HomeMy WebLinkAbout1962-09-04 (Regular) Meeting MinutesCOUNCIL CHAMBERS CITY OF ENGLEWOOD, COLORADO SEPTEMBER 4, 1962 REGULAR MEETING: The City Council of the City of Englewood, Arapahoe County, Colorado, met in regular session on Tuesday, September 5, 1962 in the Council Chambers, City Hall, , Englewood, at the hour of 8:00 P.M., due to the fact that Septemb er 3, 1962, the first Monday of September, was a legal holiday, Labor Day, as by ordinance provided. Mayor Brownewell presiding called the meeting to order and the invocation was given by Reverend Lundberg of St. George's Episcopal Church. The Mayor asked for roll call. Upon the call of the roll, the following persons were present: Councilmen: Braun, Love, Miles, Parker, Smukler, Woods. Brownewell. Also Present: City Manager Dial, City Attorney Esch, City Clerk Beausang. Absent: None. The Mayor declared a quorum present. 622-2 CONSIDERATION OF MINUTES COUNCILMAN LOVE MOVED, COUNCILMAN SMUKLER SECONDED, THAT THE MINUTES OF AUGUST 20, 1962 BE APPROVED AS CORRECTED. Upon the call of the roll, the vote resulted as follows: Ayes: Councilmen Braun, Love, Miles, Parker, Smukler, Woods, Brownewell. Nays: None. Absent: None. The Mayor declared the motion carried. 622-58 PRESENTATION O~ MUNICIPAL CODE Mr. John c. Banks, of Banks Municipal Code, discussed the recently completed Municipal Code of the City of Englewood. He stated that nearly 18 months ago he had entered into a contract with the Ci ty for codification .Qf its ordinances of general and permanent nature. He discussed the preparation of the code and set forth that: 1. The loose leaf boock had 5 rings and would lock the pages in, 2. The pages of the book were 50 pound paper, 3. That there was both a table of contents, which set out the chapters only, and an index, 4. That each chapter had a list of the sections contained therein at the beginning of that chapter, 5. That Charter references and State Statute references were pro- vided where pertinent. Mr. Banks stated that Chapter 22 of the Municipal Code was a compiled copy of the Zoning Ordinance of the City. This Ordinance had not been codi- fied due to the probable problems of passage of this type of ordinance by reference. He set out the procedure of adoption of the Code, stating that it would be adopted as a book by reference as well as the adoption of a Technical Plumb- ing Code and Building Code by reference. Public notice would be given of the preparation of the Code and public copies provided. After a sufficient passage of time an ordinance adopting the Code would be enacted. He stated that he did not change the substance of any ordinance but had placed the contents of the ordinances in a logical sequence for indexing and reference. He remarked that undoubtedly there were corrections the Council wished to make but he suggested that the Code be adopted as presented then amended after in full force and effect. He urged that provisions be made to keep the Code up to date by frequent supplements and revisiona. Councilman Braun discussed the means for updating of the Code. Mr. Banks replied that any means the Council desires can be utilized, the most conunon is that of inserting revised pages for amended sections, and paragraphs once a year. He informed the City Council that the Code was complete through June 1, 1962 and the zoning Ordinance complete through January 1, 1962. The Mayor thanked Mr. Banks for his work on the Municipal Code and his appearance at the meeting to explain the method of codification. ,.,/ '• 'I 'I I I I 'I I I Minutes of September 4, 1962 The City Attorney reported that Mr. Banks had prepared forms for notices of public hearing and adopting of the ordinance. He stated that he would re- view these forms and present them to the Council for its consideration on September 17th and suggested that the public hearing be held on October 15th. The Mayor accepted the City Attorney's direction and ordered him to pre- pare notices as required. 622-21 PUBLIC HEARING ON REZONING OF AREA BETWEEN SOUTH JD(BRSON AND SOUTH CLARKSON STREETS AND BETWEEN EAST HAMPDEN AVENUE AND HIGHWAY . NO. 70 COUNCILMAN LOVE MOVED, COUNCILMAN MILES SECONDED, THAT THE PUBLIC HEARING BE OPENED. Upon the call of the roll, the vote resulted as follows: Ayes: Councilmen Braun, Love, Miles, Parker, Smukler, Woods, Brownewell. Nays: None. Absent: None. The Mayor declared the motion carried. The Ci ty Manager stated that this involved a request for rezoning the area from R-1-D (Residence District) to R-2-B (Residence District) and pointed out the area under consideration on the City map. The Mayor asked for appearance of those favorable to the rezoning. Mr. Audra Bailey, 3565 