MEMO
TO: Mayor Otis and Members of City Council
DATE: January 12, 1983
RE: Community Center Election Date May 17, 1983
After researching the State Statutes and the Home Rule Charter,
it is the opinion of this office that the first feasitle date
to have an election for the community center is May 17, 1983.
This opinion is reached upon consultation with State Etatutes
and our Home Rule Charter. With respect to the State election
to f i ll the congressional vacancy by the death of Congressman-
elect Swiger, the County Clerk has authority to determine what
issues are placed on the ballot. The County Clerk has declinec
to include our issue involving the community center. My review
of our Home Rule Charter also indicates that pursuant to 14(3)
GO bond elections must be held separate and apart from all other
elections. This would mean that we would basically have to rur
our own election for the GO issue. We have not been able to fjnd
any case law to support that this would inf act be an election
separate and apart from the State election. There may also be
practical difficulties in conducting such an election, for
instance, separate rooms, separate ballots, separate register
books, separate judges, etc. I know that there has been some
discussion that joint elections have been held in the past.
However, I am relatively sure that none of those elections
included an issue relating to a GO bond issue. Originally, wh1 ~n
this matter was discussed last year, we were considering a gen ·~ral
question as to whether a community center should be built or n)t.
This would be much like the question surrounding the golf cour3e.
However, when GO bonds are involved, the conditions are differ 1 ~nt
according to our Charter as previously stated.
A school district election is scheduled for May 3, 1983. This is
a general biennial school election and not considered a state
election for these purposes so our research indicates. We have
also contacted Secretary of State's office and they are in agree-
ment with this particular issue. Finally, looking at our Charter,
the 45 days before or after a general municipal or state election
provision of 14(2), since we are not hampered by the May 3rd election,
the next available date would be May 17, 1983 .

I have discussed this matter with bond counsel, WLlliam 0. Lamm,
and he agrees with the interpretation, and we are planning on
May 17, 1983 as the date for the community center GO bond election.

SUBJECT: Special Election
Eric Johannisson called the County Clerk, Marjorie Page, asking
about the possibility of holding the City's special election at the
same time as the upcoming special congressional election. The
rumor is that the congressional election will be held on March 22,
March 29, or April 5. Mrs. Page said that the City would not be
able to hold our election simultaneously with the congressional
election.
Would you research what our alternatives are for conducting our
election? Council will need to know the options available.
Our office is continuing to plan on holding the election on
March 1.

MEMORANDUM

DATE: November 23, 1982
SUBJECT: ELECTION ON COMMUNITY CENTER
The City Council has directed that an election be held on
a Community Center by no later than March 1 and hopefully
earlier. The election would be for the purpose of approving
general obligation bonds for at least a portion of the
financing of the center. I should know by the end of the
year the exact location of the center. I am currently working
with the Meadow Gold officials for the site on Kalamath and
Oxford.
Please review this with Eric and the City Attorney's office
and provide me with a timetable with all necessary actions
