Wilson Gordon Hays The following property owners appeared as a result of an invitation n rom the Planning Com- mission to endeavor to arrive at some equitable plan of subdivision of the area located between West Oxford Avenue and West Quincy Avenue and between the Hays Subdivision and South Jason Street: (l Mr. and Mrs. Arthur Sanger Mr. R. Wilson Mr. Gordon Hays A proposed plan of subdivision was presented by the Planning Commission which would enable ~he use of all the land in the area with a workable street plan and lot sizes indicated in compliance with the zoning ordinance. This proposal, because of divided ownership, would involve a common interest by all property owners and full cooperation. After a l~ngthy discussion, in which not all of the property owners could agree, .Rapp moved: Romans seconded: that the rescinding action referred to in Hearing No. 18-A, March 15, regarding tentative plan of the White Subdivision, be continued until the next ~eeting to be held at 8:00 P. M., Thursday, April 12, 1956. M. Members Present: Barde, Braun, Guilford, Rapp, Romans, Rudd Members Absent: Jones H. T. Whitaker Whitaker Subdivision, Second Filing 4970 South Lipan Dr. Hearin g No. 23-B March 29, 1956 Apri 1 12, 1956 Mr. Whitaker presented the finished plat of Whitaker Subdivision, Second Filing, a resub- division of Tract 18, Whitaker Acres. After discussion, Rudd moved: Romans seconded: that the Planning Commission recommend to Council that the Plat of Whitaker Acres, Second Filing, be approved as presented. Roll Call: Ayes: Barde, Braun, Guilford, Rapp , Romans, Rudd Nays: None Absent: Jones Jess Kirklin Arthur Kirklin Jess Goin 2857 South Bannock See Below Hearing No. 28 The above named gent lemen appeared to discuss the possibility of rezoning an area located between South Mariposa Street and Topeka Court and West Mansfield Avenue and West Nassau Avenue from M-1 District to M-2 District. During the discussion, it was determined that the new Zoning Ordinance does not set out clearly the procedure of the Planning Commission in making recommendations to Council for re-zoning. I I I I I I PAGE 141 Rudd moved: Braun seconded: that the Planning Commission recommend to Cguncil that the present Zoning Ordinance be amended to provide for definite requirements in a petition for rezoning, and that a more realistic fee be provided for, and that a minimum size eligible for rezoning be established, and that any portion of the present ordinance in any conflict therewith be repealed; and, that provisions be made to publish the Zoning Oidinance in pamphlet form, to be available on or about August 1, 1956, such pamphlet to be prefaced with proper excerpts from statutes setting out the duties and jurisdiction of the City Planning Commission. Roll Call: Ayes: Barde, Braun, Guilford, Rapp, Romans, Rudd Nays: None Absent: Jones The petitioners were advised that no action could be taken on the rezoning request at this time and were asked to contact the commission at a later date. Sunderlin 1190 West Oxford Avenue See Below Hearing No. 18-D February 16, 1956 Mar ch 1, 1956 March 15, 1956 March 29, 1956 April 12, 1956 The above named property owners appeared to further discuss subdivision planning of the general area loc~ted between West Oxford Avenue and West Quincy Avenue and between the Hays Subdivision and South Jason Street and more specifically an area agjacent to and just East of the Hays Subdivision previously referred to as the White Subdivision and the portion of which Mr. Sunderlin is part owner and was speaking for. After discussion, Rapp moved: Braun seconded: that the proposed subdivision plan heretofore referred to as the White Subdivision be rejected on the grounds that it is not a feasible layout fr9m the $tandpoint of both existing street and adjacent land developments and therefore is deemed not to be in the best interests of the public: Roll Call: Ayes: Barde, Braun, Guilford, Ra pp , Romans, Rudd Nays: None Absent: Jones The Recording Secretary was directed to advise Mr. Sunderlin, spokesman for the White Subdivision, of the above action, by letter. Rex Garrett See Below Hearing No. 29 3484 So. Downing Mr. ·Garrett, representing .certain property owners, filed his offer to convey to the City a strip of land along the East line of present South Lipan Street extending from the South line of West Tufts Avenue . to the North line of West Layton Avenue, such strip being 4.37 feet wide at the North end and 3.63 feet wide at the South end, and to be used for street purposes; also, a strip 16 feet wide extending from the South line of West Tufts Avenue to the North line of West Layton Avenue, the center line of such strip lying 133 feet West of and parallel to the West Line of South Kalamath Street to be used for alley purposes; the objective being that Mr. Garrett and the certain owners will retain lands between South Kalamath Street ~nd South Lipan Street sufficient to make building sites exactly 75 feet by 125 feet in size. Braun moved: Rapp seconded: that the Planning Commission recommend to Council that the above described offer be accepted for the purposes indicated. Roll call: Ayes: Barde, Braun, Guilford, Rapp, Romans, Rudd Nays: None Absent: Jones Charles Allen 2706 South Grant 3342-46-50 South Broadway Hearing No. 30 Mr. Allen appeared to discuss the possibility of a curb cut on the East side of South Broadway for the purpose of ingress to a driveway along the North side of the building known as 3342-46-50 South Broadway, egress to be furnished through the alley between South Broadway and South Lincoln Street. Mr. Allen desired to know whether or not this request would be considered favorably b~ the Planning Commis~ion should his further planning require the curb cut. The various board members present indicated that a curb cut to provide for a one way entrance for traffic from the South only would be considered favorably . The meeting was adjourned at 12:20 'A. M.
