PARK (WEST HARVARD GUU:H) IN NORI'HWEST ENGLEWOOD, COl.DRADO AND FOR ALL OTHER LAND ACQUISITIONS
PURS UANT TO THE OPEN SPACE LAND PROGRAM OF THE HOUSING AND URBAN DEVELOPMENT ACT OF 1965.
WH EREAS, on the 17 th da y of Apri l A.O., 1 9 72, City Council of the City of Engl e wood,
authorized f iling of an appl ication for a g rant to acquire and develop open space for a Green-
belt-Park (West Harvard Gulch) within the City of Englewood; and
WHEREAS, Section 402 of the !lousing and Urban Development Act of 1965 requires that,
as a condition of eligibility for assistance under the Open Space Land Program the applicant
must satisfy the Department of Housing and Urban Development that it will follow certain
prescribed land acquisition policies.
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COI.DRADO,
as follows:
1. That the City of Englewood, its agents or employees will make every reasonable
effort to acquire the real property by negotiated purchase before instituting eminent domain
proceedings (including administrative takings and similar proceedings for the compulsory ac-
quisition of real p roperty). That further, the City of Englewood shall institute the herein-
after stated policies for all other land acquisitions pursuant to the Open Space Land Program
under the Housing and Urban Development Act of 1965. !:J
2 . That said City of Englewood, its agents or employees will not require any owner
to surrender possession of the property until the applicant pays, or causes to be paid, to the
owner the agreed purchase price arrived at by negotiation, or in any case where only the amount
of the payment to the owner is in dispute, not less than 75 per cent of the appraised fair
market value as approved by the applicant or, if subsequent to HUD concurrence in the acquisition
price for the property, as concurred in by HUD.
3. That the City of Englewood, its agents or employees will not require any person
lawfully occupying property to surrender possession without at least 90 days written notice
from the applicant of the date on which possession will be required.

The undersigned hereby certifies that:
1. He is a duly qualified and acting Director of Finance, ex officio City Clerk of
the City of Englewood , Colorado, a municipal corporation, hereinafter called the Applicant and
the keeper of its records.
2. The attached Resolution is a true and correct copy of a Resolution as finally
adopted at a meeting of the Applicant held on the 17th day of April, 1972, duly recorded in this
office.
3. The meeting was duly convened and held in all respects in accordance with law and
to the extent required by law. Due and proper notice of the meeting was given. A legal quorum
was present throughout the meeting and a legally sufficient number of members of the Applicant
voted in the proper manner for the adoption of the Resolution. All of the requirements and
proceedings under law incident to the proper adoption or passage of the Resolution have been
duly .fulfilled, carried out and otherwise observed.
4 . If the impres s ion of the seal has been affixed below it constitutes official seal
of the Applic.-int and this Cert if icatc ii:> hereby executed under the official seal.
