WHEREAS, the City of Englewood, in connection with the develop- ment of i ts Frasier River water Rights acquired certain property for the cost of the Interceptor on Beaver Creek: and WHEREAS, refined engineering studies have indicated that said property i s s urplu s ~nd n ol n ecessar y for the Ranch Creek Diversion Pro ject; and WHEREAS, said property h as never been used for either govern- ment.ii. ,,. p.11 k l''ll 1't1:1•·:1: .ind WHEREAS, it was ag reed as a part of a legal settlement in water District No. 5 with Raymo nd D. SloJn that said land would be deeded by the City to persons designated by him, said property being described as ollows : l\ ::;trip of 1.incl l 'iO frrt in wid t h lyinq in t h e S~/4 ol Section l ~, T. 1 S., R. 75W., being 75 feet i n width on either side of the following center line, the exterior boundary of which 150 foot strip of l a nd shall extend and be projected to the North line of the SE/4 of said Section 14: Beginning at a point whence the east quarter corner of H .. 1i tl Seclion l4 L>o .1 r::> 07° 49' 00" E. a distance of 370.8 feet along the north line of the SE 1/4 of Section 14; thence S. 54° 14' 00" w., a distance of 80.2 feet: thence S. 470 03' 57" W., a distance of 114.50 feet; thence S. 520 59' 37" W., a distance of 417.19 feet; thence s. 71° 21' 45" w., a distance of 558.14 feet ; thence S. 68° 44' 27" W., a distance of 100 feet, containing 4.37 acres, more or less. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, as follows: Section 1. That engineering studies have indicated that the property described above is surplus and not necessary for the Ranch Creek Diversion Project. Scclion 2 . Thul sJid property h a s never been used f or either governmental or park purposes. Section 3. That it was agreed as a part of a legal settlement in water District No. 5 with Raymond D. Sloan that said land would be deeded by the City to persons designated by him. Section 4. That the Mayor is hereby authorized and directed to execute a Quit claim Deed to such person or persons as may be designated by Raymond D. Sloan conveying to such person or persons the above described property. ADOPTED AND APPROVED this 19th day of April, 1971. ATTEST: I, Stephen A.
