NOW, THEREF ORE, BE IT RESOLVED that to both insure the orderly growth and development of The City and it's quicker consideration of ways and means to put into effect the afore- mentioned "Proposed Drainage Plan", no further construction be permitted in or along any natural drainage courses within The City limits without City Council sanction where, in the opinion of the Englewood Planning Commission or the City Engineer, such construction would either contribute to flood conditions along such courses or be subject itself to flood hazard by reason of such location. Councilman Scott, moved: Braun seconded: To adopt the above Resolution. Ayes: Braun, McCabe, McLellan, Nies, Parker, Purcell, Rapp, Scott, Woods Nays: None Absent: None" Planning Commission member Rapp moved, Braun seconded: That the letter addressed to Mr. Rudd, City Manager, from Mr. Beryl A. Wallace, Building Inspector, under date of August 16, 1956, in the matter of retaining walls in the 3300 block South Corona, which was referred to this Board for review, be received and returned to the City Manager with the following opinions: 1. That the terms: "No further construction be permitted in or along any natural drainage courses within the City limits without City Council sanction where, in the opinion of the Englewood Planning Commission or the City Engineer, such construction would either contribute to flood conditions along such course or be subject itself to flood hazard by reason of such location.", were intended to cover such instances as described in Mr. Wallace's letter. 2. That the matter of the order for removal is not a matter for decision by this Board. M. Members Present: Braun, Rapp, Romans, Rudd Members Absent: Barde, Guilford, Jones Friedrike B. Broadhurst Earl J. Hower, Attorney 4332 South Lincoln St. 4332-4340 So. Lincoln St. Hearing No. 43 Mr. Earl J. Hower, representing Friedrike B. Broadhurst, operator of a nursing home for adults at 4332 and 4350 South Lincoln Street, appeared and presented the original notice from the Englewood Building Inspector dated August 10, 1956 which advise that operations of said nursing home at the present address must cease or be moved within sixty days. The nursing home is being operated in two dwellings at theabove .addresses which are in R-1-D Zone District, which district does not permit such use. The operation was begun without City permission. 4332 South Lincoln was acquired and operation begun in August, 1953 and 4350 South Lincoln was acquired and included in the operation in June, 1954. The original cost of the homes was $10,500.00 each and approximately $4,000.00 in improvements have been made. The improvements apparently were also made without City permits since no record of same can be located. After considerable discussion, it was determined that the only course of action that could be followed by the Planning Commission would be consideration of rezoning to C-2 District-of an area surrounding the homes since any other appropriate zoning would constitute 'spot zoning which is illegal. The appellants were referred to the Zoning Board of Adjustment to request an extension of time of operation so that proper petitioning could be formulated for rezoning. Rudd moved: Braun seconded: that ·any action on the proposals from the parties appealing this case be deferred to a later date. The following letter was written to Harman , O'Donnell & Henninger Associates, Inc., Planning Consultants relative to the above problem ~ PAGE 152 CITY PLANNING COMMISSION August 30, 1956 Harman , O'Donnell & Henninger Associates, Inc. Tramway Building Denver , Colorado Gentlemen: It ~ould be greatly appreciated if you would give this Commission oertain Background in- formation which you considered in the zoning of nursing and convalescent homes into C-1, C-2 and R-3 Zone Districts. We have several such institutions now operating in R-1-D Zone which are non-conforming and in some cases are in violation. What procedure can you suggest to le g alize these activities, or do you recommend that they be eliminated by due process since we have p ossible litigation now confronting us~ There is an increasing need for s u c h i nstitutions because certain advancements in medicine are prolonging life expectancies. We feel that a very definite policy of licensing and control , even on municipal level, is becoming more and more necessary, over and above present Tri-County District requirements. Very truly •yours, /S / Lee Jones Chairman A letter from Mr. Stuart Eurman, Executive Director of the Inter-County Regional Plannin g Commission, Denver, Colorado, was presented and read. The letter referred to "A Guide To Street Naming and Street Numbering In TheDenver Metropolitan Region", copies of which were distributed to members of The Planning Commission and discussed by Mr. Eurman at the June 28, 1956 -meeting of the Englewood Planning Commission and ask what action had been taken toward the recanmendations made for the City of Englewood. The following news release was prepared for the local news papers and radio station: CITY OF ENGLEWOOD PLANNING COMMISSION August 30, 1956 The Inter-County Regional Planning Commission, whose interest is in all of the