KEIM AND DOROTH Y H. ICEIH FOR UTILITIES AND SEWER PLANT EXPANSION OR OTHER MUNICIPAL USES WITHIN THE CITY OF ENGLEJl(X)D. fliH EREAS, Council finds and determines that existing facilities for sewer treatment wi t hin the Ci t y r equ ires expansion by acquisition of an additional land area; and fiH EREAS , the real property owned by Charles G. Keim and Dorothy M. Keim, lying illmediately to the South of existing facilities, of the City of Englewood, is a suitable and proper a r ea £or such expansion; and flHEREAS , s a id real property contains approximately 9.36 acres, more or less, whose legal d escript i on i s attached hereto as Exhibit "A", and made a part of this Resolution; and flHE"REAS , the City desires to purchase and to option said property and the owners, above named, des ire to sell said property, and to execute an option with the City. NON , TH EREFORE, BE I T RESOLVED BY THE COUNCIL OF THE CITY OF ENGLEWOOD, as follows: 1 . Tha t the Mayor shall execute, and the Director of Finance attest, a proper .i nst rumen t t o be p r e pared authorizing and agreeing that the City of Englewood purchase Parcel 1 0£ ten (1 0) ad j o i n i ng parcels being identified as Tract B, and to purchase the remaining nine (9) parc e l s of Tr a ct B over a period of ten (10) successive years. 2. That the purchase price of all of said Tract B containing the said 9.36 acres, more o r less , shall n o t e xceed the total sum of $155,040.00. J . Tha t the Ci t y shall recei ve a good and sufficient deed to each of said parcels, s uccessi v e l y purchased, f ree and clear of all liens and encumbrances, subject, however, to the .lease hereinafter men tioned upon the payment to the owners thereof of one-tenth (1/10) of the total purchase p rice as above stated, or the sum of $15,504.00, for each parcel on the anniversary date of t he successive purcha ses. 4.
