H~ Benoit 4500 South Acoma 4505 South Broadway Hearing No. 98 Also See 4 /30/53 In order to secure as much off-street parking as can be permitted under the present Ordinance around his building at the Southwest corner of West Stanford Avenue and South Broadway, Mr . Benoit requested permission to install the curb along the South side of West Stanford Avenue, from South Broadway to the South Broadway-South Acoma alley, on the property line rather than at the normal curb line. Mr. Benoit indicated that at the time he originally appeared before the Planning Commission on April 30, 1953 , he was advised that this variance could be allowed. The following is an excerpt from the Flanning Commission Meeting Minutes of April 30, 1953: "Dave Williams from the R. F. Linstedt architect office, presented a plan for the proposed development of South Broadway Locker Plant, known as Frozen Food Lockers, South of Stanford, 4501 South Broadway. The wish to expand into a shopping center. Mr. Benoit, contractor, wishes to build a store extension of the Frozen Food Locker building and a physician's building facing Stanford and storage space on the alley. With the proposed zoning, which final reading is next Monday, he will be able to build his proposed plan. The question of private, angle parking off Stanford Ave. was discussed. wOne curb cut on Broadway was allowable." Rapp moved: Rudd seconded: That the Planning Commission receive the request and that any action be tabled for further study and review on August 29, 1957. Ayes: Barde , Braun, Jones, Rapp, Romans, Rudd Nays: None Absent: Guilford Planning Commission city Bill for an Ordinance Pr~vate Swimming Pools Hearing No. 99 The draft of a Bill for an Ordinance to provide for the construction and regulation for private swimming pools , which had been prepared by the Planning Commission at previous special sessions, was next considered. Rudd moved: Braun seconded: That the Bill for an Ordinance to provide for the construction and regulation of private swimming pools be recommended to City Council for immediate adoption. Ayes: Barde, Braun, Jones, Rapp, Romans, Rudd Nays: None Absent: Guilford Planning Commission city Bill for an Ordinance Public and Semi-Public Swimming Pools Hearing No. 100 Next considered was the draft of a Bill for an Ordinance accompanied by Rules and Regulations for Public and Semi-public swimming pools, prepared at previous special sessions of the Planning Commission, with the assistance of Marie Kennicott of the American Red Cross, Jack Towle of the Tri-County District Health Department, Paul Rundel, Manager, Englewood Swimming Pool, Ernest P. Romans, City Recreation Director, and Beryl A. Wallce, City Building Inspector. Rudd Moved: Rapp seconded: That the Planning Commission submit the Bill for an Ordinance accompanied by Rules and Regulations for public and semi-public swimming pools to City Council for it's earliest consideration. Ayes: Barde, Braun, Jones, Rapp , Romans , Rudd Nays: None Absent: Guilford City Planning Commission City Planning Commission "Request Form" Hearing No. 101 After some discussion, Rapp moved: Barde seconded: That, pursuant to authority contained in Paragraph 4 , Article 59, Chapter 139 , Colorado Revised Statutes, 1953, entitled "Organization and Rules, Planning Commission , Towns and Cities", the Planning Commission of the City of Englewood, Colorado hereby adopts as a part of it's rules for transaction of business, the submission by each person who requests a personal heaing before the Commission, I I I I I I PAGE 215 a completed "Request form". The "Request Form" shall be handed or forwarded to the Commission's Secretary prior to the applicant's hearing. The "Request Form" shall include the following elements: Hearing No. Hearing Date Applicant's name Owner's name, if different from applicant's Mailing address Premises or area affected with legal description if possible Space for written request Space for supporting facts Space on reverse side of "Request form" for sketch if separate sketch is not available Ayes: Barde, Braun, Jones, Rapp, Romans, Rudd Nays: None Absent: Guilford Planning Commission City City Council Resolution Requirements for Rezoning Hearing No. · 102 (Also see Planning Commission Hearing No. 50-D, 8 /1 /57) The Planning Commission received a copy of the following Resolution, approved and adopted by the City Council of the City of Englewood, Colorado, 'August 5, 1957: RESOLUTION -~. In 1955, Englewood's ·zoning Ordinance was approved by the City Council under due process by notification to the public and holding of public hearings. 2. Such Ordinance was drawn on the basis of "percentages of square footage as related between one zoning area and another". 3. This percentage ratio was the result of a thorough study of land use by experts in the professional field of zoning. 4. On approval, this Zonipg Ordinance became an integral part of Englewood's Master Plan as provided by Colorado Statutes. 5.The people, through their elected councilmen, did approve this zoning Ordinance for, among several purposes, "the most appropriate use of land through out the city", and for said purposes to divide the city into zones of such number, shape, and area as may be deemed best suited to carry out these zoning regulations. It is noted that the term "highest and best use" of small parcels of land is becoming more and more prominent as a basic reason appearing in re-zoning applications. Zoning for the "highest and best use of a small parcel of land" is considered to be "spot zoning". In no sense does the 1955 Zoning Ordinance provide for "spot zoning". "Spot zoning" is known to be the "cardinal" sin in zoning, and as such is the prime factor in the reduction of land values and the neutralizing of zoning in general of any city. Council hereby endorses the following enumerated elements now considered as reasonable requirements for each re- zoning application by Englewood's Planning Commission: 1. Area: must consist of at least one city block and be contiguous to like zoning classification. 2. Proof must be presented that there is a demand for and need of enlarging the existing zoning areas. 3. There must -be compliance with all the other usual elements which the ordinance provides for as a part of everyre-zoning study and action. There being no further business to come before the Englewood Planning Commission, the meeting was adjourned at 10:15 P. M. Approved: Dorothy Romans Secretary By: John D. M. Members Present: Barde, Braun, Jones, Rapp Members Absent: Guilford, Romans , Rudd Harry Folkerts, Owner Supreme Coal Company 864 South Broadway 3200 South Inca Hearing No. 89-B July 11, 1957 August 1, 195~ The property having been properly posted and public notice given, a hearing was held re- garding the rezoning of an area located between West Eastman Avenue extended, West Floyd Avenue extended, the present center line of Little Dry Creek and the Easterly Ri ght-of- way of the A.T. & S. F. Railway Company, frompresent M-1 Zone District (Industrial) to M-2 Zone District (Industrial). (See Planning Commission Minutes August 1, 1957, Hearing No. 89-A, for full legal description.). The reason for the rezoning request was to provide for an expansion of an existing operation of storing and processing of peat moss and non-odorous "decomposed" fertilizer, deemed legal under the 1940 Zoning Ordinanc e, by the installation of a dehydrating machine for use in the processing. The existing operation is non-conforming under the present 1955 Zoning Ordinance and the expansion of said operation would require the change of zoning to the lower M-2 classification. Mr. Richard Graham, Attorney, 3485 South Broadway, representing various property owners surrounding the tract was first to be heard. Mr. Graham presented the following petition and stated that the Two Hundred and Ninety-nine signatures thereon represented property owners and residents, a majority of which live within four blocks of the area being considered for rezoning, along with other petitioners who use recreational facilities in the vicinity; "The undersigned respectfully petition the Planning Commission of the City of Englewood, Colorado, to reject the request of Mr. Folkerts, Case Number 181-A under date of July 10, 1957, (Zoning Board Case No.) for the rezoning for the purpose of the location on the following described property, of a fertilizer processing plant, to-wit: (Legal Description Inserted Here.)
