Roll Call: Ayes: Jones, Rudd, Romans, Weigand, Janssen Nays: None Absent: Guilford, Wright Mr. Edward Alexander presented the final plat, (not completely inked) for Planning Commission approval, of The Hayes Subdivision to be located between West Oxford Avenue and West Quincy Avenue and West of South Jason Street extended. After discussion , Weigand moved: Romans seconded: that the Planning Commission recommend to Council that the Plat of Hayes Subdivision be accepted subject to proper numbering of lots with all numbered lots shown fronting on an open street, with all dedicators participating in signing the plat; and the Subd ivision to be shown to extend from West Quincy Avenue to West Oxford Avenue. Shivers, Jr., Attorney for Coleman Broom Wo n ks, 705 West Dartmouth appeared to request Plannin g Commission consideration to include property of the Broom Works in M-1 District in the proposed new zoning. It was pointed out that the factory has ex isted for many years and the property is ad jac ent to proposed M-1 Districton the South and proposed M-2 District on the West. After discussion, Weigand moved: Jones seconded: that the North line of proposed M-1 District West of South Galapago Street be changed to the center line of the alley just North of lots 25-30 inclusive, Block 1, Taylor's Addition; the East line being established along the center line of South Galapago Street from West Dartmouth Avenue to the center line of the alley above mentioned; the West line to remain adjacent to M-2 District as previously proposed. MEMORANDUM TO THE ENGLEWOOD CITY COUNCIL REGARDING ACTION OR RECOMMENDATION OF THE ENGLEWOOD PLANNING COMMISSION. Date: October 13, 1955 Subject: Plat of Hayes Subdivision Recommendation: That the Plat of Hayes Subdivision be accepted and approved sub j ect to proper numbering of lots with all numbered lots shown fronting on an open street, with all dedicators participating in signing the plat; and the Subdivision to be shown to extend from West Quincy Avenue to West Oxford Avenue. M. Mr. Myron C. Bott of 3101 South Downing appeared to discuss the possibility of variance from sixty foot frontage on property on the East side of Block 17, Evanston Broadway Addition (West side of 3100 Block South Downing Street) which is in proposed R-1-D Zonin g District. Mr. Bott stated that the total frontage of the property is 565 feet and he pro- posed to divide the property into three sites with 50 foot fronts, 1 site with 55 foot front and six sites with 60 foot fronts. PAGE ll4 Mr. Bott was referred to the Zoning Board of Adjustment for action on the problem a nd it was pointed out to him that consideration should be given beforehand to the serious drainage problem existing in the area. Regarding recommendation to Council by The Planning Commission on October 13, 1955 , that plat of the Hayes Sub-division be approved subject to certain conditions, Rudd moved: Jones seconded: that a memorandum be sent to Council to the effect that because of a mis- understanding on the proposed Hayes Subdivision Plat, the tentative approval be rescinded and the plat be returned to The Planning Commission for further consideration. Roll Call: Ayes: Jones, Wright, Weigand, Rudd, Romans, Janssen Nays: None Absent: Guilford, who wasout of the room at the time. Mr. Richard Simon, Attorney, appeared with Mr. E. J. Clark, property owner , and Mr. Don Kirkman , prospective buyer of property located between East Bates Avenue and East Cornell Avenue and South Ogden Street and South Clar'kson Street. Mr. Simon stated that it is the desire of Mr. Kirkman to purchase this property from Mr. Clark provided approval of a platting can be secured from The Planning Commission and Council. The gentlemen were advised that this property is located such that until the engineering report regarding storm drainage in this area is received and studied, no consideration can be given to platting. It was felt that the engineering report, which is presently :in the making, will soon be available and Mr. Simon was advised to keep in touch with the City Manager regarding the report and if said report covers the area completely enough, consideration could possibly be given the problem at the next meeting of The Planning Commission on November 17, 1955 . Mr. Richard Simon, Attorney, with specific reference to greenhouses, called attention to the wording of paragraph a., Sub-section 2, Section 6, Article Five, Page 56 of the pro- posed new zoning ordinance and asked for some further clarification or interpretation. After discussion, Rudd moved: Romans, seconded: that a memorandum be sent to Council stattng that it is not the intent of the Englewood Planning Commission to abate in twenty years any now existing non-conforming use in a Resid en tial District and which is permitted in an M-1 District even thou g h it is also permitted in an M-2 District. Roll Call: Ayes: Jones, Wright, Weigand , Rudd, Romans, Guilford, Janssen. Nays: None Absent: None Mr. Janssen made a brief report on his study of the Denver Building Code which is being considered for adoption for the City of Englewood. The Recording Secretary was directed, by Chairman Janssen , to write a letter to Councilman Rapp in answer to his letter of October 13, 1955 to read as follows: "A study of the technical section of The Denver Building Code reveals some thirty to thirty-six changes which would be required to make it appl:ic able to the City of Englewood. These are not technical changes but are references specifically to other Denver ordinances and to some of their administrative officials." The meeting was adjourned at 11:30 A. M. Approved: John D. M .. Mr. Laverne Adamson, 4525 South Delaware Street and Mr. J. P. Fairall, 3556 South Clarkson appeared to discuss the possibility of obtaining permission to construct two duplexes on lots 31-35 inclusive, Block 4, Higgins South Broadway Heights, located on the West side of South Emerson Street between East Hampden Avenue and East Jefferson Avenue. The gentlemen were advised that the present zoning of this area is R-1-D which restricts construction to one family units with 60 foot frontages and until such time that this zoning might be changed to an R-2 District, it would be impossible to recommend that permission for duplexes be given. It was suggested that a letter could be directed to the Planning Commission requesting that further study be given to rezoning of this area to an R-2 District in 1956 when studies for such zoning amendments are made. Mr. Orville Beam of 1510 Glenarm Street, Denver, representing Mr. Edward Alexander, appeared to show and discuss a revised plat plan for the proposed Hayes Subdivision located between West Oxford Avenue and West Quincy Avenue and West of South Jason Street extended. The revised plat includes an area which is shown as the Western portions of lots 11-12-13-14-15-1 6 and all of lot 17. The original plat did not include this section which would have been isolated and landlocked. By replatting to include the above mentioned section, the developers will gain two additional building sites. The revised plat indicated 10 feet as the total width of utility easements between certain sites and Mr. Beam was advised that this feature would have to be changed to show a total of 16 foot wide utility easements and must extend through the full width or depth of the sites. The revised plat showed the .location of Oxford Place as being between lots 23 and 24 and Mr. Beam was advised that if the developers so desired, it would be acceptable to relocate this street along the South lot lines of lots 19 and 20. It was pointed out in further discussion that the street shown on the plat as South Mariposa Street is actually more nearly in line with the street known as South Lipan and for this reason, the Planning Commission would recommend the newly platted street be also known as South Lipan Street. Johes moved: Romans seconded: that The Planning Commission recommend to Council that the revised plat of the Hayes Subdivision be approved, subject to the following conditions: That all utility easements between building sites· be shown as a total of 16 feet wide and to extend the full width or depth of the sites involved. That, if so desired by the developers, the street to be known as Oxford Place may be located either between lots 23 and 24 or along the South lot lines of lots 19 and 20. That the street intersecting the Subdivision North and South be known as South Lipan Street instead of South Mariposa Street. Roll Call: Ayes: Jones, Romans, Rudd , Janssen Nays: None Absent: Guilford
