That City Council undertake the naming of streets along the West border of the pres e nt City limits which are not now named and consider changing of names of any presently named streets that do not conform to the present Denver street names as extended. M. Members Present: Barde , Braun , Guilford, Jones, Rudd Members Absent: Romans Charles Johnson, Realtor Mrs. Rose Lorenzo, Owner See Below Hearing No. 50-D November ~~, 1956 December 13, 1956 February 14, 1957 June 27, 1957 Mr. Charles Johnson of Charles and Company, 3149 South Broadway, presented a written appli- cation requesting the rezoning of nine (9) lots which extend Southward from the Southwest corner of the intersection of South Logan Street and West Kenyon Avenue (West side of South Logan), from present R-1-D Zone District to C-2 Zone District for the specific use of a service station operation, contending that such would be it's "highest and best use". The following listed facts were considered: 1. In 1955, Englewood's Zoning Ordinance was approved by the City Council under due process by notification to the public and holding of public hearings. 2. Such Ordinance was drawn on the basis of "percentage of square foota g e as related between one zoning area and another". 3. This percentage ratio was the result of a thorough study of land use by experts in the professional field 0f zoning. 4. On approval , this Zoning Ordinance became an integral part of Englevood's Master Plan as provided by Colorado Statute. 5. The people, through their elected Councilmen, did not approve this Zoning Ordinance on the basis of "highest and best use" of small parce1ls of land, commonly known as "spot zoning ". After consideration of the above, Rapp moved: Rudd seconded: That the request be denied on the basis that sufficient C-2 Zone District area is now provided in the City of Englewood as recently attested to by the City's professional plannin g and zonin g consultants. Santa Fe Drive PAGE 211 Hearing No. 93 Mr. Laws, the owner of a tract immediately West of South Santa Fe Drive and immediately South of West Yale Avenue extended, made a proposal for the use of his lands as a trailer court, such lands now being used as a cottage camp, a residential site and a commercial site. This site is located in the area recently annexed to the City. During the discussion, the following four items were brought up as desired and probable: 1. Proper zoning applicable for trailer court use. 2. Setting up the zoning for an eight space trailer court on the West portion of t he land behind a commercial zone along South Santa Fe Drive, 150 feet in depth. 3. Means of collecting a "wheel tax" or it's equivalent. 4. Proper dedication of a 10 foot strip along the South side of present Amherst Lane al o ng with utility easements. Braun moved: Guilford seconded: That the pro p o s al, by Mr. Laws, be received for study of the following points: 1. Proper application of Subdi v ision Regulations. 2. Amendment to Zoning Ordinance relative to trailer courts. 3. Preparation of a zoning map and study of land use. 4. Preparation of a "Wheel Tax" Ordinance or equivalent. 5. Dedications for streets and/or alleys along with utility easements. Ayes: Barde, Braun, Guilford, Jones, Rapp, Rudd Nays: None Absent: Romans Harry Folkerts, Owner Supreme Coal Company 864 South Broadway 3200 South Inca Hearing No. 89-A Ju 1y 11, 1957 Mr. Folkerts appeared to discuss further the use of his land in the Northwest part of the City for an operation in the processing of fertilizer and the possibility of the installation of a dehydrating machine for use in the processing. The following letter, under date of January 12, 1955, from Mr. William Bodan, Jr., City Attorney at that time, to Mr. Robert Sunshine, Attorney for Mr. Harry Folkerts, was read as follows: Mr. Robert Sunshine Attorney at Law 515 Majestic Bldg. Denver, Colorado Dear Mr. Sunshine: William Bodan, Jr. Attorney at Law Englewood, Colorado January 12, 1955 Pursuant to your request regarding the use permitted by the present zoning of the J. F. Nordlander property, which your client has an option to purchase and pursuant to instructions of the City Council of Englewood I hereby render my opinion as to the use permitted, of said tract, under its present "M -1" zoning. The City Council has heretofore been advised, in writing by the Minissale Realty Co., that your client's operation will consist in the storing and processing of peat moss and non- odorous decomposed fertilizer. Present zoning prohibits among other things, fertilizer manufacture. It is my opinion that the proposed use, as outlined in said letter, is permitted under the present "M-1" zoning. The word manufacture has been legally construed to be the mixing of raw materials to produce a new and different product. The proposed use by your client does not constitute the manufacturing of fertilizer, in my opinion, because