PLANNING COMMISSION MEETING

Meeting convened at 9:45 a.m.
Minutes of Febr. 26th meeting read and approved as read.
The following resolutions and recommendations, herewith attached and referred to as Memos.
#A, B, C , D, E, and F. were made and adopted with copies to be provided to each member of
council.
Petition for rezoning in the vicinity of Lots 21, 22, 23 and 24, Block 41, South Broadway
Heights , Arapahoe County, Colorado was presented by representatives of the Sinclair Re-
fining Co. for a filling station to be erected and operated thereon by the Sinclair Re-
fining Co. This area comprises lots located at the northeast corner of East Stanford Ave.
and So. Broadway in the city of Englewood. Motion was made and carried that necessary
steps be taken to permit the erection of a filling station on the premises known as lots
21 , 22, 23 , and 24 , Block 41, South Broadway Heights, -provided tha t t here be the written
consent of 75% of the recorded owners of all parcels of real estate, any part of which is
within 300 ft. of any part of the above named premises.
Attorney Richard Simon and E. J . Clarke visited the Commission Meeting in regard to the
proposed subdivision of Mr. Clarke. Motion made and carried that we permit three sites to
be built on So. Ogden, north ofCornell, two sites east on So. Emerson, north of Cornell and
all the remaining sites to be substantially 60 ft. with 10 ft. additional to be dedicated
on the north side of Cornell from Ogden to Emerson, residences to be single family units
of 850 sq. ft., exclusive of garage and breezeway.
Two Hepler brothers visited the Comm~ssion and submitted sketch of their proposed sites,
being lots 1 to 11 incl, 36 to 40 incl., Block 24, Jackson Broadway Heights, divided into
seven building sites. This area includes that portion between So. Galapago St. and City
Ditch, and south of Oxford Ave. The commission 1suggested to let City Engineer take a
look at the situation and look up the title of city ditch, and to determine what the ease-
ment would be to serve this area and that the Heplers meet with the city engineer for
alignment and grade.
Resolution made and approved that land adjacent to Block 10 of F. P. Gaumer's Broadway
Heights addition, be zoned not lower than the zoning approved for the said Block 10.
Donald Salter's plan was submitted to the commission. This consists of northwest corner,
SE! of NW! of Section 3, T5S, R68W in the city of Englewood. This parcel is bounded on
the north by W. Kenyon Ave. and to the west by So. DelawareAve., with City Ditch an g ling
across east and south area, surveyed by David Nichols. Moved that we instruct the building
inspector, after we receive quick claim deeds, to issue permits of 950 sq. ft . homes,
e xclusive of g arage and breezeway. Motion carried. It was suggested that the city eng ineer
give him g rades, etc.
Richard C. Tolley, Fort Collins, Colo. wishes to enter into the veterinarian business at
the Lillian A. Jaeger's property, 5060 So. Broadway. Motion made and carried that all the
5000 block west of alley and east of Broadway be zoned C2.

MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE
ENGLEWOOD PLANNING COMMISSION:
Date: April 2, 1953
Subject: Proposed re-zoning of Bellewood annexation area set for public hearing April 6, 1953.
This area was zoned upon annexation pursuant to recommendation of the commission which was,
and now is of the opinion that an Rl-A classification is desirable for the district ,
particularly for that portion thereof not yet developed. Recommendation was made upon
consideration of the area as a whole , and the commission is of the opinion that any
contemplated rezoning should be considered on the same basis. Accordingly the commi~sion
makes the following recommendations:
1. That the present Rl-A zoning re retailed, at least in such portions of the
district as are presently undeveloped.
2. That, if council be unwilling to retain an Rl-A zoning, in whole or in greater
part, the district be referred back to the commission for r e -study, having regard to matters
developed upon hearing, and that the commission be authorized to employ expert plannin g
assistance in connection with such study.
3. If council shall not see fit to retain such zoning or refer the question
back to the commission, then in order to preserve the overall value of the district to
the city and to minimize the additional ser~ice and school burden in relation to value
which would result from a g eneral and substantial down grading, the commission recommends
further re-zoning and conditions as follows:
a) That the residential zoning be extended to include all portions of
the district lying East of the Broadway-Lincoln alley, and that, pending such
rezoning, no permits for business or commercial construction be granted East
of said alley.

b) That all portions lying West of the Broadway-Lincoln alley be zon e d
C-1 except that area between Grant Avenue and Belleview which we recommend
be zoned C-2. This will provide a substantial increase in tax value over
service and school burden.
c) That, as a condition of the re-zonin g of th e residential portion of
the district to a modified R-1, council procure the dedication or conveyance
of Logan Street at Bel l evi e w as a part of the city street plan so as to
conclusively eliminate the necessity of purchase or condemnation after the
re-zoning is accomplished, Logan Street being th e only available main use
street between Broadway and Clarkson.

