Master Street Plan Expansion
That the existing Master Street Plan, Ordinance No. 13, Series of
1951, the sidewalk, curb and gutter Ordinance, be exterlded to cover
all streets within the city limits.

June 27, 1957
The meeting was called to order by Chairman Jones at 8:00 P. M.
Members Present: Barde, Braun, Jones, Rudd
Members Absent: Guilford, Rapp, Romans

Delaware-Elati Alley -4900 Block South Hearing No. 86
Mr. Marguerites appeared, representing owners of all properties along the West side of the
4900 Block South Delaware Street, further described as the East ! of Plot 1, Harlem, 2nd
Addition. Mr. Marguerites stated that these owners desire to offer a 16 foot dedication
from the rear of all properties for alley purposes. This alley would be between South
Delaware Street and South Elati Street from West Chenango Avenue to West Grand Avenue. The
properties involved each have 75 foot frontages on South Delaware and are presently 148
feet in depth. By the dedication of the 16 foot alley, the remaining depth of all sites
would be 132 feet which leaves ample lot size to meet the requirements in the zone district
which is R-1-B.
A petition, signed by owners of all properties involved, indicating their desire to make
this dedication, has been filed previously with the City Attorney, Mr. Esch.
The sewer line which serves all properties on both the West side of South Delaware and the
East side of South Elati presently lies in a utility easement which easement is within the
proposed alley.
Rudd moved:
Barde seconded: That the Planning Commission recommend to Council that, upon proper
execution of deeds to the City, by the owners of the East ! of Plot
1, Harlem, 2nd Addition, for the West 16 feet of the E! of Plot 1,
Harlem, 2nd Addition, for alley purposes, same be accepted.
Ayes: Barde, Braun, Jones, Rudd
Nays: None
Absent: Guilford, Rapp, Romans
Mrs. Romans entered and was seated with the Commission.

Mr. William Anderson and Mr. W. G. Wright appeared to request Planning Commission considera-
tion of rezoning for an area bounded by East Cornell Avenue, the Logan-Pennsylvania alley,
East Bates Avenue and the Grant-Logan alley, from present R-1-D Zone District to R-2-A Zone
District. The gentlemen showed a petition, signed by 33 owners of properties along the
East side of South Grant Street, both sides of South Logan Street and the West side of
South Pennsylvania Street, all in the 2900 blocks, indicating no objections to the rezoning
proposal.
In the discussion, on the matter, it was pointed out to the gentlemen that the rezoning of
the area, as proposed, would constitute "spot zoning" and the Commission suggested to them
that the petition be re-written and re-circulated in the area, extended to include for re-
zoning both sides of the 2900 Block South Grant or to the Sherman-Grant alley, thus making
the proposed area for rezoning one which is contiguous to a like zoning district.

Mr. Charles Johnson and Mrs. Lorenzo appeared to discuss further the possibility of Planning
Commission consideration of the rezoning of 8 lots located at the North end of the 3700 Block
South Logan Street, West side, which are owned by Mrs. Lorenzo.
Mr. Johnson stated that a Government Agency is currently considering the location of a
Governmental building on the eight lot site and that it was his opinion that an R-3 zone
District was necessary to ·locate such a buikling.
Mr. Johnson was referred to the Zoning Ordinance, R-1-D Residential District, Paragraph 12,
Sub-Paragraph a (12) under Section 5, which permits Public Buildings and Community Centers
as conditional uses provided the public interest is fully protected and the use is approved
by The Zoning Board of Adjustment.
Mr. Johnson was advised to apply to The Zoning Board of Adjustment for this conditional use
at the proper time.

A formal, written, request was received from Marvin L. and Carolyn L. Hersey and H. L. and
Lucy F. Noller, owners, for Planning Commission re-consideration of the rezoning from R-2-B
Zone District to C-2 Zone District of the following described property:
Part of Lot 3, Lots 4, 5 and 6, Block 5, Higgins Englewood Gardens -Owned by Noller
Lots 7, 8 and 9, Block 5, Higgins Englewood Gardens -Owned by Hersey
The request was accompanied by a letter from the Minissale Realty Company, Denver, which
stated that there are prospective buyers of the land provided a rezoning to R-3 Zone District
can be accomplished.
After discussion,
Braun moved:
Romans seconded: That the request for rezoning of Part of Lot 3, Lots 4 to 9, Inclusive,
Block 5, Higgins Englewood Gardens, from R-2-B Zone District to C-2
Zone District, be denied and that the applicants and the Minissale
Realty Company be advised that the conditions along the new Highway
still do not warrant a change of zoning to C-2 Zone District.

