The meeting was called to order by Acting Chairman Guilford at 10:00 A. M. PAGE 71 Mr. E. F. Dunham reappeared to again ask for a letter of approval from the Planning Com- mission, to the Board of Adjustment, approving the granting of a building permit for construction of a one family structure on a site described as the East 79.6 feet of Lot 7, Block 9, Bellewood Second Addition, said lot having a building area deficiency of about 20%. The Commission, as at the meeting of February 3, 1955, did not feel that this was a problem to be considered by them; however, Mr. Dunham was advised that a letter would be forthcoming stating the Commis s ion's stand. The letter was dictated to the recording secretary. Mr. George Nasr appeared regarding a building located at 3100 South Broadway which, until recently, has been used as an open air fruit market. Mr. Nasr desires to remodel the interior of the building thus converting to an office for a used car lot. Mr. Nasr was advised that the lot use conforms but that the building is non-conforming for the proposed type of use. It was recommended to Mr. Nasr that he contact the Board of Adjustment with this problem after having first presented building plans to the Building Inspector for approval. Mr. Gordon Sloan of 3180 South Franklin Street appeared regarding a plot described as lots 1-11 inclusive, block 7, Evanston Broadway Addition, which is in the 3000 block South Ogden, East side . Mr. Sloan desires to make this plot into five building sites of 55 feet by 125 feet. It was brought out that there is a serious drainage problem involved at this location and that a method of drainage and a means of financing same would have to be determined and agreed upon by the City and owners of property in the area. The matter of lot area could not be acted upon as the current lot size requirements were not available. Mr. Sloan was advised that the Commission would contact the City Engineer for a full report on the drainage problem and that proper lot area would be determined so that action can be taken on that matter at the next meeting. Mr. C. T. Heltman of 3897 South Inca and Mr. Laverne Adamson, Contractor of 4525 South Delaware appeared expressing a desire to replat the block bounded by Lehigh and Mansfield Avenues and Inca and Jason Streets, into building sites for one family homes. The present zoning for the entire block is agricultural and the proposed zoning shows the East or Inca Street side of the block as R-1-D while the West or Jason Street side of the block as L-1 or Light Industry. To act on this request would be to either recommend rezoning presently or to change the proposed new zoring. The gentlemen were advised that the Commission could not take action until after public hearings of the recommended proposed zoning ordinance. Mr. Vic Felt, 2243 South Adams Street, Denver, appeared regarding the following sites: 3700 Block South Jason, West side, lots 40-41-42, Block 7, Logandale. 3700 Block South Kalamath, East side, lots 1-2-3-4-5-6, Block 7, Logandale. 3800 Block South Jason, West side, lots 41-42-43-44, Block 12, Logandale. Mr. Felt asked permission to construct a masonery building 40 feet in width on a part of one of these sites to accommodate a small factory-machine shop. The present zoning is agricultural though several other light industries exist in the area. The proposed new zoning shows all of these sites as L-1 .. Motion, Jones; seconded, Romans, that action be deferred until the next meeting to give the Commission time to physically view the sites involved, after which action can be taken. Mr. Lee Corder, 2885 South Broadway, appeared to ask permission to build a s ix unit apartment house on a site located on the Northeast corner of the intersection of Bates avenue and Sherman Street. The site consists of three regulation size lots but, according to Mr. Corder, due to terrain would not be suitable for a one family structure. The zoning, both present and proposed is R-1; however, there are existirg duplex houses in the vicinity. Motion, Jones; seconded, Wright, that matter be deferred until the next meeting to allow further study by the Commission. Roll Call: Ayes; Guilford, Jones, Romans, Rudd, Wright. Nays; None Absent; Janssen, Weigand. Mr. Corder was advised to petition the neighborhood for reaction to building of a multiple unit of this size and present the petition at the next meeting. PAGE 72 Mr. P. H. Dowling, 780 South Washington