HomeMy WebLinkAbout2023 Resolution No. 0291 RESOLUTON NO. 29 SERIES OF 2023 A BUDGET SUPPLEMENTAL RESOLUTION TO AMEND APPROPRIATIONS WITHIN THE 2023 BUDGET OF THE CITY OF ENGLEWOOD WHEREAS, the City of Englewood is required by Section 83 of the Englewood Home Rule Charter to ensure that expenditures do not exceed legally adopted appropriations; and WHEREAS, the 2023 Budget was submitted and approved by the Englewood City Council in Ordinance 50, Series of 2022, on October 17, 2022; and WHEREAS, the 2023 Budget was amended by the Englewood City Council in Resolution No. 9, Series of 2023, on February 21, 2023; and WHEREAS, the 2023 Budget was amended by the Englewood City Council in Resolution No. 14, Series of 2023, on May 1, 2023; and WHEREAS, the 2023 Budget was amended by the Englewood City Council in Resolution No. 18, Series of 2023, on July 17, 2023; and WHEREAS, specific expenditures for 2023 have now been identified, necessitating these supplemental and amended appropriations to be hereby presented for the consideration and approval of the City Council; and WHEREAS, the city completed the Classification and Compensation Study and is ready to implement the results by reclassifying the budgeted amount from Contingency to the general government departments and modify the budget accordingly; and WHEREAS, the city has contracted with Historic Englewood to provide office space on the second floor of the Englewood Civic Center and a grant to offset costs to modify the space and to assist with administrative costs and amend the budget for this appropriation request; and WHEREAS, the general government department budgets were reduced by a historical personnel and non-personnel line item budget savings percentage; however, the Human Resource Department was fully staffed in 2023 and the Information Technology Department was almost fully staffed in 2023 and neither department was able to absorb fully the estimated reduction amount and therefore a budget amendment is requested, and WHEREAS, a provision in the Colorado House Bill 2021-1162 for the Management of Plastic Products requires businesses to remit to the city $0.06 of the $0.10 fee charge to customers who purchase single use carryout plastic bag. This fee is to be used to offset costs for administrative, enforcement, recycling, composting or other waste diversion programs and related outreach and education activities. Staff plans to use a portion of these funds to support businesses in their public outreach efforts to provide information regarding the state’s goal to remove Styrofoam containers from the marketplace by the end of 2024 and requests to amend the budget for these newly identified endeavors, and WHEREAS, the city has entered into an Intergovernmental Agreement with the City of Littleton to manage a couple of the Tri-Cities Homelessness Action Plan projects funded by the American Rescue Plan Act; these projects were previously authorized by City Council and staff requests amending the budget for this expenditure; and WHEREAS, Section 92 of the Englewood Home Rule Charter requires City Council to adopt a DocuSign Envelope ID: A22EC9AD-B058-45AD-BF79-C0C294D57249 2 Resolution to transfer any unencumbered appropriation balance or portion thereof from one department, office or agency, to another; and WHEREAS, Section 93 of the Englewood Home Rule Charter requires that appropriations in addition to those contained in the budget shall be made only on the recommendation of the City Manager, and only if the City Treasurer certifies that there is an available cash surplus sufficient to meet such appropriations; and WHEREAS, in conformance with Sections 92 and 93 of the Englewood Home Rule Charter, the City Manager hereby requests a Budget Supplemental to authorize the transfer of funds within the adopted City of Englewood 2023 budget as set forth below. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS: Section 1.
