Mr. Tautz was advised that he could proceed on thE basis provided that all other build- ing requirements were met. Mr. Ed Scott appeared before the Board on behalf of the Immanuel Lutheran Church to ask for re-zoning of the 3600 Block on South Elati from A-1 to R-2. The Church needs this area re-zoned so that they may move their parsonage from it's present location to the school property. Mr. Wright moved; Mrs. Romans seconded, that the Planning Commission recommend to Council: That lots 17~32 of Block 17, Englewood Sub-division, be rezoned from A-1 to R-2. Roll Call: Mr. Janssen , aye; Mr. Jones, aye; Mrs. Romans, aye; Mr. Rudd, aye; Mayor Weigand, aye; Mr. Wright, aye. A. E. Lininger, 679 Prentice, Littleton, Colorado, requested recommendation for annexation of the area 2 blocks West of Huron and 4 blocks South of Belleview. After considerable discussion, Mayor Weigand suggested that this proposal be presented to the Water Board before the Planning Commission takes any action on it. It was later decided to send the following recommendation to C6unciiwith reference to the Water Board: "That Lininger Tract, 2 blocks West of Huron and 4 blocks South of Belleview Avenue be annexed on the approval of the Water Board with the annexation being contingent upon the potentiality of 180 homes with not less than 9,000 sq. feet of yard area and with 75 ft. fronts and from 1,000 to 1,250 sq. ft. of floor space per home and on the condition that the Liningers set aside 10% of the total land for public use." Two representatives of the Ragsdale Building Company, 1236 South Wasn~ngton, Denver, requested permission to build duplexes at Fox and Galapago Streets, facing Oxford Avenue. The Board informed them that this area is being re-zoned and the proposed re- zoning does not include duplexes. They could refer this matter to the Building Depart- ment but the answer would no doubt be negative. The builders further asked if an alley was necessary in this block. The Board told them probably not but suggested that they submit a proposed sketch for one family homes with 60 ft. fronts, vacating the alley but leaving an easement. The builders agreed to make presentation of the sketch at a later date . Mr. E. F. Dunham of Woodman and Dunham Builders, appeared to dedicate some easements and to have the City vacate some others in Bellewood Second Addition. The Board dis- cussed this proposal aid ~Mr . Jones moved, Mr. Wright seconded that the Planning Com- mission recommend to Council that: "The Planning Commission recommends to Council that the City vacate the East 3' of the 8' easement along the west side of Lot 10 , Block 9, Bellewood Second Addition. "That the City vacate the South 3' of the 8' easement oti the North side of Lot 2, Block 10 , Bellewood Second Addition. "That the City vacate the North 110' of the 16' easement between Lots 11 and 12, Block 9, Bellewood Second Addition. "That Woodman and Dunham Builders be permitted to dedicate to the City 5' on each side of the line between Lots 4 and 5, Block 9, Bellewood Second Addition." Roll call: Mr. Janssen, aye; Mr. Jones, aye; Mrs. Romans, aye; Mr. Rudd, aye; Mayor Weigand, aye; Mr. Wright, aye. The Board further suggested that Mr. Dunham have this district re-platted and present the revised plat to Council for the records. The meeting was adjourned at 12:15 P. M. Members absent: Jenssen. Meeting was called to order by Acting Chairman, Guilford, at 9:50 A. M. Mr. Wallace, City Building Inspector, appeared relative to policy of moving of old houses to new locations within the city limits. Two examples had recently come to his attention: One house is at 4549 South Sherman and is to be moved to the 4600 Block South Fox Street. The second house is now at 4475 South Broadway and is to be moved to 4781 South Acoma Street. Mr. Wallace desired to know if this procedure is permissible if building code followed closely in remodeling. The Board advised Mr. Wallace that the procedure is acceptable so long as land area and use is proper and the building is safe and sound structurally. Also, consideration should be taken as to whether or not the type of construction compares with existing houses in the area where house is to be moved. I I I I I I PAGE 69 Mr. Wallace also brought up the subject of the house at 3226 South Pennsylvania Street, owned by a Mary Loomis. He stated that there was previous correspondence in his files which involved a previous Building Inspector and also the Tri-County Health Department. The files contain a petition with twenty-two neighborhood signers protesting violations of the city building code and sanitary requirements. Mr. Wallace desires to know if the Planning Commission had any knowledge or comments concerning this instance inasmuc h as the owner has now applied for a permit to remodel the house. Mr. Wallace was advised that the matter had not previously been brought to the attention of the Planning Commission and for him to proceed, insisting that all phases of the city building code be complied with. A proposed addition to the Burt Chevrolet garage building, located at the corner of Lincoln Street and Floyd Avenue, was disclosed by Mr. Wallace, in behalf of Mr. William Larrick, Contractor, who did not atterld the meeting. The addition is to be on the Floyd Avenue front which is R-3 Zone. Mr. Wallace was advised that the proposed addition would be acceptable so long as land use is proper and the set-back is correct. Mr. Walter H. Simon, Architect, of 1922 East 18th Avenue, Denver, appeared with a sketch of layout of the First Christian Church, 3190 South Grant Street, which is presently in R-1 Zone. The sketch also showed proposed Sunday School room addition which would bring the building to within 15 feet of the property line. The proposed addition woull apparently not infringe on neighbo ring houses as the Church is on a corner site and owns considerable additional land between the building and the first residence. Mr. Simon was advised that the present zoning was the major problem and the Planning Com- mission would need to review thelimitations of requirements involved when the original building was constructed to determine how permission was granted for a church in an R-1 Zone. Since Mr. Simon was also the architect for the original building , he was directed to check his