BATTAGLIA AND LANA LOGAN, DOING BUSINESS AS LUCKY LADY CLUB OF ENGLEWOOD, TO SHOW CAUSE WHY THE HOTEL AND RESTAURANT LIQUOR LICENSE PRESENTLY HELD BY THEM AND LOCATED AT 4155 SOUTH BROADWAY, ENGLEWOOD, COLORADO, SHOULD NOT BE REVOKED OR SUSPENDED FOR VIOLATION OF REGULATION 19 OF TllE SECRETARY OF STATE OF THE STATE OF COLORADO, AS THE STATE LICENSING AUTHORITY, AND SETTING A TIME AND DATE FOR HEARING THEREON. WHEREAS 75-2-11 C.R.S., 1963, authorizes a local licensing authority, after investigation and public hearing, to suspend or revoke any liquor license issued pursuant to said Statute for any violation of any rules or regulations adopted pursuant to said Statute: and, WHEREAS the Secretary of State of the State of Colorado has adopted certain regulations pursuant to the authority granted by said Statute, which provide, inter alia, as follows: "Each licensee shall conduct his establishment in a decent, orderly and respectable manner, and shall not permit within or upon the licensed premises the loitering of habitual drunkards or intoxicated persons, lewd or indecent displays, profanity, rowdiness, undue noise, or other disturbance or activity offensive to the senses of the average citizen, or to the residents of the neighborhood in which the establishment is located": and WHEREAS it has come to the attention of this City Council that there is a probable cause to believe that Joseph J. Battaglia and Lana Logan, doing business as the Lucky Lady Club of Englewood, have violated said regulation in that they have permitted upon the premises at 4155 South Broadway intoxi- cated persons, profanity, rowrlincss, undue noise and other <wl iv i ly of .._i s imilar nalure which has been offensive to the senses of the average citizen and to the residents of the neighbor- hood: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Englewood, as follows: 1. That Joseph J. Battaglia and Lana Logan, doing business as Lucky Lady Club of Englewood, as the holders of that hotel and restaurant liquor license located at 4155 South Broadway, Englewood, Colorado, should be, and are hereby, required to appear before this City Council, as local licensing authority, to show cause, if any there be, why the aforesaid license should not be suspended or revoked for violations of the aforesaid regulations in the manner hereinabove set forth. 2. That public hearing upon the aforesaid question is hereby scheduled to conunence at the hour of 8:00 o'clock P.M., on Monday, October 20, 1969, in the City Hall, City of Englewood, 3400 South Elati Street, Englewood, Colorado. 3. That the City Clerk is hereby authorized and directed to provide to the aforesaid licensees, notice of the aforesaid charges and of the time, date and place set for public hearing thereon by providing to each of said licensees a certified copy of this Resolution, via certified mail, directed to them at the address stated in the license. f;~~~ .
