Six spoke in favor of the proposed change of zoning and two sp0ke in objection, one of whom resides outside of thearea of influence in this rezoning case. Under provisions of Article 3 of The Zoning Ordinance, The Planning Com- mission recommends approval of a change, in whole, of all of Block 1 and the West one half of Block 2, S. G. Hamlin's Addition from R-2-B (Residential) District to M-1 (Industrial) District. M. Planning Commission members present: Planning Commission members absent: Barde, Braun, Jones, Guilford, Rapp, Romans, Rudd None Zoning Board of Adjustment members present: Zoning Board of Adjustment members absent: Nursing Homes See Below Cartwright, Hill, Kinney, Miles, Wilson None Hearing No. 43-E August 30, 1956 Sept. 13, 1956 Oct. 11, 1956 Nov. 1, 1956 The purpose of the joint session was to discuss the problems, involving both Boards of the various rest homes, convalescent homes and nursing homes within the City of Englewood, and particularly those which are non~conforming as a result of being located in improper Zone Districts. Miss Edith Heid of The State Department of Public Health, 1422 Grant Street, Denver, had accepted an invitation to attend the meeting and was present to join the discussion from the angle of licensing and inspection of this particular type of activity; she indicated to the collective group that the State Department of Public Health and the Tri-County Health and Sanitation Department would cooperate to the fullest in any effort to solve the Rest Home problems. Miss Heid made available, copies of THE DIRECTORY OF HEALTH ESTABLISHMENTS, STATE OF COLORADO and REVISED STANDARDS FOR NURSING HOMES AND HOMES FOR THE AGED, STATE OF COLORADO. THE DIRECTORY OF HEALTH ESTABLISHMENTS gives the current listing of existing homes and the present operators along with pertinent statistics for each establishment. Each of the Englewood homes listed was discussed briefly, though no endeavor was made at this time to determine which was non-conforming. THE REVISED STANDARDS FOR NURSING HOMES AND HOMES FOR THE AGED sets out the rules and regulations as atoped by The State Board of Health and shows the powers and duties of The State Board of Health. Miss Heid stated that The State Board of Health endeavors to work closely with the local zoning and fire regulations and that issuance of license or renewal of same is dependent upon the ability of the operators of the homes to comply with the local regulations. PAGE 164 The following d e finitions from THE REVISED STANDARDS FOR NURSING HOMES AND HOMES FOR THE AGED were of particular interest and were discussed at length: Nursing Home -means a health establishment which maintains and operates facilities for twenty-four hours or more, providing room and board, personal services, Homes for the Aged - and nursing care for two or more persons not related to the proprietor who , by reason of illness or physical infirmity, are unable to properly care for themselves. Alcoholics, dru g addicts, persons with mental di se ases, and persons with communicable diseases (including contagious tuberculosis) shall not be admitted nor cared for in homes licensed under this section. means a domiciliary establishment which maintains and operates facilities for twenty-four hours or more, providing room, board and personal services for two or more persons not related to the proprietor. When nursing care is provided in institutibns licenses as "Homes for the Aged" it shall be for ailments of a temporary or minor nature only, inasmuch as the provision of nursing care is not the primary purpose of a Home for the Aged. Miss Heid pointed out that the State Board of Public Health has dropped the term "Convalescent Home" and Mr. Rudd suggested that theCi ty ,,of En g lewood, in amendin g the Zoning Ordinance, also drop the term "Convalescent Home" and substitute the term "Nursing Home". Miss Heid asked for several i ems of information relative to a number of the local homes which the City might have and it was agreed that such information would be made available . Miss Heid requested that no further building permits be issued for either construction or improvements to Nursing Homes or Homes for The Aged until it is determined t ha t State Health Department requirementf can be met. It was brought out during the discussions that the City will shortly be makin g a house to house canvas of most of the residential portions of the City to gather more definite and exacting data upon which decisions may be based. M. Members Present: Barde, Braun, Jones, Guilford, Rapp , Romans, Rudd Members Absent: None Mrs. Rose Lorenzo 3700 South Logan See Below Mrs. Lorenzo appeared to request Planning Commission consideration of rezoning of eight lots, located on the West side of the 3700 Block South Logan Street immediately South of East Kenyon Avenue, from pre?ent R-1-D Zone District to R-2-B Zone District. Mrs. Lorenzo stated that she had not been successful in selling this property for one family home sites and that they thought they were ideal sites for two family dwellings. She also advised the Commission that her home, which is located on the East side of the 3700 Block South Logan, is to be taken over by the Public Schools through condemnation proceedings and that it would soon become necessary for them to make other arrangements for living quarters, which would directly or indirectly involve the above mentioned vacant property. It was felt by the Commission that an area not less than that bounded by South Logan Street, East Lehigh Avenue, the Grant-Sherman alley and East Kenyon Avenue should be considered since an R-2-B area exists West of the Grant-Sherman Alley and spot zoning consideration could thus be eliminated.
