HomeMy WebLinkAbout1970 Resolution No. 003I I I RESOLUTION NO. 3 , SERIES OF 1970 WHEREAS, the street improvements in Paving District No. 18, in Englewood, Colorado, have been satisfactorily completed and have been accepted by the City of Englewood: and WHEREAS, a statement showing the whole cost of said improvements and a proposed apportionment of the same on the property in said District has been filed with theDirector of Finance: and WHEREAS, the City Council has considered the special benefits accruing to each lot or tract of land in theDistrict by reason of the making of said street improvements and has determined that the apportionment of the assessments for said improvements as set forth in the following Notice, is in accordance with such benefits: THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO: 1. That theDirector of Finance is hereby authorized and directed to notify the owners of the property to be assessed for said improvements by adver- tisement in three consec~tive weekly issues of The Englewood Herald, a newspaper published and of general circulation in the City of Englewood, that said improve- ments have been completed and accepted, that the cost thereof has been apportioned according to benefits and that a hearing on the assessments will be held at the time and place set forth in the Notice, and by mailing a sununary of said Notice to all owners of property to be assessed with the costs of said improvements. The summary of the Notice shall be forwarded by prepaid mail at or about the time of the first publication of the Notice. The hearing shall be held not less than fifteen days following the first publication of the Notice. form: 2. That the published Notice shall be in substantially the following PUBLIC NOTICE OF THE COMPLETION OF STREET IMPROVEMENTS IN PAVING DISTRICT NO. 18, 'IN THE CITY OF ENGLEWOOD, COLORADO, OF THE APPORTIONMENT OF THE COST THEREOF AND HEARING THEREON. TO ALL PERSONS INTERESTED GENERALLY and to the owners of real estate which is hereinafter described, said real estate comprising the District known as Paving District No. 18, Englewood, Colorado: NOTICE IS HEREBY GIVEN: That the improvements in Paving District No. 18, Englewood, Colorado, which were authorized by Ordinance No. 17, Series 1969, finally adopted and approved on t he 21st day of April, 1969, have been completed, that the same have been accepted by theCity Council of the City of Englewood, and that the cost thereof has been apportioned against the real property in the Di strict accordi nq to benefits. NOTICE IS FURTHER GIVEN: 1. That the whole cost of said improvements has been definitely ascertained and is the amount of $311,147.75, said amount including costs of inspection, collection, incidentals and interest as allowed by law. 2. Of the whole cost stated in paragraph 1, the City of Englewood will pay $77,629.55, leaving the amount of $233,518.20 to be assessed against the real property in theDistrict for the cost of the improvements. 3. That the share apportioned to and upon each lot and tract of land within the District and assessable for the improvements is as follows: PROPERTY OWNER A S S E S S M E N T S ----------- Paving District No. 18 Englewood, Colorado PROPERTY DESCRIPTION (Attach Copy of Assessment Roll) TOTAL ASSESSMENT 4. That any complaints or objections which may be made in writing by the owners of land within the District to the City Council and filed in the office of the Director of Finance on or before Thursday, the 19th day of March, 1970, will be heard and determined by the City Council before the passage of an ordinance assessing the cost of said improvements. 5. That the sununary of the Notice to be mailed to each owner of prop- erty to be assessed for the cost of improvements shall be in substantially the following form: (Form of Mailed Notice) NOTICE OF FILING ASSESSMENT ROLL OF THE CITY OF ENGLEWOOD, COLORADO, PAVING DISTRICT NO. 18 AND OF HEARING THEREON NOTICE IS HEREBY GIVEN That the assessment roll for the City of Englewood, Colorado, Paving District No. 18 has been filed in the office of the City Clerk. The owner or owners of any property which is assessed in said assess- ment roll, whether named or not in said roll, may, on or before Thursday, the 19th day of March, 1970, file with the undersigned, his, her or their complaints or objections in writing to the proposed assessments. The City Council will meet to hear and consider complaints or objec- tions to the assessme n ts by any party or parties aggrieved thereby on Monday, the 23rd day of March, 1970, at 8:00 o'clock P.M. at the City Hall in said City. Any complaint or objection to the validity of the assessments or the proceedings taken therefor shall be deemed waived unless presented in writing at the time and in the manner indicated above. That if any one or more sections or parts of this Resolution shall be adjudged unenforceable or invalid, such judgment shall not affect, impair or invalidate the remaining provisions of this Resolution, it being the intention that the various provisions hereof are severable.
