Notice of Election can be published on following dates:
July 19, 1972
July 26, 1972
August 2, 1972
August 9, 1972
Firemen's amendment must be published with the call.
Law requires that a Special Election be called on the
Petition of 5% of registered voters, within 120 days
of the Notice u..~less a Regular:E!..ection is scheduled
within the 120 days.
"Regular election" could mean the Primary Election
September 12, 1972 or the General Election on
November 7, 1972. It probably means the General
Election on November 7, 1972 (Chapter 139-90-11 (3))
SUBMISSION OF CHARTER AMENDMENT BY ORDINANCE
Ordinance cannot be passed even with an emergency clause
in order to meet September 12, 1972 election.
Reasons, therefore,that the proposition must be published
for two successive weeks no earlier than five weeks from the
date of election nor later than three weeks from the date of
election. Therefore, the submission by Ordinance could not
be completed prior to the date that the proposals would be
required to be published which would be August 9, 1972 and
August 16, 1972.
The only feasible date then remaining would be the
General Election on November 7, 1972, which then would
require an Ordinance to be introduced no later than
September 5, 1972 and earlier than August 21, 1972.
The Ordinance would require an emergency clause.
With a November 7, 1972 date as date of election, publication
of proposals would take place October 4 and 11, 1972 .