South Emerson, Mrs. Dale Flood, 3585 South Emerson, and Mr. Oliver Sidebottom, 3530 South Clarkson .. Street, spoke for the rezoning. The Mayor asked if there were any persons present in opposition to the proposed rezoning. Mr. J. c. Kirk, 3520 South Clarkson, stated that he would rather have the zoning R-3 the same as the west side of the street rather than R-2 •. Discussion ensued. Councilman Love stated that zoning is requested by residents of an area and such request is made subject to approval of the Planning Commission and Council after public hearing. Councilman Braun stated that the objection was to the zoning district but not to the zoning itself and, therefore, could not be considered by the Council. COUNCILMAN PARKER MOVED, COUNCILMAN WOODS SECONDED, THAT THE PUBLIC HEAR- ING BE CLOSED. Upon the call of the roll, the vote resulted as follows: . Ayes: Councilmen Braun, Love, Miles, Parker, Smukler, Woods, Brownewell. Nays: None. Absent: None. The Mayor declared the motion carried. 622-30 PUBLIC HEARING ON THE REZONING OF THE QUARTER BLOCK IMMEDIATELY SOUTH- WEST OF SOUTH LINCOLN-EAST CHENANGO INTERSECTION COUNCILMAN BRAUN MOVED, COUNCILMAN LOVE SECONDED, THAT THE PUBLIC HEARING BE OPENED. Upon the call of the roll, the vote resulted as follows: Ayes: Councilmen Braun, Love, Miles, Parker, Smukler, Woods, Brownewell. Nays: None. Absent: None. The Mayor declared the motion carried. The City Manager pointed out the area immediately east of the Kinney Shoe Store, 4 9 00 South Broadway, between the South Broadway, South Lincoln Street alley and South Lincoln Street projected and fronting on East Chenango Avenue. This area had been proposed to be rezoned from R-1-C (Residential District) classification to C-2 (Business District). He commented that granting of this zoning request would complete the zoning of the 4900 block South Broadway and South Lincoln as C-2. The Mayor asked that those persons present favorable to the proposed re- zoning present their arguments. Mr. Elroy Shaffer, 4940 South Broadway, the applicant for the proposed re- zoning, stated that he had previously sou9ht R-3 zoning but that it had not been approved. He agreed that C-2 zoning appeared to be much more logical and in conformance with the zoning of the area. He also reported that he had provided for t h e deeding to the City for dedicat i on as an alley a strip of land behind the shoe store. 317 318 Minutes of September 4, 1962 The City 'Manager reported that the deed for the dedication of the land as an alley was pending and should be made a condition precedent to the final passage of an ord i nance rezoning the area if the Council should so desire. The Mayor asked if there were anyone present in opposition to the rezoning. There was none. COUNCILMAN LOVE MOVED, COUNCILMAN BRAUN SECONDED, THAT THE PUBLIC HEARING BE CLOSED. The Mayor declared the motion carried. 622-32 PUBLIC HEARING ON ZONING OF AREA BETWEEN WEST BELLEWOOD DRIVE AND WEST BELLEVIEW AVENUE AND THE SOUTH FEDERAL BOULEVARD-SOUTH GROVE ALLEY AND SOUTH FEDERAL BOULEVARD COUNCILMAN MILES MOVED, COUNCILMAN BRAUN SECONDED, THAT THE PUBLIC HEARING BE OPENED. Upon the call of the roll. the vote resulted as follows: Ay es: Councilmen Braun, Love, Miles, Parker, Smukler. Woods, Brownewell. Nays: None. Absent: None. The Mayor declared the mot i on carr i ed. The City Manag er located the area under considerat i on for zoning as being the one-hal f b lo ck between Bellev i ew and Bellewood Avenue immediately west of South Federal Boulevard and the Centennial Acres Shopping Center. He stated that C-2 (Business Distr i ct) had been requested for th i s tract. He remarked that the area was almost comple t e ly deve loped as commercial area at the present t i me. Mr. James Marks, 5050 South Federal, was the petitioner for the proposed rezoning and offered to answer quest i ons or explain what development may be proposed. The Mayor asked for those wh o were in opposition to the zoning . Mr. o. A. Ronnestadt, 5054 South Grove Street, expressed h i s objection to a r o ta ti ng f lash i n g l i ght s ign wh ich disturbed him and his neighbors. Mr. Mark stated t h at he notif i ed t h e operato rs of the Artie Circle Drive-In and would correc t t he s i tua tion. Mr. Ly nn F ey , 50 5 7 South Grove Street, suggested that the Building Code be amended t o pro h i b it the e r e ct i o n of such a si g n in residential areas. The City Manager s t a t ed that th e p ar t i c ular s ign i n questio n meets the sign code and urged t h at a c o r re ction b e made i n the s ign to prohibit the s i gn from flashing in bedroom w ind o ws of nearby residents. Mr. Victo r Daley, 5054 South Grove