
WHEREAS , the City Eng ine er, pursuant to said Order, has prepared preliminary surveys,
estimat es and maps in connection with the proposed Paving District No. 21, which will be on file
in the office of the Director of Public Works;
BE IT RESO LVE D BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO:
1 . That the City En g ineer's reports, together with the details, specifications,
estimates , maps and schedu les prep are d a n d f ile d with the Director of Finance be and the same are
h ereb y approved and adopted b y this Council for use in the construction of the improvements
t o be made in s aid Paving District.
2. That the materials to be used in constructing the proposed improvements are stated
in the No tice hereinafter set forth.
3 . That the assessments to be levied for said improvements shall be due and payable
within thirty days f r an and after the final publication of the ordinance assessing the whole actual
cost of said impr o v em ents a g ainst the real property in said District; provided, however, that any
owner who shall pay the f u l l as s e ssment within said period of thirty days, shall be entitled to
an all owance of fiv e perce n t (5 \) o f the amount so assessed against his property and paid by him.
In t h e event any owner of real estate shall fail to pay the whole of such assessment against his
p roperty wi thin s aid thirty days, then the whole cost of the improvements so assessed against his
p roperty shal l be payable in ten equal annual installments of principal. The interest rate on
the unpaid installments o f assessments will be established by ordinance to be adopted by the City
Council at a later d ate . Th e f irst o f said installments of principal and interest shall be due
and payable at such time as may be determined in and by the assessment ordinance, and the remainder
of the annual installments of p r incipal a n d i nterest shall be due and payable successively on the
same day in each year thereafter until a ll are p aid in f ull.
4. That the p roperty to be a s sessed for said improvements shall be the property within
the District ti pcc ially bcncf itcd by :;.:.aill i mprove me n ts , as more p articu lar ly descr i bed in the Notice
hereinafter set for t h .
5 . That t h ere s hall be pre pared an ordinance in accordance with the provisions of the
City Charter and Ordina n ce No . 1 4, Seri es of 1 9 65, as amended, creating within the corporate
limits of said City a l ocal improvement district to be known as Paving District No. 21 and pro-
v .iding f o r the con s truction in said District of the improvements, as is set forth in this Resolution
and in accordance with the report , plans , maps , specifi cations , d e tai ls and estimate s o f the
Engineer of said City, herein referred t o and which will be on fi l e in the office of the Director
of Public Works . The proposed ordinance will be introduced as a Bill at the regular meeting of
·the City Council o n Monday, February 7, 1 9 72.
6 . Not i ce o f the p roposed improvements shall be given by the Director of Finance and
publis hed onc e .'l week for three corn;ecu tivc weeks in t h e Englewoo d He r a l d, a n e ws p aper p ublis h e d
and of general circulation in the City, therein giving Notice to the owners of the property to be
assessed of the ma tters and things required by law. In addition, a copy of a notice shall be
mailed , post age p repaid, to each known owner of real property within the proposed district.
The No tice to be published shall be in substantially the following fonn:

(b ) The descri ption of t h e proposed district, and the property to be assessed
wi th t he c o s t of the improv e me n ts s h al l be a ll of the real property fronting or abutting on the
street s and alleys between the termini hereinbefore described, including the real property within
one half (1/2 ) block o f s uch s treets and alleys. Adjustments for the assessment of costs will
be ma d e f o r irrequ lar and odd s h a p ed l ots a nd parcels of property.
(c) Th e probable total cost of the improvements to be constructed and installed
is $721 ,29 0 .
(d) The prob ab l e amount of the total cost which the City shall pay is approximately
$85,803 .

Al l e s t imates exclude the six per cent (6%) for inspection, collection, incidentals
and int e r est as p rovided by law.
The cost s o f paving to be constructed along the sides of corner lots within said District
shall be assessed against properties within one-half (1/2) block or 300' of such intersections and
corner lots, whichev e r is sma ller, on a zone basis in accordance with benefits conferred on such
pro perties.
Each one -half (1/2) block or 300' section, will be divided into six (6) parallel zones
and assessments wil l be on the following basis:

No assessments will be made for curbs, gutters and sidewalks in place which conform
with the plans and specifications for the proposed improvements and which are acceptable to the
City Engineer .
The cos t of improving street, avenue and alley intersections throughout the D~strict,
and of paving in excess of 36' widths and 8" thickness on streets designated as arterial within
residential zoning as of January 3, 1 9 72, will be paid by the City of Englewood.
Property owners are specifically referred to the schedule of proposed assessments
which will be on file in the Office of the Director of Public Works, from which the approximate
amount to be assessed ..iyaiu:;L .my pJrlic:ulJr Jol or parcel or property may be determined.
Upo n complet ion of said improvements, or as soon as the total cost thereof is definitely
ascertained, such cost shdl l be a pportioned to t h e property in the District. Notice of such
apportiorunent shall be g iven and a Hearing will be held prior to the adoption of an ordinance
assessing such cost , all as p rovided by law.
(f) Said assessments will be d u e and payable without demand within thirty days
from and after the final publication of an ordinance assessing the whole cost of said improvements
against the real property in said District; provided, however, that any owner who shall pay his
full assessment within said period of thirty days shall be entitled to an allowance of five per-
cent (5\). In the event that any owner of real property shall fail to pay the whole of such
assessment against his property within said thirty days, then the whole cost of said improvement
so assessed against his property shall be payable in ten equal annual installments of principal.
The first of such installments of principal shall be due and payable at such time as may be determined

paid in full. The rate o f interest to be paid o u unpaid a nd de ferred installments will be es-
tablished by ordinance to be adopted by the City Council at a later date.
(g) A Hearing on the creation of the District will be held by the Council on Monday,
the 24th day of January, 1972, at the hour of 8:00 o'clock P.M., at the City Hall in Englewood;
and a bill for an ordinance authorizing said improvements will be considered by the City Council
at the regular meeting on February 7, 1972.
(h) Any person desiring to be heard upon the issue of the creation of the district
or upon the construction , installation or improvement of the improvements involved, may appear
at the time and place set for the public hearing thereon for that purpose.
Ci) A map, estimate and schedule showing the approximate amount to be assessed, and
all resolutions and proceedings will be on f ile and can be seen and examined by any person interested
at the Off ice of the Director of Public Works at any time during business hours on or prior to the
d.alc of h4'.'.arinq.

7. The Notice to be mailed to the owners of property to be assessed with the cost of
said improvements, sha ll be in substantially the f ollowing form:
January 17, 1972
The City Council has adopted a resolution which describes the City's
intent to form Paving District No. 21. This District will be formed £or
the purpose of construction and improving curbs, sidewalks and paving on certain
streets and alleys in your neighborhood and throughout the City during the
summer of 1972. The cost for such improvements will be assessed against
the property to be benefitted by these improvements.
Your property will be affected by these improvements and we invite you
to review the attached resolution. You may have seen or will see markings
on your curbs, sidewalks or trees that are scheduled for removal. There
are times during the course of construction that changes in removal quantities
may have to be mJdc.
May we request that you make any inquiries regarding the paving district by
calling our Engineering staff at the City Hall, 761-1140, ext. 220.
You are invited to attend a public hearing on the formation of this
Paviny District on January 24, 1972, at 8:00 P.M. in the City Council
Chambers in City llall, 3400 South Elati Street. At this public hearing
you will be invited Lo make any COll'ITlents , pro or con, regarding the
imprOVf"mrnt of st r eet~, the cost of which would affect your property.
