A RESOLUTION AUTHORIZING AND DIRECTING THE INSTITUTION
OF EMINENT DOMAIN PROCEEDINGS TO ACQUIRE CERTAIN PROPERTY UPON
WHICH IS TO BE CONSTRUCTED A RESERVOIR, ACCESS ROAD AND APPURTENANT
IMPROVEMENTS.
Jl)W, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ENGLEWOOD as follows:
l. That the City of Englewood does hereby, pursuant
to statute, determine to construct and has authorized the construc-
tion, as a public work and improvement, of a reservoir, access
road, and appurtenant improvements in Grand County, Colorado,
as a portion of the Ranch Creek Transmountain Diversion Project
of said city. Such construction to be made for the public purpose
of supplying numicipal water to the water works of this city.
2. That the City Council of the City of Englewood,
pursuant to statutory authority, does hereby find and determine
that construction of aforesaid public works and improvement,
cons i sting in part of a reservoir, access road and appurtenant
improvements, constitutes a public necessity.
3. That the Council further finds and determines that
acqui s i tion of title to the following described real property is
n ecess ary to p e rmit construction of said public improvement con-
sisti n g of the aforesaid reservoir, access road and appurtenant
improv e me nts as follows, to-wit:
A 216 acre tract of land described as follows:
Beginning at the SE corner of Section 11, Township 1
North, Range 75 W of the 6th P.M.: thence S 89° 27' W
along the South line of said Section 11, a distance of

4. 'l'hat negotiaitons with the owners thereof, Alma
M. Johnson, Edward E. Johnson and Ernest L. Johnson, have been
carried out and that said negotiations have failed and the
C i t y i s unable to agree with the owner upon the purchase of
