RESOLUTION STATING THE LAND ACQUISITION POLICY FOR ALL LAND ACQUISITIONS PURSUANT .TO THE WATER AND SEWER FACILITIES GRAN!' PROGRAM OF THE HOUSING AND URBAN DEVELOPMENT ACT OF 1965. That the C ity o f Englewood, its agents or employees will make every reasonable effort to acquire the real property by negotiated purchase before instituting eminent domain proc cedinqs (inc luding achninistrativ e taking s and similar proceedings for the compulsory acqui- sition o f real property). 'l'hat f urth e r, the City of Englewood shall institute the herein- after stated policies for all land acquisitions pursuant to the Water and Sewer Facilities Grant Program under the Housing and Urban Development Aet of 1965. 2. That said City of Englewood, its agents or employees will not require any owner to surrender possession of the property until the applicant pays, or causes to be paid, to the owner the agreed purchase price arrived at by negotiation, or in any case where only the amount of the payment to the owner is in dispute, not less than 75 percent of the appraised fair market value a s approved b y the applicant or, if subsequent to HUD concurrence in the acquisition price for the property, as concurred in by HUD. 3 . That the City of Englewood, its agents or employees will not require any person lawfully occupying property to surrender possession without at least 90 days written notice from the applicant of the date on which possession will be required.