City Planning Commission Swimming Pools Hearing No. 88
The following drafts were presented for consideration and recommendation to City Council,
copies of which had previously been furnished all members of The Planning Commission:
A BILL FOR AN ORDINANCE DEFINING SWIMMING POOLS, POOL OPERATOR, NATURAL BATHING PLACE;
REQUIRING ACCORD OF INSPECTION SERVICES AND LICENSES; PROVIDING FOR THE ENFORCEMENT OF
THIS ORDINANCE, INCLUDING THE RIGHT TO MAKE REASONABLE INSPECTIONS AND INVESTIGATIONS;
REGULATING THE SANITARY OPERATION OF SWIMMING POOLS; AND PROVIDING FOR PENALTIES.
AND
PROPOSED SWIMMING POOL RULES AND REGULATIONS.
In the discussion which followed, it was decided that a special session of the Commission
should be called and devoted to the study of these proposals and that representatives of
the City Recreation Department, Tri-County Health Department and The American Red Cross,
should be invited to attend the session to assist in formulating the final drafts for
presentation and recommendation to Council.
Chairman Jones stated that a Special Meeting of the Planning Commission, for the purpose
of making the above mentioned studies, will be held Monday Evening at 8:00 P. M., July
8, 1957. The Secretary of the Commission, Mrs. Romans, was asked to extend invitations
to the proper persons from the abovementioned Departments.
There being no further business to come before the Planning Commission, the meeting was
adjourned at 10:50 F. M.

Mr. William Anderson and Mr. W. G. Wright again appeared before the Commission to further
discuss the possibility for zoning change from R-1-D to R-2-A in an area between East Bates
Avenue and East Cornell Avenue. The gentlemen originally appeared on June 27, 1957, showing
a petition for the rezoning between thPse Avenues and between the Grant-Logan alley and the
Logan-Pennsylvania alley which area is not contiguous to a presently zoned R-2-A Zone District.
A new petition was presented indicating signatures of thirty-five property owners in a larger
area which is bounded by the Sherman-Grant alley (present East line of R-2-A Zone District),
East Bates Avenue, the Logan-Pennsylvania alley and East Cornell Avenue. This area is, of
course, contiguous to the present R-2-A Zone District.
After considerable discussion relative to possible Planning Commission consideration for
entering rezoning procedure,

Guilford seconded: That the petition be received and that action be deferred until after
a comprehensive Housing Code has been adopted.

Mr. R. A. Collier, representing Supreme Coal Company (Harry Folkerts, owner), requested
further confirmation of a tentative approval for fertilizer mixing and processing use on
lands described as 7.6 acres located at and near 3200 South Inca Street extended, beginning
at the Northeast corner of the NEi of the SE! of Section 33, T.S. 4, R 68 W, thence South
along East line of said NEi, 1318.35 feet, thence West at right angles 634.25 feet, more or
less, to Easterly line of the Santa Fe Railway right of way, thence Northeasterly along the
Easterly line of said right of way 624.96 feet, thence East at right angles 420.33 feet,
thence North and parallel to East line of said NE!, 725.03 feet, more or less, to North line
of said NE", thence East along said North line to place of beginning, Arapahoe County,
Colorado.
It appears that this matter was discussed before various City Government bodies and officials
during December, 1954, and January, 1955, and it is claimed by the Supreme Coal Company that
general approval of these lands for such use was obtained.
Since the records concerning this matter are scattered and should be bright together in one
package,

Braun seconded: That the Planning Commission recommend to City Council that they authorize
the preparation of a transcript of all proceedings and all correspondence
within the City Council, Plannin g Commission, Zoning Board of Adjustment
and the City Attorney's off1ce in regard to the request for specific use
of the above described lands.
