AND PT,AC F. FOR A PUBLIC HEARING UPON THE ASSESSMENT OF SAID COS'l'S AN l> OIID l::IUN G PUULll!A'l' !ON ANU MA!LlNG 01'' NO'l'ICE 'rHEREOF TO 'l1 HE OWNERS OF PROPERTY TO BE ASSESSED WITHIN THE DISTRICT: AND TO APPROVE THE COMPLETION OF SAID DISTRICT. WHEREAS, the City Council of the City of Englewood, Colorado, pursu- ant to the Charter and Ordinance No. 14, Series of 1965, of said City and the Laws of the State of Colorado, enacted Ordinance No. 28, Series of 1969 creating Sidewalk Improvement District No. 69, and providing for the construction therein of sidewalk improvements: and WHEREAS, the construction of such improvements has been completed and the t o ta l c o s ts of s uch improve me n t s have been reliably ascertained. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EN GLEWOOD , COLORADO, as follows: 1. That, subject to the provisions and conditions contained within the Charter of the City of Englewood, Ordinance No. 14, Series of 1965, and any applicable statute, City Council hereby declares that it is its intent to approve the whole cost of the improvements made in and for Sidewalk Improvement District No. 69, to approve and confirm the apportionment of said cost to each lot or tract of land in said District and to assess a share of said cost against each lot or tract of land in the District, and to approve the completion of said district. 2. That a public hearing upon said assessments will be held before City Council at City Hall, 3400 South Elati, Englewood, Colorado, to commence a t 8:00 o'clock p.m. on Monday, February 16, 1970, and that notice of the pro- posed assessments be given by the City Clerk and published in the Englewood Herald and Enterprise, a newspaper published and of general circulation in said City, in three consecutive weekly editions, therein giving Notice to the owners of the property to be assessed of the matters and things required by law. At or about the time of the first publication, Notice shall also be given by prepaid mail to all known owners of property to be assessed with the cost of s a id improveme nts. 3. The Notice to be published shall be in substantially the follow- ing form: NOTICE OF PUBLIC HEARING UPON THE COSTS AND ASSESSMENTS FOR SIDEWALK IMPROVEMENT DISTRICT NO. 69, CITY OF ENGLE- WOOD, COLORADO, AND OF A HEARING UPON A BILL FOR AN ORD- INANCE APPROVING SAID COSTS AND ASSESSMENTS. All owners of real estate and property located in Sidewalk Improvement District No. 69 created by Ordinance No. 28, Series of 1969, City of Englewood, Colorado, and all persons generally, are hereby notified that the construction of the improvements for Sidewalk District No. 69 has been completed and the costs tberedf have been ascertained, and that the City Council is of the intent to approve and confirm the apportionment of said costs to each lot or tract of land in said District: to assess a share of said costs against each lot or tract in said District1 a nd to prescribe the manner of collection and payment of said assessments: and that the City Council at its regular meeting on January 19, 1970 adopted a resolution setting forth its intent to approve said costs and assess- ments. Said persons are further notified as follows: (a) The whole cost of said improvements is the sum of $14,063.31. (b) Of said sum of $14,063.31, the City of Englewood will pay $4,169.91, l e aving a balance of $9,893.40 to be assessed against the real property in said District.
