Section I .
NaMe. The name of the organization is the "Code Enforcement

Section ,
Powers. In order to perform the duties enumerated in Section
above, the Committeeshall have the authority:

ARTICLE 11
gection 1. Structure. The Committee shall be composed of 7 members who
shall serve without compensation., Committee members shall be appointed by
City Council for two (2) year terms. Whenever a vacancy becomes due, Council
shall fill the vacancy. Members appointed to vacancies will serve out the
remainder of the vacancy or two (2) years, whichever is shorter. In addition to the
7 members appointed by the City Council the Committee shall also have up to
three (3) ex-officto staff members appointed by the City Manager and two (2)
Council Liaison members.
The committee may also have up to two (2) alternate members.
Section 2. Officers. The Chair and the Vice Chair shall be elected by a majority
vote of the Committee, and shall •s the Executive Committee of the Code
Enforcement Advisory Committee. The Chair and Vice Chair shall be elected for
one (1) year terms and no officer shall serve more than two consecutive terms in
the same position.
Section 3. Sub-CommLftees. The Committee may establish any sub-
committees, which, in its discretion, are necessary for the purposes of the
Committee. Each sub-commiftee shall be composed of a Chair an optional Vice
Chair and other members as needed to achieve the objectives oft sub-
committee.
Section 4. Votina Riallits. All members of the Committee except ex-officlo
members and Council Liaison members shall have one vote equal in weight. All
voting shall be by voice vote; provided, however, the Chair of the Committee
may, at his/her discretion, call for a roll call vote.

exception of executive sessions allowed by Colorado law.

§ection 4.'1 Quorum. A simple majority of the voting Committee members shall
constitute a quorum fort transaction of business.
Section §j Transaction of Business. Every act or decision on or made by a
majority of the Committee members present at a duly held meeting at is a
quorum is present shall be regarded as the act of the entire Committee.

designated by the Committee members. A meeting shall not last longer than two
hours from the time It commences, unless a majority oft Committee members
present at a duly held meeting vote to allow such meeting to continue for longer
than the two hour duration.
Section:Z. Roberfs Rules of Order. All meetings shall be conducted according
to Roberts Rules of Order, Current Edition. It shall be the responsibility of each
Committee member to -observe that these rules are followed and the meeting
conducted in accordance therewith.
ARTICLELV
Section 1. Ten_ure. Members will be appointed to overlapping terms of two (2)
years.
Segjgn si n ticnt Any member may resign at any time by giving written
notice to the Chair and City Council. Such resignation shall take effect upon
acceptance by City Council.
Section 3. Remayal. Any Committee member missing more than two (2)
consecutive meetings without prior notice or a total of three meetings without
prior notice in a calendar year shall be removed by City Council.
SectionA. Duties. The duties are as follows:
1. Ch i on The Chair shall serve as the Chief Executive Officer of the
Committee; shall act as public spokesperson for the Committee at public
functions; shall serve as ex-officio member of all sub-commiltees; shall
prepare an annual report and other reports as needed and shall perform
all other duties as the Committee elects.

2. Vige ChalMIrson The Vice Chairperson will act in the place and stead of
the Chair in the event of his/her absence, inability, or refusal, to act, and
shall exercise and discharge such other duties as may be required of
him/her by the Commiftee.
3. Ir_easurer The Treasurer shall be the Vice Chair unless by majority vote
the committee decides to elect a separate person to fulfill these duties.
The Treasurer will coordinate with the City's Finance and Administrative
Services Department to assure accurate records of the funds, debts,
expenses and donations of the Committee.
4. Alternate Members Alternate members will serve as voting members only
in the event that a quorum is not otherwise present. Alternate members are
otherwise free to propose items for the agenda, Alternate members may also
be appointed to sub -committees with the consent of a majority of the
committee.
ARTICLE__V
Section 1. ManagemeLt of Funds. The Committee, with City Council approval,
will have the power to receive and disburse funds within the limitations of
appropriations, gifts and grants and in connection with projects or undertakings
consistent with Article 1, Section 3. Within the same limitation, the Committee will
be empowered to contract with any private or public agency to the extent
required for its -.proper operation. The Committee will report to the City Council
annually. The Report will include the Committeexs actions and accomplishments
in connection with each project or undertaking and will include as part of its
report a statement of its receipts and disbursements for the preceding 12
months. Additionally the Committee will present its proposed annual budget
during each July, including its anticipated revenues and expenditures, and
source of its anticipated revenues. The Committee shall keep such records as
will enable it to make such reports and accountings and the same will be subject
to verification and examination by the City Treasurer and/or auditors of the City.
ARTICLE VI
Segtion 1. Amendments. These By -Laws may be amended by a two-thirds (2/3)
vote of the Committee members present at any regular meeting provided (1) a
quorum is present; and (2) notice was presented in writing at the previous
Committee meeting. A copy must be presented to the City Clerks Office and a
courtesy copy to the City Council.

COUNCIL GOAL AND PREVIOUS COUNCIL ACTION
Staff has proposed the creation of a Code Enforcement Advisory Committee as a departmental
advisory committee to review and make recommendations for Improved service delivery. Council has
held two work sessions on this topic.
RECOMMENDED ACTION
Staff seeks Council approval of a bill for an ordinance creating the Code Enforcement Advisory
Committee.
BACKGROUND, ANALYSIS, AND ALTERNATIVES IDENTIFIED
Per Council's request, this ordinance creates an 11 member departmental advisory committee,
supported by three staff and two Council liaison members. The attached ordinance outlines the role of
the committee.
FINANCIAL IMPACT
No financial impact Is foreseen as a result of the creation of this committee.
