A RESOLUTION DENYING THE APPLICATION OF NATIONAL TEA CO.,
DOING BUSINESS AS DEL FARM CO., FOR A FERMENTED MALT BEVERAGE
LICENSE TO BE LOCATED AT 4160 SOUTH BROADWAY.
WHERF.AS Del Farm Co. has heretofore made application,
pur s uant lo lh c provisions of Chapter 75, Article l, Colorado
Re v ised Statutes , 196 3 , as amended, for the issuance of a fermented
malt beverage license to be located at 4160 South Broadway,
Englewood, Colorado, and
WHEREAS notice of said application, and of the public
hearing thereon has been properly given and public hearing upon
said application was properly conducted on the 2nd day of December,
1968, before the City council of the City of Englewood, as the
local licensing authority, and all other procedural requirements
of the stat u te havinq h<'<"n c omplied with,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ENGLEWOOD, as follows:
That, based upon the application of said Del Farm Co.
and the evidence and information adduced at the public hearing upon
said application, the City council of the City of Englewood should,
and does hereby, adopt the following findings and conclusions:
l. The applicant is a corporation organized under the

convicted of a felony or crime within any court of the
United States or with any court of record of any state or
territory of the United States.
3. At the time of the public hearing, petitioner submitted
petitions bearing approximately 800 signatures favoring
the application. Of these, 379 were signatures of residents
of the area, while the remainder were signatures obtained
from customers of applicant's grocery store located at
4160 South Broadway. Protestants submitted remonstrances
containing approximately 430 signatures, all of which
app eared to be signatures of Englewood residents, 283 of
which were of persons living within a three block radius
of the location set forth in the application. Approxi-

application. One person appeared in opposition. Even
though the petitions submitted for application in favor
of the i~su~n cc of said license exceeded, in toto, the
nwnl.Jcr ol siynalu rcs contained upon the remonstrances,
it is c lear that there is substantial opposition to the
issuance of the license from the residents of the neigh-
borhood. In addition, the evidence adduced indicated
that there are several package liquor stores, three-
way liquor establishments and at least one 3.2 outlet
within a relatively short distance of the location
requested in the application and Council therefore finds
and concludes that the reasonable requirements of the
neighborhood are presently being met by the existing
outlets.
BE IT FURTHER RESOLVED that, based upon the foregoing,
the application of Del Farm co. for the issuance of a fermented
malt beverage license to be located at 4160 South Broadway, Englewood,
Colo.rado, should be, and is hereby, denied.