Street, Denver, appeared with a sketch prepared by the City of Englewood, Engineering Department, showing a proposed vacation of a portion of Logandale Boulevard now situated on the Northwest corner of the Fox Street and Mansfield Avenue Intersection. This vacation would enlarge the property described as lots 25-26- 27, Block 16, Logandale 2nd Filing, enough to facilitate a building site. Motion, Weigand; seconded, Rudd, that recommendation be made to Council that the follow- ing portion of Logaqdale Boulevard be vacated: Beginning at a point .on the East line, 5 feet south of the North line of lot 27, thence on a straight line, Southwesterly to a point on the South line 44.5 feet East of the West line of lot 25, thence East 47.17 feet along the South line of lot 25, thence Northeasterly on a straight line to the point of beginning, Block 16 , Logandale 2nd Filing. Roll Call: Ayes; Guilford, Jones, Romans, Rudd, Wright. Nays; None Absent; Janssen, Weigand. Mr. J. D. Harris, 303 East Hampden Avenue, Englewood, appeared regarding the block bounded by Jefferson and Ithica Avenues and Huron and Galapago Streets all of which is presently zoned agricultural. The proposed zoningshows the East or Galapago Street side as R-1 and the West or Huron Street side as L-1. Mr. Harris expressed a desire for the entire block to become L-1 so that future plans could be made for Light Industry in the entire block. Mr. Harris was advised that the Commission will review the area with the proposed zoning consultants and determine whether or not it will be practical to move the Eastern line of L-1 zoning from the Huron-Galapago alley one block East to the Galapago-Fox alley and if so have same incorporated in the plans before the public hearings on the pro- posed new zoning ordinance. Mr. Kimmel of 240 West Layton Avenue appeared to discuss with the Commission the situation which exists regarding his property which is 74 feet wide fronting on Layton Avenue and extending North about 297.6 feet bounded on the West by what will become Cherokee Street after dedication. Mr. Kimmel desires to retain enough property area to make two build- ing sites after Cherokee Street is opened and wishes to make an addition to his present house on the site on the South. He feared that by making a full street dedication, his lot area would be deficient. Mr. Kimmel was advised that a Mr. Garrett of 1924 South Broadway, Denver, had already submitted a proposed sketch of the same area which would allow Cherokee Street to be opened 6n a less than normal width and would only require a five foot dedication from Mr. Kimmel's property on the West thus leaving his measurements about 69 feet wide by 297.6 feet or two sites about 69 feet by 148 feet . Mr. Kimmel was referred to Mr. Garrett regarding the matter as other owners in the area will need to agree to the pro- posal before it can be submitted for approval. Mr. M. C. Bott of 3101 South Downing revealed to the Commission that he is the owner of the entire West side of the 3100 Block South Downing located between Dartmouth and Eastman Avenues which is zoned presently and proposed as R-1.· Mr. Bott expressed a desire to have the area rezoned to accommodate duplex houses or buffet apartments. Mr. Bott was advised that the area was quite far removed from any such zoning proposal but that the Commission would take his problem under consideration for further study for feasibility of rezoning. Mr. A. D. Spencer of 4211 South Pennsylvania Street, appeared i ·n behalf of The Church of Christ, presenting sketches of their new proposed Church building and the land area which has been acquired by the Church consisting of six lots on the Northeas-t corner of the intersection of South Logan Street and East Union Avenue. The present zoning of this property is R-1 which does not allow a Church. The proposed zoning of R-1-D will allow a Church building. Mr. Spencer was advised that there were two alternatives, ie., he could apply for rezoning, the legal costs for which the Church must pay or, the construction must be delayed until after the new zoning becomes effective later this year. Mr. Spencer was directed to contact the Church Board and then advise the Planning Com- mission which procedure they desire to follow :. A letter was read from Sherman H. Miller, Minister, First Christian Church, 3190 South Grant Street directed to Mr. Rudd for presentation to The Planning Commission regarding problems involved in construction of a Sunday School Room addition to the Church. The meeting of February 3, 1955 brought out that the existing Church is non-conforming under present zoring while the proposed new zoning woul:l allow the Church building and the addition. The Church Board does not feel that should wait for the new zoning ordinance to become effective and are, therefore, applying for rezoning.