Street, inquired into t h e presently zoned cond ition o f R-1 and inqu i red wh y a commercial building was a l lowed to be erected under th is zoni n g . Counc i lman Braun discussed the erection of the c o mmercial· bu i ld i n g stating t h at it had been commenced as commerc i al prior to annexa t j on t o Englewo od and t h at as all of the other area was comercially developed the City didn't stop th~ erect i on of the buildi n g. Mr. Daley inquired about t h e sec t i o n of a screened area or fence at the rear of the commercial z o ne. The Mayor stated that he was not certain whether this was required under the Ord i nance but knew that there was prov i sions to prevent automob i le headlights fr om sh i n i ng i nto residential areas. Mr. Robert Olson, 5005 South Federal Boulevard, stated that he was favor- able t o t h e pro posed zoning as it con f orms rather closely to the ceunty zoning and f i ts the ex i sting pattern of bu i ldings in the area. The Mayor asked if there were any other persons to be heard. There were none. COUNCILMAN BRAUN MOVED, COUNCILMAN MILES SECONDED, THAT THE PUBLIC HEARING BE CLOSED. The Mayor declared the motion carried. ,·,1 I I I I I I I Minutes of September 4, 1962 The Mayor announced that ordinances had been prepared for zoning of each of the tracts upon which public hearings had been held and these bills would be considered later in the meeting. 621-42 PUBLIC HEARING ON PROPOSED CREATION OF SCENIC VIEW SANITARY SEWER DISTRICT COUNCIU>!AN BRAUN MOVED, COUNCILMAN LOVE SECONDED, THAT THE PUBLIC HEARING BE OPENED. Upon the call of the roll, the vote resulted aa follows: Ayes: Councilmen Braun, Love, Miles, Parker, Smukler, Woods, Brownewell. Nays: None. • Absent: None. The Mayor declared the motion carried. The City Manager reported that the bill for an ordinance for the crea- tion of the Scenic View Sanitary Sewer District had provided for a public hearing. Notice of the public hearing had been published as required. The Mayor asked if there were anyone present to speak at this public hearinq . There were none. The City Manager reported that he had received a telephone call from Mr. R. C. Reynolds, 5380 Sombrero, that his opposition to the proposed method of assessing be entered before the Council. Mr. Reynolds expressed the view- point that this assessment would work a hardship upon his property and other large tracts in the area. It was indicated that he may consider legal action regarding the creation of the district unless some relief is given to him and others. Discussion ensued. · The City Attorney reported that the benefit of land from a particular special improvement is hard to determine and often by a rule of thumb. He stated that he could not find a method to allow the exclusion of a tract from a proposed district in the State Statutes. COUNCILMAN WOODS MOVED, COUNCILMAN SMUJ<LBR SECONDBD, THAT THE PUBLIC HEARING BE CLOSED. Upon the call of the roll, the vote resulted as follows: -Ayes: Councilmen Braun, Love, Miles, Parker, Smukler, Woods, Brownewell. Nays: None. Absent: None. The Mayor declared the motion carried. Thereupon the Clerk announced that a bill for Ordinance No. 24, Series of 1962, creating an improvement district in the City of Englewood, Colorado, to be known as Scenic View Sanitary Sewer District, introduced and read for the first time in full at the regular meeting of the Council held on the 20th day of August, 1962, had, as ordered by the Council, been published in full in the Englewood Herald and Enterprise, a newspaper of general circulation published in E 1glewood, in its issue of August 23, 1962, and that the pub- lishers affidavit of said publication of said ordinance is now on file in the office of the City Clerk. Whereupon a public hearing on said bill for an ordinance was held and there were no persons present to oppose the creation of the district, although City Manager Dial reported an ob j ection voiced by Mr. R. c. Reynolds on be- half of Mr. Reynolds and other owners of large tracts of land who claimed that the proposed method of assessing would work a hardship upon them. Whereupon the City Council considered the objection and overruled•' it due to the fact that the method of assessing is set forth in the State Statutes and that these Statutes do not appear to have a method for exclusion of tracts of land. THEREUPON IT WAS MOVED, BY COUNCILMAN BRAUN, AND BECONDED BY COUNCILMAN WOODS, THAT SAID ORDINANCE BE NOW PLACED ON ITS SECOND READING AND FINAL PASSAGE AND THAT ALL RULES OF THE COUNCIL WHICH MIGHT PREVENT, UNLESS SUSPEN- DED, THE FINAL PASSAGE OF AND ADOPTING OF SAID ORDINANCE AT THIS MEETING BE, AND THE SAME ARE HEREBY SUSPENDED.