the components and the end product are the same, there is no new product produced. This opinion is restricted solely to the proposed use as outlined in said letter and is not applicable in the event a different use is made of the property. WB,Jr./ji cc: Minissale Realty Co. After lengthy discussion, Mr. Folkerts, as recorded owner of the lands, made the request that the following described lands be rezoned from present M-1 (Industrial) Zone District to M-2 (Industrial) Zone District: A part of the NE! of the SE! of Section 33, Township 4 South, Range 68 West of the 6th P. M., more particularly described as: Beginning at the point where the South Line of the NE! SEt of Section 33, Township 4 South, Range 68 West of the 6th P. M. intersects the center line of Little Dry Creek as now located, which point is 237.6 feet West of the SE corner of the NE! SE! of said Section 33; thence, Northwesterly and Northerly, along the center line of said Little Dry Creek as now located, a distance of 612 feet, to a point which is 593.32 feet North and 323 feet West of the SE corner of the NE! SE! of said Section 33; thence, West to a point on the Easterly Right-of-Way line of the A.T. & S.F. Railway Company; thence, Southwesterly alon~ the Right-of-Way line of said Railway Company, to a point on the South line of the NE 4 SEt of said Section 33; thence East along the South line of the NE! SE! of said Section 33, to the point of beginning. Rapp moved: Rudd seconded: That the Planning Commission proceed to legally advertise, post premises and hold a public hearing on August 29, 1957, as to the rezoning of the above described lands from present M ~l (Industrial) Zone District to M-2 (Industrial) Zone District, all costs of ad- vertising and posting to be paid by the appli ca n t. Dade 1890 West Evans See Below Hearing No. 94 Mr. Dade appeared to request Planning Commission consideration for rezoning of Lots 21-24, Inc., Block 93, Alta Vista, iocated at the corner of West Evans and South Vallejo Street, from tentative R-1-A Zo n e District, under the Annexation Ordinance, to some type of commerci a l zoning. A discussion developed in which it was pointed out to Mr. Dade that, while the City will prodeed with studies of the entire newly annexed area West of the City, no recommendations f o r zoning Eould possibly be made until after the expiration of the 90 day protest period following t h e recently passed Annexation Ordinance. Rapp moved: Braun seconded: That Mr. Dade's request for commercial zoning of the above described land be received and that the Planning Commission recommend that, in the interim , Mr. Dade contact the Building Inspector relative to the various requirements for bot~ C-1 and C-2 Zone Districts. Ayes: Barde, Braun, Guilfo rd, Jones, Rapp, Rudd Nays: None Absent: Romans John G. McMurtry 2890 South Clarkson 2890 South Clarkson Hearing No. 05 Mr. Beryl Wallace, Building Inspector, asked for a directive in the matter of a probable application for a building permit by Mr. John G. McMurtry, owner of the premises known as 2890 South Clarkson Street. The proposed structure would extend over a part of the Denver City Ditch. After discussion, Rudd moved: Braun seconded: that any action regarding the issuance of a building permit be deferred until there has been proper clearance from the Denver Board of Water Commissioners made available to the Building Inspector and that a copy of this movement be transmitted to the Building Inspector. Ayes: Barde, Braun, Guilford, Jones, Rapp , Rudd Nays: None Absent: Romans Beryl Wallace Building Inspector City Registration -Non-conforming Uses Hearing No. 96 In a letter from Mr. Wallace, Building Inspector, under date of July 29, 1957, it was called to the attention of the Planning Commission, the fact that the grace period for registration of non-conforming uses has expired on or about July 1, 1957. Ayes: Barde, Braun, Guilford, Jones, Rapp, Rudd Nays: None Absent: Romans Ruben Maerz Street Dedications Hearing No. 97 6196 South Broadway From Nortpwest corner of Quincy and Huron Mr. Reuben Maerz, owner, has offered to dedicate, for street purposes, a 30 foot strip extend~ng approximately 205 feet Northward along the West side of South Huron Street and a 30 foot strip extending approximately 150 feet Westward along the North side of West Quincy Avenue, each from the Southeast corner of Section 4. Rud d moved: Guilford seconded: That the Planning Commission recommend to Council that the above offer of street dedications be accepted. That the offer by Mr. Reuben Maerz, owner, of the following described land, for street purposes, be accepted: A 30 foot strip extending approximately 205 feet Northward along the West side of Aouth Huron Street and a 30 foot strip extending approx- imately 150 feet Westward along the North side of West Quincy Avenue, each from the Southeast corner of Section 4.
