I I I Minutes o f May 21 . 1962 NON -SCHEDULED CITIZENS The Mayor aaked if there were any persons present who wished to speak to the Council. Mr. James Murphy. 2001 Bast Floyd Avenue. asked to speak to the Council. Be stated that he has a 9reat interest in his local 9overnment and wished to see that local government remain free from corruption and scandal. Very undesirable publicity alon9 these lines had appeared in the papers throughout the nation with reqard to the 9overnment at the Federal level . Accordingly he was interested in callin9 to the City Council's attention that three members of the Council had a conflict of interests sufficient enough in his opinion to warrant a very conscientious review of their activities as Councilmen . He s~ated that in these opinions he was speak- in9 for himself only. Be urged the Council to do away with executive sessions as they are not democratic and do not allow the public to participate in the decision mak ing meeting• of the Council. He listed the three Councilmen wi th conflicting interests as: Mayor McLellan . who has a lease for City owned land. had secured a 300 foot drive-way and other f avors f rom the Cityr Councilman Brau~ who was directly interested in the aonin9 o f the site f or a Nursin9 Home which he was deaiqning for the owner o f that site. the architectural desi9n of the Colorado Central Power Company. which company also has a very 9reat interest in annexation and further had provided a desi9n for a proposed extension o f the City Hall Buildings and finally Councilman Smukler. who as an Officer o f the First National Bank of Englewood is instrumental in seeking special leqialation for the ?irat National Bank as well as acting upon tax and zon- ing matter of indirect interest to the Bank. Be stated that none of the particular actions are ille9al as such. but cause quest i ons in the citizens minds . He also stated that each of the items mentioned had been reported in the Englewood Herald newspaper and. therefore, was of cOll'lnOn public k nowledge. Mayor McLelland and other suggested that Mr. Murphy secure accurate information from the individuals involved or the City records before mak- ing rash statements as made this evening. Eaah of the Councilmen listed refuted Mr. Murphy and his claims as to their special privile9es. The Mayor declared the matter ended. MAYOR'S CHOICE 621-98 Renewal of the Tri-City Trust Agreement The Mayor discussed recent act i on on behalf of the members of the Tri-City Trust wherein Denver and Littleton wished to continue the trust and Englewood f avored abandonin9 the or9anization . Under the circumstances o f a two to one vote, Englewood agr• .. ·~O purchase or dispose the remain- i ng available water ri9hts in the area. The Mayor reported on a recent Urban Mayors' Meeting at which a state- wide proposal f or a sales tax based upon a population basis, revenues to be used by the cities had been proposed.
