Harold M. Sales, 1900 . So. Pearl, owner of a parcel 245' x 180' on So. Lo g an and the new
Hampden drive, seeks settlement from the City since the new highway will not leave enough
room for the erection of a filling station.
Mr. Sales was referred to City Attorney Bodan for settlement and to have the title checked .
Harry Wilt, 1045 W. Hampden, questioned whether an Architect or an Engineer Seal was re-
quired for an industrial building.
Mr. Wilt was told that the State Statute provides for an Architect Seal except on a two-
story building for private use; and an owner of an industrial building can use the services
of an engineer.
Mr. Laverne Adamson, 4500 So. Elati, requests approval of subdivision plat of Hines property,
South of Stanford between Elati and Delaware . Mr. Adamson agrees to deed 30' of Stanford to
the City for the street and Mr. Campbell agrees to give a quit claim deed for 30' for the
street (see minutes for September 2, 1954).
Mr. Adamson was told the sub-division plat would be approved on condition that the plat
would include a 30' dedication on Stanford, a 16' alley, a 10' drainage easement to pro-
vide for existing drainage, 55' frontage to meet R-1 zoning requirements, and a building
with a minimum of 850' exclusive of garage and breezeway.
Robert B. Lee, Attorney, requests for his client that zoning be changed from the existing
R-2 to allow multiple unit structure or apartment house, on Lots 7 to 12 inclusive, Block
2, Higgins Englewood Gardens, Arapahoe County. (East side of 3500 So. Pearl 150' S. of
Pearl-Hampden intersection extending from that point 150' S.)
The Commission will take the application under advisement to consider in connection with
the proposed rezoning and hearings thereon.
Motion by Mr. Wright that the proposal to plat sub-division of Hines prop e rty be accepted
subject to the conditions set forth. Second by Mayor Weigand . Mr. Wright, yes; Mayor
Weigand, yes; Mr. Flint, yes; Mr. Guilford,yes; Mrs. Romans, yes.
Motion by Mayor Weigand that the Commission take Mr. Lee's application under advisement.

PLANNING COMMISSION MEETING
September 30, 1954
The meeting was called to order by Acting chairman Jones.
Robert E. Hinson, 2820 So. Elati, requests permission to construct an office building 25'
wide, 14' deep, 12' high with sleeping quarters for one man; constructed of concrete blocks.
Wrecked cars will be stored, until insurance claims are settled, behind an adequate fence.
Mr. Hinson was asked to keep the prevailing set back, meet zoning requirements. The
Building Permit is to be issued.
Mrs. Fred Freeland, 4837 So. Lincoln, requests permission to build a house with the south
side yard 5' rather than 7' .. The existing house on the south has a 5' north side yard
allowing the required 10' between houses. Mrs. Freeland owns four lots with an existing
building on the north portion ... this building is to be torn down when the new construction
is completed on the south lots ..
Members of the Commission suggest that a legal agreement between the City and the Freelands
by drawn by City Atty. Bodan allowing limited occupancy in the old house. Mrs. Freland
was asked to check with the Board of Adjustment about the non-conforming side yard.
Mr. Zulian and Mr. Miles from the State Highway Depa r.tment visited the meeting to discuss
the closing of Linc~ln Street where the new highway .will cross. It was decided that only
the South Lincoln would need to be closed .. that the North Lincoln could be open • for right
turns from the East and right turns to the West.
Mr. S. Huot, 3270 S. Sherman, requests permission to alter one of two present structures
on an 83' front.
Because this area is zoned for duplex and these are two structures, Mrs. Huot was referred
to the Zoning Board of Adjustment.
Claud Shockley, 3476 So. Corona, is building on Girard between Ogden and Corona, Mr.
Shockley wants to know what side yard will be necessary for a building fronting on the
side street.
There is no other house facing the side street, so the ordinary set back (7' & 3') will
meet requirements. Mr. Flint will notify the Building Inspector.

Mark T. Gerto9, 2353 So. Sherman, requests a change of zoning for Lots 7, 8, 9, 10, Blk.
2, S. G. Hamlin Addition (2900 So. Fox) to permit a one story office building and a
storage building .
The recommended rezoning conforms with the proposed light industry zoning. Motion by
Mr. Jones that the Commission recommend to Council that Lots 7, 8, 9, and 10, Blk. 2,
S. G. Hamlin Addition be rezoned M-1 limited. Second by Mr. Wright.

