WHEREAS. the subject property is approi:imately 113 •=• with the subject property, wu the aite of the former Cinderella City Shopping Mall and is located in the area bounded by U.S. 285 on the south, South Elati Street on the eaat, West Floyd Avenue on the north and South Santa Fe Drive oti Iba wtat; and WHERE.\£, the ,ubject property is zoned PUD and the adjacent property to the north ia zoned R-1-C-Singlc-Family Residence and R-2-Mediwn Denaity Residence, the area to the eut ia zoned B-1 -Buaineaa, and the areas to the south and west are zoned I-I-Light Industrial; and WHEREAS. application has been made by the Englewood Environmental Foundation (EEF) requesting subdivision of the property; and WHEREAS, the preliminary plat of the Englewood CityCenter Subdivision is in subotantial conformance with the previously approved Planned Unit Development District Plan; and WHEREAS, tht> Englewood Planning and Zoning Commission held a Public Hearing on the proposed EngJ,,wood CityCenter Subdivision Preliminary Plat on June 22, 1999 and the Englewood CityC~nter Subdivision Preliminary Plat waa approved with five requirements to be incorporated in the Final Plat of the Subdivision; (I) 30 foot easement on the west side of Lot I , Block 9, be shown; (2) easement for e:rtension of Tract C across Lot I , Block 9, be shown; (3) definitions of parcels of land between Blocks 5 and 6 and between Blocks 7 and 8; (4) all street dimensions be defined and shown on the plat; and (6) 12.6 foot easement along the west aides of Blocks 6 and 6 be shown. NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ENGLEWOOD , COLORADO, THAT: ~-The City Council of the Ci ty of Englewood, Colorado hereby approves the Englewood CityCenter Subdi,iaion Plat which now in.eludes the Planning and Zoning Commission's requirements, attached hereto as Exhibit A. Stitt, Senior Planner COUNCIL GOAL AND PREVIOUS COUNCIL ACTION On July 20, 1998 City Council adopted Ordinance No. 46, Series of 1998 authorizing the transfer of ..pr:o_pertyJcnown as Cinderella City by the City of Englewood, Colorado to the Englewood Environmental Foundation . RECOMMENDED ACTION Staff recommends that Council adopt a resolution approving the Final Pint of the CltyCenter Englewood Subdivision . BACKGROUND, ANALYSIS, AND Al Tl:RNATIVES IDENTIFIED The CityCenter Englewood development is located on the site of the former Cinderella City Mall. The site contains approximately 53 acres . The proposed subdivision is the final land use control element to be put into place for the redevelopment of this site . This subdivision mirrors the Englewood Town Center PUD that was approved by City Council in 1998. The 1979 Comp rehensive Plan designates the site as part of tt,,3 central business district . The proposed subdivision is in compliance with the Comprehensive Plan. FINANCIAL IMPACT Approval of the Final Plat is ne,eded before lransfer of property and redevelopment can occur . RECOMMENDATION; The Department of Neighborhood and Business Development recommends that the preliminary plat for Englewood CityCenter Subdivision be approved and the applicant be directed to submit a final plat for review and consideration by the Commission . The zoning of the property proposed for subdivision, together with the zoning of the areas immediately adjacent thereto . Topography and natural features of the land with special reference to flood plains . The site has been extensively filled . The fill and resulting topography hava been designed to accommodate the proposed development The Little Dry Creek box culvert runs adjacent to and through a portion of the property . The box culvert is designed to contain the 100-year flood and as a result does not impact the proptrty. 5. The continuity of streets and alleys within the area proposed for subdivision, and the desi$11 and location of such streets and alleys, with relation to existing streets and alleys, both within and without the area proposed for subdivision, and the Master Street Plan . The streets proposed for this subdivision re-impose the grid system that was interrupted with the development of Cinderdla City. South Galapago Street and South Inca Street will be re-introduced as well u the realigned Enslewood Psrlcway (idmtified u Tract C.) 2 • • 6. Bicycle or pedestrian facilities are specified in the PUD Design Standard, and Guidelines and this subdivision is consistent with the PUD . 8. The location of utility and other easements . Because building design and specific tenant requirements are not known at this time, utility easements will be established as a part of the building design phase. 9. The location of, and provision for, public areas, including land reserved for parks, schools and other public uses . RELATION TO COMPREHENSIVE PLANi The 1979 Comprehensive Plan designates the subject site as part of the central business district . The proposed subdivision is in compliance with the Comprehensive Plan . PROCEDUREi The Subdivision Regulations , Title 10 of the Englewood Municipal Code, require th~t the Planning Commission shall review both a prelir.U11•ary and final subdivision plat and affer due consideration, recommend to City Council approval, conditional approval, or denial of the proposed subdivision . Upon receipt of a subdi~ision application and the preliminary plat, a public hearing is set for the consideration of the proposed s>1bdivision . After the public bearing and Planning Commission consideration of the preliminary plat, the commission may give approval, conditional approval, '>r the preliminary plat may be disapprov-:d . If the preliminary plat is approved or conditionally approved, the applicant shall prepare a final plat incorporating any suggestions or cond::i ons resulting from the public hearing . If the preliminary plat is disapproved, 1he applicant may appeal the decision to the City Council as set forth in Section I 0-2-9 of the Subdivision Regulations . Upon submission of tlie final plat the Planning Commission shall review the final plat for conformance to any c,,nditions imposed on the preliminary plat. THAT members of the Commission determined the Final Plat of the Englewood City- c-~nter Subdivision must include additional specified information, ml delineated that information in conjunction with the motion to approve the preliminary plat. CONCLUSIONS 1. THAT the application for approval of a preliminary plat for Englewood CityCenter Subdivision was filed by the Englewood Environmental Foundation (EEF). 2. THAT public notice was properly given by Cenified mail sent to 26 adjacent propcny ()WIICfS, 3. THAT '.he preliminary plat of the Englewood CityCenter Subdivision is in substantial conformance with the previously approved Planned Unit Development District Plan . 4. THAT specifically identified information must be incorporated on the Final Plat to be considered by the Planning Commission at a future date. • • DECISION THEREFORE, it is the decisic n of the City Planning and Zoning Commisaion that Ille pre- liminary plat of Englewood CityCemcr Subdivision shall be approved , and dlat five specifi- cally identified requiremelllS shall be incorporated in the Final Plat of the SUbdivision.
