The regular meeting of the Englewood Board of Adjustments and Appeals was called to order at 7:35 P.M. in the Englewood City Council Chambers, Chair O'Brien presiding . Members present: Allen , Barber , Bode , Fowler, O'Brien, Seymour, Smith Members absent: None . Staff present: Director Robert Simpson Assistant City Attorney Reid Planning Technician Cathie Mahon The Chairperson opened the Pub lic Hearing stating she had proof of posting and publication. Chair O'Brien stated that both Case #7-97 and Case #8-97 had been canceled. II. APPROVAL OF MINUTES. September 10 , 1997 Chair O'Brien asked for consideration of the Minutes from the September 10 , 1997, public hearing. Seymour moved: Fowler seconded , THE MINUTES OF SEPTEMBER 10, 1997 BE APPROVED AS WRITTEN. AYES: Barber, Bode , Fowler, O'Brien , Seymour, Smith NAYS: None ABSTAIN: Allen ABSENT: None The motion carried . Ill. APPROVAL OF FINDINGS OF FACT. Case #5-97 and Case #6-97 The Chairperson asked for consideration of the Findings of Fact. Seymour moved: Smith seconded , 1 (' THAT THE FINDINGS OF FACT FOR CASE #5-97, LINDA AND DOUG COHN, 275 E. GIRARD AVENUE, AND CASE #6-97, SHANNON SWEENEY, 3356 S. PENNSYLVANIA STREET, BE APPROVED AS WRITTEN. A YES: Barber , Bode , Fowler, O'Brien, Seymour, Smith NAYS: None ABSTAIN: Allen ABSENT: None The mot ion carried. IV. STAFF ADVISORS ' CHOICE. Ms . Mahon , Planning Technician , welcomed Mr . Allen as a new member. Ms . Mahon brought the Board current on Case #7-96 , Jack York , 15 East Quincy Avenue , stat ing the variance is now null and void. She reported that Mr. York contacted staff questioning if he would need to apply for a variance for an 8' x 12 ' shed. The shed would be smaller t han the initial request. Discussion ensued regarding whether Mr . York would need to apply for a var iance for the shed. Nancy Reid , Assistant City Attorney , stated that she would review the case and report her findings to Ms . Mahon. V. CITY ATTORNEY'S CHOICE. Ms. Reid presented preliminary informat ion regarding a proposed addition to the Handbook on "Duty to Vote " relating to abstent ions. Discussion ensued. T he Board decided to conduct a study sess ion after the public hearing . Ms . Reid stated a forma l proposal will be presented at a future public hearing . VI. BOARD MEMBERS' CHOICE. Mr . Seymour commented that since City Council is receiving a pay raise , he would like the Board 's $50.00 monthly "gas " money reinstated . Mr . Seymour also wanted to know what plans had been made for a Christmas party. Chair O'Brien officially welcomed Mr. Allen to the Board. There was no further business brought before the Board .
