Members Absent: Rudd Associated Veterans, Inc. 799 West Hampden Avenue 799 West Hampden Avenue Hearing No . 57-B January 17, 1957 May 16, 1957 The property having been properly posted and public notice given, a hearing was held regarding the rezoning, from R-1-D Zone District to C-2 Zone District, of the following described land: Beginning at a point 50 feet East and 193 feet North of the S.W. corner of Section 34 , Township 4 South, Range 68 West of Sixth P.M.; thence North 65.63 feet; thence Northeasterly along Greenwood Parkway 202.19 feet; thence South 206.24 feet; thence West 145.0 feet to point of beginning. (The Northerly portion of the property at 799 West Hampden Avenue presently owned by Associated Ve terans, Inc.) There being no property owners present to be heard, Braun moved: Guilford seconded: That the hearing be closed. Ayes: Barde, Braun, Guilford, Jones, Rapp, Romans Nays: None Absent: Rudd After some discussion, Braun moved: Gui 1f ord seconded: That the Planning Commission recommend to Council that, since due notice has been given,' property has been properly posted and a hearing was held with no property owners present to be heard, under provisions of Article 3 of The Zoning Ordinance, a change of zoning be made , in whole, from present R-1-D Zone District to C-2 Zone District, of the following described land: Beginning at a point 50 feet East and 193 feet North of the S.W. corner of Section 34, Township 4 South, Range 68 West of Sixth P.M."; thence North 65 .63 feet; thence Northeasterly along Greenwood Parkway 202.19 feet; thence South 206.24 feet; thence West 145.0 feet to point beginning. Ayes: Barde, Braun, Guilford, Jones, Rapp, Romans Nays: None Absent: Rudd George Allen See Below 2799 South Downing Hearing No. 17-C February 16, 1 956 March 15, 1956 May 16, 1957 Mr. Allen appeared to request Planning Commission consideration of a chang e of zonin g, from present R-1-B Zone Distra ct to R-3 Zone District, of a tract of land generally described as the North 155.85 feet of the South 305.85 feet of the area lying between West Layton Avenue and West Chenango Avenue and between the South Acoma-Broadway alley extended and South Bannock Street extended. After considerable discussion in which it was brought out that the Commission ge nerally does not feel that an area less than a square block, unless the contiguous to a like zoning, should be considered f or a zoning change. Romans moved: Rapp seconded: That the request for zoning change be denied at this time. Leroy Smith Calvary Baptist Church 101 West Chenango Avenue 101 West Chenango Avenue Hearing No. 85 The above named representatives for the proposed new Calvary Baptist Church to be located at 101 West Chenango Avenue appeared and presented a plot plan of the land owned by the Church along with land which is under their option to purchase, described as follows: Tract of land in s! of SW~ of Section 10, Township 5 South, Range 68 West of the 6th P.M. more particularly described as follows: PAGE 204 Beginning at a point on the North boundary line of Chenango Avenue, which is 296 feet West of the intersection of the West line of South Broadway with the North line of said Chenango for a point of beginning; thence west along said North line of said Chenango a distance of 326 feet to a point; thence North a distance of 150 feet; thence East a distance of 326 feet; thence South a distance of 150 feet to a point of beginning. The gentlemen requested Planning Commission corsideration for permission to use a portion of South Acoma Street extended, which is within the above described property under their ownership, t o construct a part of their proposed new Church building.Acoma Street presently dead-ends f r om the South at West Chenango Avenue with no part of South Acoma treet yet dedicated for street purposes through the 4800 block. Their reason for th e re quest was to make the maximum use of their land with the future structures, still leaving sufficient land for future off-street parking spaces; also, due to the fact that a sewer trunk line runs throu g h the property from South to North would necessitate a change of building plans if the structures were to be arranged to facilitate the opening of South Acoma Street. After considerable discussion, Braun moved: Guilford seconded: that the request for permission to construct a Church building partly in projected Acoma Street at the South end of the 4800 block be denied and , in conformity with Article 2, Section 2, Paragraph b, of The Sub- division Regulations, Street Systems, the West 30 feet of the South 150 feet of South Acoma Street extended between West Layton Avenue and West Chenango Avenue And the East 30 feet of the South 150 feet ~f South Bannock Street extended between West Layton