· Motion, Jones, seconded Wright, that the Planning Commission recommend to Council that property owned by The First Christian Church, bounded by South Grant Street, Eastman Avenue and South Logan Street, described as lots 12-28 inclusive, block 1, Rose Addition, be rezoned to R-2 to permit expansion of the Church building and the parking area, the expense · of legal publication of rezoning ordinance to be borne by The First Christian Church. Recording Secretary was directed to write letter to Reverend Miller, attaching copy of recommendation for rezoning and pointing out necessity of expedience in acknowledgement of agreement to bear cost of legal publication of ordinance so that recommendation could be presented to Council Monday evening, February 21, 1955. Members absent: None The meeting was called to order by Chairman Janssen at 9:45 A. M. Mr. Pete A. Colman of 4488 Colman Drive and Mr. Joe Atencio, Attorney, appeared and revealed a petition for annexation and a proposed plat of Colman Subdivision described as follows: Beginning at a point 995 feet South of the Northeast Corner of Section Nine (9), Township Five (5) South, Range Sixty-eight (68) West of the Sixth Principal Meridian, thence West 280 feet; thence North 0°40' West 53.4 feet more or less Northwesterly along the upper bank of the City Ditch 533 feet more or less; thence West 180 feet; thence Southwesterly along the upper bank of said ditch 927 feet more or less to the South line of the North one-half (N!) of the Northeast quarter (NE!) of said Section Nine (~); thence East along Slid South Line 1548.5 feet to the point of beginning. This area is bounded by South Huron Street on the East, Stanford Avenue on the South and Colman Drive the remaining distance. Principal points discussed regarding the proposed plat were the lot sizes which varied but had a minimum of 75 foot frontages, an "L" shaped access roadway named Louise Court running off Stanford Avenue to a point midway in the project thence East to intersect with Colman Drive shown to be planned for 40 feet in width and easement problems involved. Motion, Guilford; seconded Jones, that The Planning Commission recommend to Council that the proposed annexation of Colman Subdivision be approved contingent upon a replatting in accordance with the proposed plat subject to establishment of a fifty foot access roadway instead of forty feet to be known as Stanford Place instead of Louise Court, as proposed and with the establishment of new utility easement between Stanford Avenue and Stanford Place, all other streets, easements and restrictions to be retained as originally platted in Colman Subdivision providing for a minimum floor area of 1,000 square feet for all houses, exclusive of garages and breezeways, and other conditions existing in present R-1-A zoning. Mr. Vic Felt, 2243 South Adams Street, Denver, reappeared to determine whether the Planning Commission had made a decision regarding rezoning of sites in Block 7, Logandale, said decision having been deferred from the meeting of February 17, 1955. All of the sites in question are presently zoned agricultural and Mr. Felt desires to build a machine shop which calls for present zoning of "M" to coincide with proposed zoning of L-1. Mr. Felt related that since February 17th, he has chosen the site described as Lots 40-41-42, Block 7, Logandale, located in the 3700 block South Jason Street, West side. Motion, Jones; seconded, Romans, that The Planning Commission recommend to Council that Lots 40-41-42, Block 7, Logandale, be re-zoned from agricultural to "M" zone to permit the building of a machine shop, such zoning to be compatible with proposed new zoning and further that necessary public recording expenses be borne by the petitioner. Mr. Felt was advised to submit a petition for this re-zoning signed by himself, as buyer, and the present owner so that same can be attached to the Planning Commission's r e commendation to Council. He was also advised to post $100.00 with The Englewood City Clerk .to :~be applied to expense of legal publications involved in re-zoning.