Counties adjacent to, as well as in, the City and County ofDenver, has suggested to the various local Planning Commissions that a more nearly uniform system or plan of street naming and house numbering be adopted. Many streets in the Metropolitan area do not extend on the true rectilinear system. The various irregular and curving streets run in every direction. Upon the multitude of subdivision plats which have been accepted and filed in the past, there are many deviations from a systematic plan, both in name and numbers. The disadvantages now accruing because of these irregularities include the possible mis- routing and delay following emergency fire, ambulance, Doctor and police calls; the mis- delivery and delay in the handling of U. S. Mail and merchandise; the unfavorable impression on visitors and motorists and pedestrians searching for addresses; the complications in maintaining correct addressing for licenses, documents, vital statistics , etc.; and the resultant extra expense to all persons involved because of these various difficulties. Englewood is quite fortunate with respect to coordination of street names in the Metropolitan Area; however,· a few exceptions still exist. It has been strongly recommended by The Inter-County Regional Planning Commission that Greenwood Parkway be changed to Greenwood Avenue; that Cherry Lane be changed to South Clarkson Circle; that Arapahoe Place be changed to Cornell Place; and that various sections of Bates Parkway be changed to Bates Drive and Amherst Drive. The City Planning Commission has discussed these matters informally. At their next session, to be held on September 13th, more specific and definite action will possibly be taken. The Commission ,will appreciate comments •on these proposals from any who are interested in or affected thereby. Kenneth Andrews -3398 South Ogden Kenneth Ordelheide -3393 South Corona See Below H~aring No. 42-A August 16, 1956 There was held, at this time, further discussion of the petition presented August 16, 1956 by Mr. Andrews and Mr. Ordelheide, requesting consideration of rezoning of the area bounded by South Corona, East Girard Av e nue, South Ogden Street and East Floyd Avenue (3300 Block) from present R-1-D District to R-2 District for the purpose of permitting basement apart- ments in the various existing homes. Rudd moved: Braun seconded: that the above request be denied . M. Members Present: Braun, Rapp, Romans, Rudd Members Absent: Barde, Guilford, Jones Vice-Chairman Guilford entered just after the meeting was opened and too~ the Chair. E. 0. Davis See Below Hearing No. 44 2960 South Fox Street Request for Planning Commission consideration of rezoning of lots 11-18 inclusive, Block 2, S. G. Hamlins Addition from present R-2-B District to M-1 District for the purpose of permitting an office building and storage facilities. 'Mr. Davis indicated that he desires to remodel and enlarge an existing garage building to 1,200 square feet for a warehouse and to construct an office building of 4,200 square feet to be located on a site 12,000 square feet in size. Chairman Jones entered at this time and took the Chair. It was pointed out, to Mr. Davis, that this area had been seriously considered for Industrial zoning prior to the passage of the present Zonin g Ordinance and that this thinking was met by vigorous protest by residential property owners in the area. Mr. Davis was advised that, in order to avoid spot zoning which is illegal, an area bounded by the Fox-Elati Alley and the center line of South Galapago Street and West Bates Avenue and West Cornell Avenue would, of necessity, need to be included in any consideration for rezoning, thus making the considered area contiguous to an existing M-2 District. Mr. Davis was further advised that, if he elects to proceed with rezoning efforts, he should have a petition prop erly drawn showing area description and indicating in some way the resistance to such a movement and /or the lack of resistance. It was pointed out that the petitioner must bear the expense involved in posting of the property and the legal advertising. Nursing Homes See Below Hearing No. 43-A August 30, 1956 A letter, in reply to the Planning Commission's letter of August 30, 1956 to Harman, O'Donnel and Henninger Associates, Inc., was presented and read at this time. The letter was in reference to the problem of existing nursing homes in R-1-D Zone Districts within the City limits of Englewood. (See copy attached hereto). After discussion, Rudd moved: Braun seconded: that a copy of the letter from Harman, O'Donn ell & Henninger, replying to the Planning Commission's letter of August 30, 1956, be furnished to each member of City Council with the suggestion that no action be taken now on paragraph 5 therein until there has been consideration given paragraph 6~ Ayes: Braun, Guilford, Jones, Rapp, Romans, Rudd Nays: None Absent: Barde Mr. Rudd stated , at this time, that it was his opinion that corrections for the Zoning Ordinance should be gotten in order so that the corrected Zoning Ordinance can be made available in pamphlet form. A general discussion was held, at this time, relative to annexation policy of the City of En glew ood.
