HomeMy WebLinkAbout1969 Resolution No. 012RESOLUTION NO. 12, SERIES OF 1969 WHEREAS, the street improvements in Paving District No . 17 , i n En g l e wood, Colorado, have been satisfactorily completed a nd h ave been accepted by the City of Englewood: and WTIF.RF.A S , ~ Rt~t e m c n t showing th e whol e cost of sa i d improv emen ts a nd a p r opo sed apportionment of the same on the prope rty in said District has been filed with the Director of Fi n a n ce : and WHEREAS, the City Council has considered the special benefits accruing to each lot or tract of land in the District by reason of the making of said street improvements and has determined t hat the apportionment of the assessments for said improvements as set forth in the following Notice, is in accordance with such ben ef i t s: THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE C I TY OF ENGLEWOOD, COLORADO: 1. That the Director of Finance is hereby authorized a nd directed to notify the owners of the property to be assessed fo r said improve me nts by advertisement in three consecutive weekly issu e s of The Engl e wood He rald, a newspaper published and of gen- e ra l circulation in the City of Englewood, that said improvements have been completed and accepted, that the cost thereof has been apportioned according to benefits and that a hearing on the assess- ments will be held at the time and place set forth in the Notice, and by mailing a sunonary of said Notice to all owners of property to b e assessed with the costs of said improvements. The summary of the Notice shall be forwarded by prepaid mail at or about the t ime of the first publication of the Notice. The hearing shall b e held not less than fifteen days following the first publication o f the Notice. 2. That the published Notice shall be in substantially the following form: PUBLIC NOTICE OF THE COMPLETION OF STREET IMPROVEMENTS IN PAVING DISTRICT NO. 17, IN THE CITY OF ENGLEWOOD, COLORADO, OF THE APPORTIONMENT OF THE COST THEREOF AND HEAR- ING THEREON. TO ALL PERSONS INTERESTED GENERALLY and to the owners of real estate which is hereinafter described, said real estate c om p rising the District known as Paving District No. 17, Englewood, Colorado: NOTICE IS HEREBY GIVEN: That the improvements in Paving District No. 17, Englewood, Colorado, which were authorized by Ordinance No. 10, Series 1968, finally adopted and approved on the 18th day of March, 1968, have been completed, that the same ha v e b ee n a c c e p ted by t h e City council of the City of Englewood, and that the cost thereof has been apportioned against the real p rope rty in the District according to benefits. NOTICE IS FURTHER GIVEN: 1. That the whole cost of said improvements has been def i nitely ascertained and is the amount of $428,960.45, said amount including costs of inspection, collection, incidentals and i n t e rest as a l l ow e d by law. 2. Of the whole cost stated in paragraph 1, the City of Englewood will pay $80,239.42, leaving the amount of $348,721.03 to be assessed against the real property in the District for the cost of the improvements. 3. That any complaints or objections which may be made in writing by the owners of land within the District to the City Council and filed in the office of the Director of Finance on or before Thursday, the 24th day of April, 1969, will be heard and determined by the City Council before the passage of an ordinance assessing the cost of said improvements. 5. Complaints or objections to be proposed assessments will be heard by the City Council on Monday, the 12th day of May, 1969, at the hour of 8:00 o !clock P.M., at the City Hall in said City. IS HEREBY GIVEN That the assessment roll for the City of Englewood, Colorado, Paving District No. 17 has been filed in the office of the City Clerk. The owner or owners of any property which is assessed in said assessment roll, whether named or not in said roll, may, on or before the 24th day of April, 1969, file with the undersigned, his, her or their complaints or objections in writing to the pro- posed ~sscss m c n ts . The City Council will meet to hear and consider complaints or objections to the assessments by any party or parties aggrieved thereby on Monday, the 12th day of May, 1969, at 8:00 o'clocl P.M., at the City Hall in said City. Any complai nt or objection to the validity of the assess- ments or the proceedings taken therefor shall be deemed waived un- less presented in writing at the time and in the manner indicated ~o~. Should any one or more sections or provisions of this Resolution be jud icially determined invalid or unenforceable, such determination s hall not affect, impair or invalidate the remaining provisions hereof, the intention being that the various provisions hereof are severable.
