L!' :Jmn~s 01' l ~Jr l A RESOLUTION DECLARit«J THE INTENTION OF THE CITY COUNCIL OP THE CITY OP Er«JLEWOOD, COLORADO, TO CREATE AN IMPROVE- MENT DISTRICT IN SAID CITY TO BE KNOWN AS PAVIt«J DISTRICT NO. 20; ADOPTit«J DETAILS AND SPECIFICATIONS THEREFOR; AND ORDERit«J PUBLICATION AND MAILIJ«l OP NOTICE OP HEARIMJ TO THE C7#NERS OP THE PROPERTY TO BE ASSESSED FOR IMPROVEMENTS IN SAID DISTRICT. WHEREAS, the City Council ot Englewood, Colorado, has determined to create Paving District No. 20 in said City and to order the construction and installation or the street and alley improvements therein as more particularly described in the form ot Notice hereinafter set forth; and WHEREAS, petitions have also been filed with the Director or Finance, ex-otr1c10 City Clerk, by a majority or property owners on a certain street and alley, requesting the construction and installation or improvements therein; and WHEREAS, the City Council has heretofore adopted a preliminary order directing the City Engineer to make the necessary preliminary surveys, estimates and maps as required by the provisions or the City Charter and Ordinance No. 14, Series of 1965, as amended; and WHEREAS, the City Engineer, pursuant to said Order, has prepared preliminary surveys, estimates and maps in connection with the proposed Paving District No. 20, wh1ch will be on file in the office of the Director or Public Works; BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: 1. That the petitions which have been filed with the Director of Finance, ex-off1cio City Clerk, were s1gned by a majority or the owners or real property as required by law, which petitions contained a description or the area to be included within the district, a description or the nature of the improvements petitioned tor, including the locations thereof, and the names and addresses or the signers thereof, together with the legal description of the parcels of real property owned by each. 2. That the City Engineer's reports, together with the details, specifications, estimates, maps and schedules prepared and filed with the Director ot Finance be and the same are hereby approved and adopted by this Council ror use in the construction of the improvements to be made in said Paving District. 3. That the materials to be used in constructing the proposed improvements are stated in the Notice hereinafter set forth. 4. That the assessments to be levied tor said improvements shall be due and payable within thirty days from and after the final publication or the ordinance assessing the wholeactual cost or said improvements against the real property in said District; provided, however, that any owner who shall pay the tull assessment within said period or thirty days, shall be entitled to an allowance ot five percent (5-) or the amount so assessed against his property, and paid by him. In the event any owner or real estate shall rail to pay the whole of such assessment against his property within said thirty days, then the whole cost or the improvements so assessed against his property shall be payable in ten equal annual installments or principal. The interest rate on the unpaid installments of assessments will be established by ordinance to be adopted by the City Council at a later date. The first of said installments ot pr1ncjpal and interest shall be due and payable at such time as may be determined 1n and by the assessment ordinance, and the remainder of the annual 1natallments or principal and interest shall be due and payable successively on the same day in each year thereafter until all are paid in full. 5. That the property to be assessed for said improvements shall be the property within the District specially benefited by said improvements, as more particularly described in the Notice hereinafter set forth. 6. That there shall be prepared an ordinance in accordance with the provisions or the City Charter and Ordinance No. 14, Series or 1965, as amended, creating within the corporate limits or said City a local improvement district to be known as Paving District No. 20 and providing for the construction in said District or the improvements, as is set forth in this Resolution and in accordance with the report, plans, maps, specifications, details and estimates or the Engineer or said City, herein referred to and which will be on tile in the office or the Director of Public Works. The proposed ordinance will be introduced as a Bill at the regular meeting of the City Council on Monday, February 1, 1971. 