Avenue and West Chenango Avenue be dedicated for street purposes; and that any building permits for improvements on the remaining land be issued upon the express condition that deeds to said portions of streets be given by the owner thereof within 30 days from this date and that such building permits provide for location of improvements with reference to the establishment of said streets. Ayes: Braun, Barde, J o nes, Guilford, Rapp Nays: None Absent: Rudd, Romans Barde moved: Braun seconded: That the Planning Commission recommend to Council that deeds for the following described tracts for street purposes be accepted: The West 30 feet of the South 150 feet of South Acoma Street extended between West Layton Avenue and West Chenango Avenue and the East 30 feet of the South 150 feet of South Bannock Street edtended between West Layton Avenue and West Chenango Avenue, said deeds to be prepared by the City Attorney. Ayes: Bar de, Br a un, Jones, Guilford, Rapp Nays: None Absent: Rudd, Romans At this time Mr. Rapp made a brief but interesting report on the convention recently held by The Colorado Municipal League at Glenwood Springs, Colorado and attended by him as Councilman representative from Englewood. After some discussion as to zoning problems within the Scenic View area proposed for annexation, Guilford moved: Rapp seconded: That the Planning Commission recommend to Councilthat, relative to the Scenic View Annexation, the annexation Ordinance specifically establish the zoning of all unplatted areas as M-1 Zone Districts. Ayes: Barde , Braun, Jones, Guilford, Rapp Nays: None Absent: Rudd, Romans Mr. Braun was excused from the meeting at this time . A discussio n was held at this time relative to further development of the Master Street Plan. Rapp moved: Barde seconded: That the Planning Commission recommend to Council that the existing Master Street Plan, Ordinance No. 13, Series of 1951, the sidewalk, curb and gutter Ordinance, be extended to cover all streets within the city limits . M. Members Present: Barde, Braun, Jones, Rudd Members Absent: Guilford, Rapp, Romans S. C. Marguerites 4965 So. Delaware Delaware-Elati Alley -4900 Block South Hearing No. 86 Mr. Marguerites appeared, representing owners of all properties along the West side of the 4900 Block South Delaware Street, further described as the East ! of Plot 1, Harlem, 2nd Addition. Mr. Marguerites stated that these owners desire to offer a 16 foot dedication from the rear of all properties for alley purposes. This alley would be between South Delaware Street and South Elati Street from West Chenango Avenue to West Grand Avenue. The properties involved each have 75 foot frontages on South Delaware and are presently 148 feet in depth. By the dedication of the 16 foot alley, the remaining depth of all sites would be 132 feet which leaves ample lot size to meet the requirements in the zone district which is R-1-B. A petition, signed by owners of all properties involved, indicating their desire to make this dedication, has been filed previously with the City Attorney, Mr. Esch. The sewer line which serves all properties on both the West side of South Delaware and the East side of South Elati presently lies in a utility easement which easement is within the proposed alley. Rudd moved: Barde seconded: That the Planning Commission recommend to Council that, upon proper execution of deeds to the City, by the owners of the East ! of Plot 1, Harlem, 2nd Addition, for the West 16 feet of the E! of Plot 1, Harlem, 2nd Addition, for alley purposes, same be accepted. Ayes: Barde, Braun, Jones, Rudd Nays: None Absent: Guilford, Rapp, Romans Mrs. Romans entered and was seated with the Commission. Anderson & Wright Construction Co. 477 East Cornell Avenue See Below Hearing No. 87 Mr. William Anderson and Mr. W. G. Wright appeared to request Planning Commission considera- tion of rezoning for an area bounded by East Cornell Avenue, the Logan-Pennsylvania alley, East Bates Avenue and the Grant-Logan alley, from present R-1-D Zone District to R-2-A Zone District. The gentlemen showed a petition, signed by 33 owners of properties along the East side of South Grant Street, both sides of South Logan Street and the West side of South Pennsylvania Street, all in the 2900 blocks, indicating no objections to the rezoning proposal. In the discussion, on the matter, it was pointed out to the gentlemen that the rezoning of the area, as proposed, would constitute "spot zoning" and the Commission suggested to them that the petition be re-written and re-circulated in the area, extended to include for re- zoning both sides of the 2900 Block South Grant or to the Sherman-Grant alley, thus making the proposed area for rezoning one which is contiguous to a like zoning district.
