RESOLUTION NO. 15, SERIES OF 1970
A RESOLUTION CONCERNING X-RATED FILMS WITHIN THE CITY OF ENGLEWOOD, COLORADO.
WHEREAS, the members of the city council have heretofore received numerous
petitions and letters of protest relative to the exhibition of x-rated films in the
City of Englewood and have received large numbers of citizens who have appeared in
Council meetings to openly and publicly protest the display of said X-rated films
within the City of Englewood; and
WHEREAS, a committee of the City council, as well as other citizen committees
have viewed the X-rated film presently being shown at one of the local theaters within
the City: and
WHEREAS, the City council has received reports from the City Attorney, from
the Colorado Municipal League, and others relative to the possibility of effective
municipal legislation to control the exhibition of said films: and
WHEREAS, the City Council is fully aware of the two pending Colorado State
Supreme court actions involving said films; and
WHEREAS, the City council is aware of the fact that such films are the subject
of local, state, and national concern: and
WHEREAS, the City Council has an abiding conviction that obscenity is not
protected by the Constitution.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD,
COLORADO, as follows:

1. That the City council of the City of Englewood finds and determines that
X-rated films such as "Infra-sexum," considered and taken as a whole, appeals predominently
to prurient and shameful interest in nudity, sex, and sexual conduct.
2. That such film material and the performance goes substantially beyond
the customary average adult limits of candor in depicting nudity, sex, and sexual
c onduct ~nd is utterly without redeeming social value in this community and as such,
the council considers the same an obscene film within the generally accepted meaning
of that t e rm, a nd as such, condemns its public showing.