ENGLEWOOD PLANNING COMMISSION:

Subject: General Zoning Policy
On or about October , 1951, the commission prepared and submitted to council a proposed
city zoning code. The council held public hearings thereon, received various objections,
and returned the proposed code to the commission for further consideration. The com-
mission reconsidered with re g ard to objections made, amended the same and re-submitted
to council on or about March, 1952. No further action has been taken with re g ard to
adoption.
The proposed code was drafted by the commission after comprehensive study and after
survey and consultation by and with a plannin g engineer employed by the commission,
and was advanced as a necessary guide for the city's expanding development.
Since re-submission of the plan, the g eneral development of the city has continued
necessarily in accordance with the existing zoning code which, in the commission's
opinion, is outmoded and in conflict with the proposed zoning in many respects. On
the other hand , the commission has attempted to influence development either in favor
of the proposed zoning , or, where enforcement thereof provided impractical because of
continued inconsistent development under the existing code, has yielded to compromise
between the two codes . The result is that development has been , and is now progressing
under several inconsistent standards, and will so continue to the disadvantage of the
city until a single comprehensive plan is adopted.
Since re-submission of the proposed code , the city has annexed much additional territory,
some of which is now without any zonin g whatever, some of which is inadequately or
superficially zoned because of insufficient notice, opportunity or faciliti e s to study
and survey the area prior to ann e xation , and some of which, althou g h properly zoned in
view of proposed development, will not be able to be held to that standard because of
adjacent development which must be permitted under the existing code.
In the commission's opinion, portions of the proposed code may now prove to be un-
enforcible or ineffectual for the reasons above stated, and it is expected that continuing
revision will be required until adoption is accomplished in order to keep abreast of
development which is not harmonious therewith.
The commission believes that the fore g oing zoning situation is detrimental to the best
interests · of the city, and, in order to minimize and check in so far as possible the
undesirable effects thereof, has adopted a general policy that it will apply, as a
standard for recommendation in all cases referred to it or otherwise to come within
its jurisdiction , said proposed zoning code as re-submitted to council and as amended,
changed or enlarged from time to time by resolution of the commission made prior to
final adoption of the code by council.
The commission further makes the following recommendations:
1. That the proposed zoning code as re-submitted to council in March, 1952,
be revised to reflect subsequent development inconsistent therewith, and be enlar g ed
to include territory subsequently annexed, and, as so revised and enlarged , be pushed
to final adoption. In connection ther ew ith the commission regards it necessary that
a planning consultant be employed to survey, advise and assist the commission regarding
all territory annexed to the city beginning with the Wollen Weber annexation, and re-
garding areas affected by changes, exceptions or development since March , 1952, which
are inconsistent with the proposed code as re-submitted . The council may regard it
advisable to extend such survey throughout the city.
2. That formal notice be g iven the commission of the filing of petitions
for future annexations to the city; that the commission be given a reasonable period
of not less than forty-five days a f ter receipt of such notice in which to make adequate
study of any such annexation and report of its recommendations to the council; that
the commission be authorized to employ a planning consultant to assist and advise in
connection with such study; that the acceptance of any such annexation or petition for
annexation be reserved by the council until report of the commission is received and
that acceptance be conditioned upon zoning and other restrictions which council may
see fit to impose upon acceptance in consequence of the commission's report and recom-
mendations, or upon council's own motion.

Subject: E. J. Clarke proposed subdivision, Bates-Co nell, Ogden-Emerson .
Commission recommends the following as absolute minimum requirements for platting, zoning
and use:
1. Not more than three equal building sites on west side of Ogden from Clarke
residence to Cornell.
2. Not more than two equal building sites on east side of Emerson from Clarke
residence to Cornell.
3. Not more than five equal building sites on east side of Emerson from Clarke
residence to Bates.

Sub ject: Zoning of Ox-Bow Subdivisi.on upon annexation. •·
Comm ission recommends acceptance of subdivision in accordance with plat prepared by
Norman J. Costellan and signed by Charles and Emma Hague on October 28, 1952, subject
to the following changes, conditions and zoning:
1. All building sites on Huron to have a minimum frontage of sixty feet and a
minimum area of 7,200 square feet so as to conform as nearly as possible with seventy-five
foot frontage set up on we st side of Huron.
2. Plat to contain restrictions providing for construction of single family
residences only, with floor area of not less than 850 square feet, exclusive of garages
and breezeways.
3. That Fox Street be dedicated through subdivision to conform with city street plat.
4. Dedication of sewer, water and utility easements according to specification and
approval by city engineer and planning commission.