Mr. Janssen, yes; Mrs. Romans, yes. Mr. Gerton was told that he would have to pay the
cost of publication.
Mr. Walt Bobay presented a resubdivision of plat of Block 14, F. P. Gumaers Broadway
Heights; Block 2, Bobay Heights, Chenango and Layton, Jason and Kalamath.
City Attorney Bodan is to contact the owner of the house built in the street are on
Kalamath and Chenango.
Motion by Mr. Wright that the Planning Commission approve the plat. Second by Mr.
Jones. Mr. Wright, yes; Mr. Jones, yes; Mr. Janssen, yes; Mr. Guilford, yes; Mr.
Flint, yes; Mayor Weigand, yes; Mrs. Romans, yes.
Mrs. W. H. Brant, 525 E. Amherst, appeared on behalf of owners of the Edens Dry Wall
Co. The office is at present in the house at the above address, and is not in compliance
with zoning requirements.
Mr. Flint is to consult the County Building Inspector to see whether or not it was oon-
forming in the County before the area was annexed.
T. W. Walker, 4400 So. Grant, attended the meeting to see why a stop order wgs issued
against the laying of a sidewalk at this address.
A Hollywood type sidewalk is being put in and trees go into the walk about 6". Mr.
Walker said he couldn't afford to take the trees out, so he was going to leave a cut-
out in the sidewalk for the trees. Mr. Walker was toad that the City would remove the
trees if he would give his consent. He consented.
Jess Fowler appeared at the meeting with plans to sub-divide lots 14 thru 17 and N
12.5 ft. of Lots 18, Block 35, Jackson Broadway Heights.
The Commission suggested to Mr. Fowler that he get the adjoining owner to join in the
plat.
Mr. Curtis representing Alcoves, 3139 So. Broadway, attended the meeting to see why a
stop order had been issued against the construction of a sign at this address. A
permit had been obtained by the Advance Neon Sign Co. It is alouvered neon sign on
the south side of the building .... 15' rather than the required 13' high, and not the
required 2' from the ground.
A motion by Mr . Jones that permit be given to erect the sign at 15' height provided
the sign is backed with adequate rear screening and doesn't project beyond the adjacent
building. Second by Mr. Guilford. Mr. Jones, yes; Mr. Guilford, yes; Mr. Wright, yes;
Mr . Flint , yes; Mr. Janssen, yes; Mayor Weigand, yes; Mrs. Romans, yes. Mr. Flint is
to notify the building inspector.
Ralph M. Fishel requests permission to biack-top 6 lots for parking between the Broadway
alley and Lincoln on Bates in back of Arapahoe Motor and Bear Frame and Axel. He
plans to have the entrance on the alley and curb cuts on Bates adjacent to the alley.
Mr. Fishel was asked to secure the property owners permission within the 300' limit.
A committee from the Commission will meet with Mr. Harmon to review the problem before
a decision will be made.
Chuck Fritsinger discussed the proposed annexation of a subdivision West of Platte
River Drive between Dartmouth and Harvard and West to Tejon and Zuni. Mr. Fritsinger
proposed 10 acres of commercial development, 68 acres of industrial development and
132 acres of residential development.
Mr. Fritsinger was advised to check the legal aspects of the proposal.
E. L. Benton is purchasing property on the corner of Emerson and Amherst, and wants
to know what side yard will be allowed.
No houses are facing Amherst so 7' is permissabB. It was suggested that Mr. Benton
have a certified survey made. Mr. Flint is to notify Mr. Wallace.
A representative of the Standard Oil Co. attended the meeting to see whether or not the
curb cuts for the station to be built at Nassau and Broadway could be changed to three
ft. from the sidewalk of Broadway and five feet on Nassau.
Mr. Flint is to have the City Engineer reset the stakes on Broadway to allow the cut
5' from the sidewalk and to work out the .pattern for the cut. No change is to be
allowed on Nassau.
Mr. Curtis, representing Alcoves, reappeared at the meeting with measurements of the
sign in question. The sign is 27' long and projects 6!' beyond the front of the adjacent
property front, but is within the property line. The rest of the buildings in the
block are at the property line---the adjacent welding shop is the only building set back.
Motion by Mayor Weigand that permission be given to go ahead as decided earlier in the
meeting, if the owner and tenant of the adjacent property will give their consent.
