RESOLUTION NO. 32, SERIES OF 1967
A RESOLUTION AUTHORIZING AND DIRECTING THE INSTITUTION
OF EMINENT DOMAIN PROCEEDINGS TO ACQUIRE CERTAIN PROPERTY UPON
WHICH IS TO BE CONSTRUCTED A RESERVOIR AND APPURTENANT IMPROVE-
MENTS.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY o~· ENGLEWOOD as follows:
1. Th at t he C i Ly o f En g lewood does hereby, pursuant to
statute, determine to construct and has authorized the construction,
a s a public work and improvement, of a reservoir and appurtenant
improvements in Grand County, Colorado, as a portion of the Ranch
Creek Transmountain Diversion Project of said city. Such con-
s t ruct i on to be made for the public purpose of supplying municipal
wate r to the water works of this city.
2. That the City Council of the City of Englewood, pur-
suant to statutory authority, does hereby find and determine that
construction of aforesaid public works and improvement, consisting
in part of a reservoir and appurtenant improvements, constitutes a
public necessity.
3. That the Council further finds and determines that
acquiaition of title to the following described real property is
necessary to permit construction of said public improv ement consisting
of the aforesaid reservoir and appurtenant improvements as follows,
to wit:
All of the NW~ of Section 13, Township 1 North, Range
75 West of the 6th P.M.
Except a 47.4 acre tract of land lying South and West
of the High Water Traverse of Meadow Creek Reservoir
described as follows:
Beginning at the West \ corner of Section 13 whence the
Northwest corner of Section 13 bears North 2°56'40" West,
a distance of 2,570.32 feet; thence N 2° 56' 40" W, a
distance of 944.92 feet to High Water Traverse; thence
along High Water Traverse on the following bearings and
distances:
thence N45° 39' E, a distance of 86.0 feet:
thence N60° 40' E, a distance of 119.8 feet;
thence N77° 12' E, a distance of 120.5 feet;
thence N81° 05' E, a distance of 199.1 feet;

Except a 20.7 acre tract of land bounded on the North,

Reservoir described as follows: Beginning at a point on the East
line of the NW~ of Section 13, whence the N~ corner of said Section
13, bears N 2° 48' E, a distance of 383.38 feet; thence following

4. That negotiations with the owner thereof, L. R.
Meister, have been carried out and that said negotiations have
failed and the City is unable to agree with the owner upon the
purchase of said property.'
5. That having made a determination of necessity, and

City of Englewood in any and all legal proceedings herein authorized