Re: Request for re-zoning of building site owned by Mr. Coffey at Jeffersonand
Clarkson from R-2 to R-3 to permit construction of a four-family dwellin g .

Commission recommends that th e request be deni~d for the following reasons:
1. This district is predominately single family.
2. Neither grade nor right of way width for new Hampden Drive has been established
by the State Highway De p artment, and it is possible that final determination will leave
insufficient area under the commission's standard, for the type of building proposed even
if deemed desirable for the district.

RE: Proposed re-zoning of Acoma-Delaware, Layton-Belleview area from Rl-A to lower
residential classification.
Informal application was received by the commission on April 4, 1953, for recommendation
to council by April 6, 1953. Although the commission stands ready to re-study this
area as well as all other areas recently zoned upon annexation, provided sufficient
time is given for such re-study with or without the assistance of a planning consultant
as requested April 2, 1953, the commission cannot at thie time make a recommendation
on the above area, and believes it would be unwise to re-zone without careful re-study
of the area and areas adjoining, as a whole.

PLANNING COMMISSION MEETING
April 30, 1953

Meeting convened at 9:30 a.m.
Bill Smith, photographer, 4296 So. Cherman and Mr. Peterson, owner of property at 2900
So. Acoma, visited the meeting. Mr. Smyth wishes to build a photo studio at 2900 So.
Acoma , corner E. Bates and So. Acoma. Motion made and carried, we recommend that the
council take favorable action on the application for rezoning of the back 50 foot of
the two lots, 50 foot by 50 foot.
Mrs. Donald Gibbon and father, 4051 So. Pearl visited the meeting. They wish to make
a two unit out of a single family residence at this location. At present it is zoned
Rl, only a single unit dwelling. Their request was refused. They decided to re-design
their plans and eliminate a second kitchen. Mr. Flint advised that he would take the
matter up with the city attorney and would call them.
Mr. Ralph Bullock of the Bullock Mortuary, 1375 E. Hampden visited the Commission. He
wishes to build an addition to the north of his present building, facing So. Layette
St. Present zoning is C2. The technical point is what is considered his back yard,
as C2 requires that there shall be a rear yard of not less than 25 ft. provided that
on interior lots no accessory buildings shall be permitted within 25 ft. of the center
line of the alley. The Commission decided that this was a legal point in their
specific case the rear yard would be the portion along the alley line.
Attorney Richard Simon presented plan of Block #49, Evanston Broadway of seven lots at
So. Downing and E. Hampden, owned by Peter E. and Oneida Voorheis, for re-zoning for
Standard Oil Co . Five lots,,#20, 21, 22, 23, and 24 are zoned for commercial zone
and lots #18, and 19 under R2. The Commission referred him to Board of Adjustments
for hi s problem of rezoning of lot 19.
Herman Wachter presented plan for ~lots 1 and 2, Block 16 in F. P. Gumaer's Broadway
Heights, between Chenango and Layton and So. Inca and So. Huron. He was advised to
build on 75 foot fronts, 1000 square foot homes, exclusive of garage and breezeway.
Advised to provide alley or e asement and to check water, sewer, electricity, phone
and gas.
Mr. Ames presented plan between E. Bates and E. Corn ell on Clarkson Street. He wishes
to extend his greenhouse 60 foot east on Clarkson. The Commission turned this down,
since Clarkson is a main use street. Ext ens ion denied on street side and recommended
he build to the south.
Mr. Homer Lizar inquired concerning the Jaeger property, 5600 So. Broadway. He was
informed that all portions lying west of the Broadway-Lincoln alley were recommended
to be zoned Cl, except that area between Grand Ave. and Belleview be zoned C2 which
includes the Jaeger property.
Lee Schillinger, contractor presented plan of W. Chenango to Layton, between So. Bannock
and So. Broadway of 303 feet. He owns six lots on Broadway north of Chenango. Wishes
rezoning to Cl. The Commission recommended that Mr. Schillinger look into the possibilities
of this area, specially the owner south of Brunton Machine Works.
Dave Williams from the R. F. Linstedt architect office presented plan for the proposed
development of So. Broadway Locker Plant, known as Frozen Food Lockers, south of
Stanford, 4501 So. Broadway. They wish to expand into a shoppin g center. Mr. Benoit,
contractor wishes to build a store extension of the Frozen Food Locker building and a
physician's building facing Stanford and storage space on alley. With the proposed
z oning, which final reading is next Monday, he will be able to build his proposed
plan. The question of private, angle parking off Stanford Ave. was discussed. One
curb cut on Broadway was allowable.
Mrs. Ference, 4500 Block So. Elati St. visited the Commission in regard to straightening
that street. She was advised to see Mayor Frantz , to see what he found out in regard
to Mr. Spark's opinion of same.
