RESOLUTION NO. 23__
SERIES OF 2023
A RESOLUTION AUTHORIZING THE EXECUTION OF A CONTRACT
WITH CHANCE RIDES TO PURCHASE AN ELECTRIC-POWERED
TRAIN FOR BELLEVIEW PARK
WHEREAS, Denver Broncos Football Club and the Metropolitan Football
Stadium District Resolution distributed a portion of Broncos franchise sales proceeds to
the counties, cities, and towns within the seven-county metro Denver boundary, including
$1,119,139.81 to the City of Englewood; and
WHEREAS, the funds are restricted for youth activity programs only; and
WHEREAS, the City of Englewood Belleview Train is aged, with significant
required repairs, and is in need of replacement; and
WHEREAS, City staff proposes to use a portion of the above-referenced funds to
replace the train with an electric, ADA-compliant train for youth activity programs in
Belleview Park; and
WHEREAS, Englewood Municipal Code § 4-1-3-1(B)(2) allows for the purchase
of equipment and machinery from an optimal source without competitive bid, when
approved by Resolution; and
WHEREAS, City staff identified only two train manufacturers that produce trains
suitable for Belleview Park, and only one of the two train manufacturers could meet the
specifications for ADA compliance and seating capacity; and
WHEREAS, the award of this contract for a train purchase to an optimal source
is appropriate under Englewood Municipal Code § 4-1-3-1(B)(2).
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS:
Section 1. The Englewood City Council hereby authorizes approval of a contract
in an amount not to exceed $492,550.00 for the purchase of an electric train from Chance
Rides. Such contract shall be in substantially the same form as that attached hereto.
Section 2. The Mayor, Mayor Pro Tem (in the Mayor’s absence), and/or City
staff are hereby granted the authority to take all actions necessary to implement the
provisions of Section 1 above.