1. Notice or the proposed improvements shall be given by the Director or Finance and published once a week for three consecutive weeks in the Englewood Herald. a newspaper published and of general circulation in the City, therein giving Notice to the owners or the property to be assessed or the matters and things required by law. In addition, a copy or a notice shall be mailed, postage prepaid, to each known owner of real property within the proposed district. I I I I I The Notice to be publ i shed shall be in substantially the following ronn: NOTICE OF A PROPOSITION TO CREATE A LOCAL IMPROVEMENT DI STRICT IN ENGLEWOOD, COLORADO, TO BE KNOWN AS PAVING DISTRICT NO. 20, TO CONSTRUCT AND INSTALL CERTAIN STREET AND ALLEY IMPROVEMENTS THEREIN, AND FOR A HBARit«J THEREON. All owners or real estate and property hereinafter described, and all persons generally, are hereby notifjed that the City Council of Englewood, Colorado, pursuant to its own order and upon petitions filed by a majority of the owners or real property as required by law, has adopted full details, ~lana and specifications for construction or street and alley improvements and appurtenances in and for a proposed local improvement district within the corporate limits or Englewood, Colorado, to be known as Paving District No. 20. The cost or improving street intersections throughout the District, and or paving in excess of 36' widths and 8" thickness on streets designated as arterial within residential zoning as or January 4, 1971, will be paid by the City or Englewood. Property owners are specifically referred to the schedule or proposed aaaessmenta which will be on file in the Office or the Director or Public Works, from which the approximate amount to be assessed against any particular lot or parcel or property may be determined. Upon completion of said improvements, or as soon as the total cost thereof is definitely ascertained, such cost shall be apportioned to the property in the District. Notice or such apportionment shall be given and a Rearing will be held prior to the adoption or an ordinance assessing such cost, all as provided by law. (t) Said assessments will be due and payable without demand within thirty days from and after the final publication or an ordinance assessing the whole cost or said improvements against the real property in said District; provided, however, that any owner who shall pay his full assessment within said period or thirty days shall be entitled to an allowance or five percent (5~). In the event that any owner or real property shall fail to pay the whole or such assessment against his property within said thirty days, then the whole cost of said improvement so assessed against his property shall be payable in ten equal annual installments or principal. The first or such installments or principal shall be due and payable at such time as may be determined in and by the assessing ordinance,· and the remainder or said installments thereafter until all are paid in full. 'nle rate or interest to be paid on unpaid and deferred installmentw will be established by ordinance to be adopted by the City Council at a later date. (g) A Hearing on the creation or the District will be held by the Council on Monday, the 25th day of January, 1971, at the hour or 8:00 o'clock P.M., at the City Hall in Englewood; and a bill for an ordinance authorizing said improvements will be considered by the City Council at the regular meeting on February 1, 1971. (h) Any person desiring to be heard upon the issue or the creation or the district or upon the construction, jnetallat1on or improvement of the improvements involved, may appear at the time and place set for the public hearing thereon for that purpose. (i) A map, estimate and schedule showing the approximate amount to be assessed, and all resolutions and proceedings will be on file and can be seen and examined by any person interested at the Office of the Director of Public Works at any time during business hours on or prior to the date of hearing. 28~ .,~, ~ , ) .-l Dated the 4th day or January, 1971. Lyon DIRECTOR OF FINANCE The Notice to be mailed to the owners or property to be assessed with the cost or said improvements, shall be in substantially the following torm: Dear Englewood Citizen: 'l'he City Council has adopted a resolution which describes the City's intent to torm Paving District No. 20. This District will be formed tor the purpose ot constructing and improving curbs, sidewalks and paving on certain streets and alleys in your neighborhood and throughout the City during the summer or 1971. The cost for such improvements will be assessed against the property to be benetitted by these improvements. Your property will be affected by these improvements and we invite you to review the attached resolution. You may have seen or will see markings on your curbs, sidewalks or trees that are scheduled tor removal. There are times duri ng the course of constructi on that changes in removal quantities may have to be made. May we request that you make any inquiries regarding the paving district by calling our engineering staff at the City Hall, 761-1140, ext. 220. You are i nvited to attend a public hearing on the tonnation of this Paving Distri ct on January 25, 1971, at 8:00 P.M. in the City Council Chambers in City Hall, 3400 South Elati Street. At thds public hearing you will be invited to make any comments, pro or con, regarding the improvement or streets, the cost or wh i ch would affect your property.
