HomeMy WebLinkAbout2023 Resolution No. 0221 RESOLUTION NO. 22 SERIES OF 2023 A RESOLUTION AUTHORIZING THE CLOSURE AND CITY- FUNDED MAINTENANCE OF SIDEWALK AREA ON THE NORTH SIDE OF BELLEVIEW AVENUE, BETWEEN S. LOGAN AND S. SHERMAN. WHEREAS, the City of Englewood, seeks to maintain a safe and attractive community where all residents, businesses and other stakeholders can thrive; and WHEREAS, the Colorado Department of Transportation does not maintain pedestrian infrastructure behind the gutter line of their roadway system, including Belleview Avenue, also known as State Highway 88; and WHEREAS, the sidewalk between S. Logan and S. Sherman on Belleview Avenue is not appropriate for pedestrian traffic, given it provides less than 36 inches of clearance for pedestrians to traverse the sidewalk; and WHEREAS, residents along Bellwood Drive that back up to Bellevue Avenue have petitioned the City of Englewood for many years for assistance with maintenance of weeds and snow along Belleview Avenue that would otherwise be their responsibility under Englewood Municipal Code; and WHEREAS, Englewood Police Department has determined that because the sidewalk area provides less than 36 inches of clearance along the north side of Belleview Avenue between S. Logan and S. Sherman, it may not be appropriate for some residents to perform routine maintenance of weeds and snow removal; and WHEREAS, the Englewood City Manager wishes to enforce laws in the City equitably, unless otherwise directed by City Council in special or extenuating circumstances; and WHEREAS, the Englewood City Council recognizes that the sidewalk area along Belleview between S. Logan and S. Sherman poses a unique condition for residents to maintain, and thereby warrants an exception to otherwise-applicable municipal code provisions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1. City Council hereby closes to pedestrian traffic the sidewalk area between S. Logan and S. Sherman along the north side of Belleview Avenue, and directs that City staff shall post signage to this effect at that location. Section 2. City Council hereby directs the City Manager to utilize City resources to maintain the sidewalk area between S. Logan and S. Sherman along the north side of DocuSign Envelope ID: 59B33E62-1A40-44B2-8502-2C66F3DC3A44 2 Belleview Avenue, by keeping it clear of weeds, grass, trash, and nuisances. This section of sidewalk area shall be exempt from any requirement that residents maintain it, including but not necessarily limited to EMC § 11-3-2 (snow and ice), EMC § 15-6-1 (weeds and grass), and EMC § 15-2-1 (nuisances).
