HomeMy WebLinkAbout1968 Resolution No. 020AI I RESOLUTION NO. 20A, SERIES OF 1968 A RESOLUTION DENYING THE APPLICATION OF SAFEWAY STORES, INC., DOING DUSINESS AS SAFEWAY STORE NO. 004, FOR A FERMENTED MALT BEVERAGE LICENSE TO BE LOCATED AT 125 EAST HAMPDEN AVENUE. WHEREAS Safeway Stores, Inc. has heretofore made applica- tion, pursuant to the provisions of Chapter 75, Article 1, Colorado Revised Statutes, 1963, as amended, for the issuance of a fermented malt beverage license to be located at 125 East Hampden Avenue, Englewood, Colorado, and WHEREAS notice of said application, and of the public hearing thereon has been properly given and pl:Jblic hearing upon said application was properly conducted on the 15th day of April, 1968, before the City Council of the City of Englewood, as the local licensing authority, and all other procedural requirements of the statute having been complied with, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, as follows: That, based upon the application of said Safeway Stores, Inc., and the evidence and information adduced at the public hearing upon said application, the City Council of the City of Englewood should, and does hereby, adopt the following findings and conelusions: 1. The applicant is a corporation organized under the laws of the State of Maryland and is duly qualified to do business within the State of Colorado. 2. The Store Manager at which any license would be located, as well as the officers and directors of said corporation, are of good character and reputation and have not been con~ victed of a felony or crime within any court of the United States or with any court of record of any state or territory of the United States. 3. Even though the petitimn submitted by applicant in favor of the issuance of said license numbered approximately 741 while the signatures upon the remonstrances submitted in protest of the issuance of said license numbered only approxi- mately 320, in view of the testimony induced upon public hearing, as well as the fact that there are several package liquor stores, three-way liquor establishments and at least one 3.2 outlet within a relatively short distance of the location requested in the application, it is the finding and the conclusion of this Council that the reasonable require- ments of the neighborhood are presently being met by the existing outlets. BE IT FURTHER RESOLVED that, based upon the foregoing, the application of Safeway Stores, Inc., for the issuance of a fer- mented malt beverage license to be located at 125 East Hampden Avenue, Englewood, Colorado, should, and is hereby, denied. /~ ATTEST: ~r)
