Members Present: Barde, Braun, Rapp, Guilford, Jones, Romans Members Absent: Rudd Shelby L. Whaley 3490 South Downing 3490 South Downing Hearing No. 16 Mr. Shelby L. Whaley, Lessee of a local Standard Oil Company service station appeared to discuss with The Planning Commission the large number of service stations which now exist within the City of Englewood and the hardships for the lessees that would be added through new competition created by opening of other new service stations at this time. Mr. Whaley offered his services in making any kind of ·a City wide survey regarding this problem which might be of use to The Planning Commission in making future decisions regarding service station construction. Wilson -:r7U5-S0uth Fox Street Oxford Heights Hearing No. 3-A TI~12-56) Mr. Wilson presented the final plat of Oxford Heights, a subdivision in the SE! of Sec. 4, T. 5S, R 68 W., City of Englewood, County of Arapahoe, Colorado, bounded by West Oxford Avenue, South Jason Street extended, West Quincy Avenue artd approximately the South Huron- South Inca alley extended. Braun moved: Romans seconded: that the Planning Commission recommend to Council that the plat of Oxford Heights be approved as presented. Roll Call: Ayes: Barde, Braun, Rapp, Guilford, Jones, Romans Nays: None Absent: Rudd Lee Schillinger 4"2"9"5 -SOuth Delaware Dwight John 523 South Windermere Ave. See Below Hearing No. 17 Messrs. Schillinger and John appeared to present a sketch and request a partial rezoning of an area bounded by South Broadway, West Layton Avenue, South Bannock Street extended and West Chenango Avenue. The proposal was for a C-2 District between South Broadway and the Acoma-Bannock alley extended and an R-2-A District between the Acoma-Bannock alley extended and South Bannock Street extended. After discussion, Chairman Jones instructed the Recording Secretary to receive the sketch and asked the Commission members to endeavor to view the area before the next meeting so that action can be taken on the request at that time. J. H. White See Below Hearing No. 18 1101 West Quincy Ave. Mr. White showed a pencil drawing of an area South of West Oxford Avenue adjacent to and just East of The Hays Subdivision and requested approval of the Planning Commission for placement of South Kalamath Street to intersect the plot North to South to join with an extension Eastward of Quincy Place. Mr. White stated that placement of the street is necessary so that dedication of same may be made in order to sell the land and bring about subdividing. Chairman Jones stated that the Planning Commission would make a study of the area before the next meeting and suggested that Mr. White have a platting proposal prepared showing lot sizes along with necessary easements and other necessary features for presentation at the next meeting. Dowle Conrad Colsman See Below Equitable Building, Denver Hearing No. 13-A (2-2-56) The above named gentlemen appeared to discuss further their previous request for permission for a 42! foot curb cut along the West side of South Logan Street beginning 88 feet North from East Jefferson Avenue or the North edge of the proposed new State Highway along with their request that South Grant Street be opened, as a driveway, North off of East Jefferson Avenue to a width of 44 feet instead of the proposed 36 feet. After discussion, Rapp moved: Braun seconded: that the request regarding the Logan Street curb cut be tabled until such time as a plat showing the proposed use is submitted and that no advance committments be made by the City. Roll Call: Ayes: Barde, Braun, Rapp, Guilford, Jones, Romans Nays: None Absent: Rudd Albert D. Spencer Church of Christ 4211 South Pennsylvania St. So. Logan at East Union Hearing No. 19 Mr. Spencer appeared to request permission to construct a Church on the corner property located on the North side of East Union Avenue and the East side of South Logan Street . This area is in R-1-D District and under conditional uses in this zone District, permission for this use may be granted by The Zoning Board of Adjustment. Mr. Spencer showed the plot plan which indicated approximately 18,750 square feet lot area. It was determined that about 8,000 square f eet of off street parking would be necessary and approximately 9,000 square feet will be available . Mr. Spencer was ref erred to The Zon ing Board of Ad j ustment, the next meeting being scheduled for March 14, 1956. Robert Kelly See Below Hearing No. 9-A 3311 South Broadway A proposed agreement between the owner of property between East Bates Avenue, East Cornell Avenue, South Emerson-South Clarkson alley extended and South Ogden-South Emerson alley extended, and the City of Engl e wood re g arding storm drainage facilities was presented and read by the Secretary. After discussion, Rapp moved: Braun seconded: that the Planning Commission advise Council that in considering the pro- posals introduced by this agreement, The Planning Commission feels that there is a question as to the degree of damage possible to the adjoinin g property owners which cannot be determined until further engineering studies are made. The Planning Commission recommends that any action on the pro- posed subdivision and the agreement be tabled until the engineering studies can be made by the City Engineer. The Plannin g Commission will attempt to have a more complete report by March 5, 1956. Roll Call: Ayes: Barde, Braun, Rapp, Guilford, Jones, Romans Nays: None Absent: Rudd Planning Commission Special Meeting Hearing No. 20 Regarding the Uniform Subdivision regulations study, it was agreed that the Planning Com- mission will hold a special meeting at 8:00 P. M. Present: Barde, Braun, Guilford, Jones, Rapp , Rudd Absent: Romans Ed Clark See Below Hearing No. 9-B Mr. Clark appeared to discuss further the proposed sub-divisim of the SWt of the NWt of Sec. 35, T. 4S, R. 68W, in the City of Englewood, Arapahoe County, Colorado, such described property located between East Bates Avenue and East Cornell Avenue and between the South Emerson-South Clarkson alley extmded and the South Ogden-South Emerson alley extended. A report was read at this time which was prepared and presented by Neil Barde, City Engineer, covering flood conditions in the vicinity of East Bates Avenue and South Eme Eson Street. After discussion, Rapp moved: Braun seconded: that The Englewood Plannin g Commission recommend to Council that the original recommendation, as presented to Council February 2, 1956, be modified pursuant to the conditions of the report of Neil Barde, City Engineer so as to prohibit issuance of a building per.mit for lot 13 in addition to the original prohibition covering lots 1 through 5. The Planning Commission further recommending to Council the adoption of the following policy resolution as a result of the study of Mr. Barde's report highlighted by the subject situation: RESOLUTION WHEREAS, since it's very existence, the City of Englewood has had within it's borders, and continuing in exte nuation, as thCEe borders have been changed or altered, certain natural drainage courses and /or channels, and, WHEREAS, no practical building restrictions have been heretofore imposed by the City Council of Englewood in respect to construction within these drainage area, and, I I I
