ENGLEWOOD PLANNING COMMISSION MEETING
March 14, 1957
The meeting wa s called to order by Chairman Jones at 8:00 P. M.

Mr. Hively and Mr. Luna appeared and presented a proposed plat of the West side of t h e 3200
Block South Galapago Street which lies between West Eastman Avenue extended and Wes t -F16yd
Avenue. The proposal indicated a 30 foot dedication for the West half of South Galapa g o
Street the entire length of the block and a 30 foot dedication ~for the South ha lf of West
Eastman Avenue from the center line of South Galapago Street, as proposed, to t he West
extremity of the plat. An 8 foot utility easement was i n dicated along the rear or West
lot lines of all building sites from West Eastman, as proposed, to the North line of West
Floyd Avenue. Ten building sites were shown, each with 58.4 foot frontages and with a
depth of 131 feet. This would provide for 7,650.4 square feet lot area which exceeds the
minimum area as required by Ordinance in the R-1-D Zone District; howev e r, the minimum
frontage requirement is 60 foot frontage for each building site.
Following a detailed study and discussion of the proposed plat, it was felt by the Planning
Commission that they had no authority to approve a plat with any dimensions sub-standard to
the present Zoning Ordinance.
Rapp moved:
Romans seconded: That the Planning Commission receive the proposal and refer to the City
Attorney the question as to whether the Commission has authority to
approve a plat having less than minimum lot sizes and frontages required
by the Ordinance, endeavoring to be in a position to take final action
for recommendation to City Council at the next session of the Commission,
Thursday, March 28, 1957.

There followed a discussion as to the possiblities of P lanning Commission approval of the
same plat with the exception of showing 9 building sites of 60 foot frontages or more.
Rudd moved:
Braun seconded: That the preliminary plat be given tentative approval contingent upon
a revision of lot frontages to 60 feet or more.
Ayes: Barde, Braun, Guilford, Jones, Rapp, Romans, Rudd

It was suggested to the applicants that, if they choose to proceed with the plat on a basis
of 9 building sites, which would leave some excess land available above the required minimum
frontages, that the sites at each end of the block be made larger to provi d e for ample side-
yard setback without necessitating construction of h o uses too close to th<Ee adjacent on the
next lots.

Mr. Johnson appeared to discuss further the proposed construction of a multiple unit apart-
ment house on a site located at the Southwest corner of West Jefferson Avenue and South
Cherokee Street.
On February 14, 1957, Mr. Johnson had requested that, upon dedication of sufficient land
along the West side of South Cherokee Street to open same to a width of 60 feet from West
Jefferson Avenue to the City Ditch, the City to agree to grade both South Cherokee Street
and West Jefferson Avenue and install necessary 36" concrete pipe for a crossing of the
City Ditch, said pipe to be furnished by the petitioners.
Mr. Johnson stated that upon discovery that it would be necessary to dedicate 47 feet from
the Eastern portion of the building site, it was determined that the 129 feet Jefferson
Avenue frontage remaining and 120 foot depth would not accomodate the building as planned.
He also stated that owners of the property immediately South would not consider any dedication
of land for street purposes at this time.

The recommendation of the Englewood Planning Commission from the meeting of February 14,
1957 to the Englewood City Council, and the subsequent meeting of the Englewood City
Council on February 18, 1957 has been presented to us as the Sellers of the property on
the South West corner of West Jefferson Avenue and South Cherokee Street.
After careful consideration of the proposal, we feel that the request of the Purchasers
of this ground is not in keeping with the plans we have for the gr ound afore mentioned.
You are hereby respectfully requested to withhold further action to open South Cherokee
Street, and provide tentative approval of a building to be erected on the aforementioned
property without the futther dedication of rights-of-way for the street of South Cherokee.
We are assuming the proposed building to be within the present zoning regulations of
Englewood.

Mr. Johnson stated that, in view of the above letter, he was requesting that any further
action as proposed by The Planning Commission on February 14, 1957 and subsequently
substantiated by City Council at its meeting of February 18, 1957 be discontinued and
that the Planning Commission recommend issuance of a building permit allowing the use of
the entire plot without further consideration of openin g South Cherokee Street.
After discussion,
Guilford moved:
Romans seconded: That the following memorandum be sent to City Council and the Building
Inspector:
In connection with the application referred to in the above letter,
the attention of the Building Inspector is called to the following
references:
(1) Article VI, Paragraph 13, Supplementary Re gulations, 1955
Zoning Ordinance, which states: "No building permit shall be
issued for a building or structure on a lot which abuts a
street dedicated to a portion of its required width and located
on that side thereof from which no dedication has been made.
(2) The Master Street Plan established by Ordinance No. 13, Series
of 1951 which authority indicates to the Planning Commission the
desirability and necessity for the eventual opening of South
Cherokee Street in this block requiring at least 50 foot roadway,
the recommended standard for this street.
Additional requirements on dedicated street widths may be indicated
upon study by The City Engineer.

After some further discussion, it was indicated by The Commission that consideration could
p ossibly be given to a dedication of land sufficient to open Cherokee Street to 50 foot
width rather than the originally proposed 60 foot width.
Mr. Braun was excused from the meeting at this time.
Mr. Jones, Chairman, stated that, inasmuch as The Englewood Planning Commission has not
been represented at the sessions of The Inter-County Regional Planning Commission, he
would volunteer to attend for a period of time covering the next few months.
At the request of City Council, the Planning Commission held a discussion on procedures
relative to utility franchises.
After discussion, it was determined , that City Planning Commission attention should be
limited to the developmentrf1ases of the physical plant in connection with public utilities
rather than the regulations of the franchise.
Mrs. Romans was excused from the meeting at this time.
R. W. Northrup See Below Hearing No. 73
Mr. Rudd, City Manager, stated that Mr. R . W. Northrup had requested some Planning Commission
consideration be given to a sub-division plan in an area North of West Oxford Avenue and
in the vicinity of South Inca Street and South Jason Street extended because there is a
movement in the area to start residential construction in a location which will interfere
with later feasible street extensions and, no doubt, applications for buildirg permits will
be forthcoming.

The letter of January 29, 1957, diredted to The City Planning Commission, Attention: Mr .
Beryl Wallace, Building Inspector, from Mr. Royal R . Irwin, Attorney and Mr. Thomas T.
Grimshaw, Attorney, requesting an exten~ion of time be allowed on Building Department
Notices Numbers 344 and 356 dated Ja.nuary 10, 1957, ordering vacation of second unit apart-
ments in residences at 2785 and 2775 South Grant Street respectively within 30 days, and
which letter was referred to The Zoning Board of Adj us tment for action, was returned to
The Planning Commission with the following recommendat ~on:
"It is the recommendation of the Englewood Zoning Board of Adjustment that whenever the
Building Inspector takes action within the scope of the Zoning Ordimnce, proper support
be accorded him."
There being no further business to come before The Englewood Planning Commission, the
meeting was adjourned at 12:05 A. M.

RECOMMENDATION OF THE ENGLEWOOD PLANNING COMMISSION.

Subject: Partially Dedicated Streets and Issuance of Building Permits Thereby (See
Planning Commission Minutes -Hearing No. 65, February 14, 1957 , and Hearing
No. 65-A, March 14, 1957)
The following letter from H. P. and Lulu I. Nauman, pres e nt owners of the
tract located at the Southwest corner of the intersection of South Cherokee
Street and West Jefferson Avenue, was presented, read and discussed at the
meeting of The Englewood Planning Commission, March 14 , 1957:
