A RESOLUTION ADOPTING THE FINDINGS, CONCLUSION AND DECISION OF THE
CITY COUNCIL OF THE CITY OF ENGLEWOOD, COLORADO, REGARDING THE
PLANNED DEVELOPMENT BY SANFORD COMPANIES AT 300 WEST BELLEVIEW
AVENUE.
WHEREAS, Case No. 34-85 for approval of a planned develop-
ment for a parcel of land at 300 West Belleview Avenue was heard by
the Planning and Zoning Commission; and
WHEREAS, the Planning and Zoning Commission recommended to
City Council that the application of Sanford Metzel (Sanford
Companies) be approved with certain stipulations;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ENGLEWOOD, COLORADO, AS FOLLOWS:
The City Council finds:
1. That the application is concerned with a parcel of land
at 300 West Belleview Avenue which is legally described on attached
Exhibit A and incorporated herein by reference.
2. That the area with which the application is concerned is
to be developed by Sanford Companies, a sole proprietorship,
Sanford K. Metzel, sole proprietor.
3. That the application for approval of a Development Plan
at the parcel located at 300 W. Belleview Avenue was filed with the
Department of Community Development on October 21, 1985, notice of
public hearing was published in the Englewood Sentinel on November
6, 1985, the property was posted no less than fifteen days prior to
the public hearing, and public hearing was held November 19, 1985.
4. The application was for approval of a Development Plan of
28.8 dwelling units per acre with 312 proposed dwelling units, 400
usable open space, maximum building height 45 feet, a 25-foot
buffer strip with landscaping and privacy fence along the property
line adjacent to a single-family zone district, 532 off-street
parking spaces, all of which comply with the R-3 High -Density
Residence District classification place on the property by the
City of Englewood.
5. The portion of the property which is in Littleton will be
utilized only for useable open space.

6. The applicant has committed to providing for the cost of
a traffic signal if it is required by the City Traffic Engineer
after studying the traffic patterns for a two-year period following
the issuance of a Certificate of Occupancy.
7. All of the City staff concerns were incorporated into the
design of the Planned Development prior to review by the
Commission.
8. Public access, emergency access and fire lane easements
have been taken into consideration.
9. The Planning and Zoning Commission recommends that
Application #34-85 filed by Stanford Metzel for a Planned
Development at 300 West Belleview Avenue be approved with the
following stipulation:
a. There shall be a two-year traffic study following the
issuance of the final Certificate of Occupancy; if, in the opinion
of the City Traffic Engineer, a traffic signal is warranted at the
South Delaware Street/West Belleview Avenue intersection, it shall
be installed at the expense of the developer.
b. A fire crash gate access shall be installed on the
southeast corner of the property to provide emergency access from
the south through the South Slope development via the east fire
lane.
10. City Council held a public hearing on the application on
January 13, 1986.
CONCLUSIONS
City Council therefore concludes that:
1. The application for a Planned Development submitted for
property at 300 W. Belleview Avenue should be approved with the
following requirements:
a. There shall be a two-year traffic study following the
issuance of the final Certificate of Occupancy; if, in the opinion
of the City Traffic Engineer, a traffic signal is warranted at the
South Delaware Street/West Belleview Avenue intersection, it shall
be installed at the expense of the developer.
b. An eight (8) foot, solid fence shall be installed
along the west property line by the developer to minimize any
negative impact from the development on the properties adjoining on
the west which is zoned R-1-A, single-family residence.

c. The City will negotiate with South Slope Homeowners
Association regarding a secondary access for fire service.
d. At the exit of the project a right or left turn only.
2. This Development complies with the Comprehensive Plan and
all appropriate City ordinances.
3. Usable open space and landscaped areas have been incor-
porated into the overall design and is sufficient to serve the
number of units being constructed and will be accessible to all of
the occupants of the dwelling units.
4. The amount of off-street parking to be provided complies
with the requirements of Section 16.5-5a(12) of the Comprehensive
Zoning Ordinance of the City of Englewood.
5. Consideration has been given to the location, design and
height of the buildings as well as access and fire lanes.
IT IS HEREBY DECIDED that this Council adopt the foregoing
Findings and Conclusions as amended for a Planned Development at
300 West Belleview Avenue, Application #34-85.

The land included in this planned development is described
as follows:
Plot 6, INTERURBAN ADDITION, County of Arapahoe, State of
Colorado. Containing 122,633 square feet or 2.815 Acres
more or less. And including,
Lot 1, SOUTH SLOPE SUBDIVISION, County of Arapahoe, State of
Colorado. Containing 51,422 square feet or 1.18 Acres
more or less. And including,
Part of Block 7, INTERURBAN ADDITION, County of Arapahoe,
State of Colorado, described as: Beginning at the Northeast
corner of the NWl/4, NW1/4 of Section 15, Township 5 South, Range
68 West of the 6th P.M., Arapahoe county, Colorado; thence
Soo `10.118"W and along the Easterly line of the NW1/4, NW1/4 of
said Section 15 and also along the Easterly line of MIRAMONTE
SUBDIVISION, 841.22 feet to the Southeasterly corner of said
MIRAMONTE SUBDIVISION, to the True Point of Beginning; thence
continuing 500` 10` 18''W and along the Easterly line of said
MIRAMONTE SUBDIVISION extended Southerly and also along the
Easterly line of Plot 7, INTERURBAN ADDITION,.215.25 feet to the
Northwesterly line of Lehow Avenue; thence 563`48�39"W and along
the Northwesterly line of Lehow Avenue, 103.00 feet; thence
N28103`49''W and along the Westerly line of said Plot 7, 377.24