original contract for date and advise Mr. Rudd before the next meeting January 17th so that some investigation on the files can be made. Mr. Paul R. Rimer, 2925 South Birch Street, Denver, appeared with sketch showing location of a one family dwelling on property at 4446 South Bannock Street and also an occupied converted garage house on the rear of the lots. The property includes lots 9 J l0-ll-12, Block 15, Wollenweber Broadway Addition, with the front house being located on lots 11 and 12 while the rear house is located on lot 11 and 6 feet overhang on lot 10. Mr. Rimer was seeking authority to move the garage house entirely on lot 11 or remove the north 10 feet of the building to clear lots 9 and 10 for construction of a new one family house. The Planning Commission advised Mr. Rimer that this property was in an R-1 Zone and while the garage house is now permissible since there are four lots surrounding the two houses, moving or remodeling the garage house so that it would be situated on the rear of lots 11 and 12, it would then be non-conforming use and the only way in which the procedure could be allowed, would be for the rear house to be vacated as a dwelling. Mr. Robert Haines appeared with a final Plat of Block 2, F. P. Gumaer's Broadway Heights , Second Filing, re -sub-divided as Haines Sub-division. Motion , Mr. Rudd, seconded, Mr. Wright, that the plat be accepted subject to additional lettering: "Subject to use and area restrictions hereon noted". Roll Call: Ayes: Gui lford, Weigand, Jones, Wright, Romans, Rudd Nays: None Absent: Jenssen. Mr. Haines was directed to have lettering shown on Plat and return to P lanning Commission for signatures. A preliminary sketch received from Mr. D. L. Nicholl, Surveyor, was presented showing Block 3, F. P. Gumaer's Broadway Heights, re-sub-divided as Miller Heights. Motion, Mr . Jones, Seconded, Mayor Weigand, that preliminary sketch be approved subject to change in drawing to show a 16 foot alley rather than an 8 foot easement for utilities. Roll Call: Ayes: Guilford, Weigand, Jones, Wright, Romans, Rudd. Nays; None Absent: Jenssen. Recording Secretary directed to return the sketch to Mr. Nicholl advising him to make change before presenting the final plat for approval. Mr. V. A. Buckmaster appeared to ask approval to build two four unit apartment houses, one to be located at 3188 South Lincoln on fifty foot frontage, which location is zoned presently as R-2 and proposed as R-3 which requires 8,000 square feet land area. The second building would be located at about 3680 South Sherman which is presently and pro- posed as R-2 zoning. Mr. Buckmaster was told that neither of these locations were properly zoned under either present or proposed zoning; however, his request would be taken under advisement. PAGE 70 Mr. E. F. Dunham, of Woodman and Dunham Builders, appeared to request recommendation that the City of Englewood vacate the north 1 foot of the 8 foot easement along the south line of lot 6 , Block 9, Bellewood Second Addition, because of existing building encroachment. No vote was taken , but Acting Chairman Guilford directed the recording secretary to in- clude the recommendation of the Planning Commission, for this vacation, to Council, along with other recommendations regarding the same plat made at meeting of January 13 , 1955. Mr. Dunham also requested a letter of approval from the Planning Commission to the Board of Adjustment approving the granting of a building permit for construction of a one family house on a site described as the East 79.6 feet of lot 7, Block 9, Bellewood Second Addition , said lot being considerably shy of proper land area. The Planning Commission generally did not feel that this was a problem to be considered by th e m and it was decided that the request for the letter to the Board of Adjustment would be taken under advisement. Meeting was adjourned at 1:20 P. M. for recess until 2:00 P. M. The second session of the meeting was called to order by Acting Chairman Jones at 2.15 P. M. Members Present: Jones, Wright, Romans , Rudd . MembersAbsent: Janssen , Guilford , Weigand. Mrs. Romans , in the absence of Mr. Roy Stellway, 3298 South Bannock Street, presented a sketch showing location of two houses on lots 47-48, Block 4, S. G. Hamlin's Addition, a corner site at Delaware Street and Cornell Avenue , a one family house located on the front of the lots facing Delaware and a second one family house located on rear of lots facing Cornell Avenue. Mr. Stellway desired approval of The Planning Commission so that building permit could be issued for remodeling of the rear house. The Planning Commission decided that it would be permissible for the second house to remain so far as location on lots and land use is concerned since the site is in an R-2 Zone. Mr. Rudd was directed, however, to discuss the structural design further with the Building Inspector to make sure that the remodeled building would conform with the City Building Code. Mr . P. G . Lull appeared with a plat showing present dimensions of a site known as the North portion of lot 7 , Lull Heights and expressed a desire to build a house thereon. It was mutually agreed that certain vacations and dedications would be necessary before site would be suitable for construction. Mr. Lull was advised to work out a new proposed plat with the County Surveyor for presentation at a later date which would enlarge the site to conform with building requirements at which tiIJE action could be taken. Mr. Ragsdale, of Ragsdale Building Company, 1236 South Washington Street, Denver, appeared with a pencil sketch of a proposed sub-division bordered by Fox and Galapago Streets and Oxford Avenue and the City Ditch. The Planning Commission reviewed the sketch, making varbus suggestions for improvement and advised Mr. Ragsdale to have a final plat prepared for a surveyor and present same at a meeting at a future date for approval. A set of building plans, presented by Gratts-Warner Company, covered a proposed com- mercial building to be constructed on lots 25-26, Block 1, Wollenweber's Broadway Heights, was reviewed by the Board. After noting certain minor changes on the plans, they were given to Mr. Rudd for delivery to the Building Inspector for his inspection and approval. The meeting was adjourned at 4:30 P. M.
