M. Members Present: Barde, Braun, Jones, Rapp Members Absent: Guilford, Romans , Rudd Harry Folkerts, Owner Supreme Coal Company 864 South Broadway 3200 South Inca Hearing No. 89-B July 11, 1957 August 1, 195~ The property having been properly posted and public notice given, a hearing was held re- garding the rezoning of an area located between West Eastman Avenue extended, West Floyd Avenue extended, the present center line of Little Dry Creek and the Easterly Ri ght-of- way of the A.T. & S. F. Railway Company, frompresent M-1 Zone District (Industrial) to M-2 Zone District (Industrial). (See Planning Commission Minutes August 1, 1957, Hearing No. 89-A, for full legal description.). The reason for the rezoning request was to provide for an expansion of an existing operation of storing and processing of peat moss and non-odorous "decomposed" fertilizer, deemed legal under the 1940 Zoning Ordinanc e, by the installation of a dehydrating machine for use in the processing. The existing operation is non-conforming under the present 1955 Zoning Ordinance and the expansion of said operation would require the change of zoning to the lower M-2 classification. Mr. Richard Graham, Attorney, 3485 South Broadway, representing various property owners surrounding the tract was first to be heard. Mr. Graham presented the following petition and stated that the Two Hundred and Ninety-nine signatures thereon represented property owners and residents, a majority of which live within four blocks of the area being considered for rezoning, along with other petitioners who use recreational facilities in the vicinity; "The undersigned respectfully petition the Planning Commission of the City of Englewood, Colorado, to reject the request of Mr. Folkerts, Case Number 181-A under date of July 10, 1957, (Zoning Board Case No.) for the rezoning for the purpose of the location on the following described property, of a fertilizer processing plant, to-wit: (Legal Description Inserted Here.) I I I I I I PAGE 217 As grounds therefor, your petitioners would respectfully show the Board that the operation of a fertilizer processing plant within the City of Englewood, Colorado, would constitute a public nuisance, would be a menace to health, would be productive of unpleasant odors, and would result in detracting from the value of the property within the vicinity. Your petitioners would further respectfully show the Board that t he proposed site is located within an area surrounded by residence properties, contemplated residence properties , restaurants , motels, drug stores, and other like businesses, the value of which would be greatly reduced and impaired in the event of the location within the vicinity of a business of this type contemplated, to-wit: a fertilizer processing plant." Your petitioners hereby adopt as a part of this petition all other l ike petitions which may be filed herewith. Mr. Graham spoke further on the various "nlisance" factors brought out in the petition which he contended would develop from the operation of a fertilizer plant in this location. The main points covered were dust, noise and odor along with the devaluation of surrounding properties and the health hazard. Mr. Graham asked that the following letter from the Tri-County District Health Department be read: TRI-COUNTY DISTRICT HEALTH DEPARTMENT Arapahoe County Office Englewood Planning Commission Englewood City Hall 3345 South Bannock Englewood, Colorado Gentlemen: 4857 South Broadway Englewood, Colorado August 28, 1957 This department has received a number of requests to investigate the operation of the Supreme Fertilizer and Peet Moss Company at approximately 3200 South Inca, En g lewood Our investigations revealed that the Supreme Company is processing a soil conditioning product using only top soil and peet. The operation was not creating any odor or nuisance at the time of our investigations and there was no evidence of rodent or insect infestion on the premises . It is my opinion that the operation is being conducted in a satisfactory manner to control any nuisance or hazard which may be created by such an operation and it is also my opinion that the area is properly and adequately zoned to protect the immediate and agjacent properties within the area. However, this department would like to go on record as opposing a ~oning change to a less stringent zone within that area, as such a change would be most undesirable and would present a potential public health hazard and nuisance to the area. Yours truly, TRI-COUNTY DISTRICT HEALTH DEPT. /S I Sherman Warburton Assistant Director, Division of Sanitation Mr. Warburton, who was in attendance, was questioned as to his opinion of the health hazard involved if "decomposed" fertilizer was used rather than top-soil. Mr . Warburton stated that he was not aware that "decomposed" fertilizer was being contemplated in the processing but that it was his opinion that the use of "decomposed" fertilizer, de- composed to any degree short of H2 0, would create a health hazard from rodent and insect infestation in outside storage and would definitely create some type of odor. Mr. Folkerts stated that it was his beli e f that no odor would be forthcoming from the operation and that everything humanly possible would be done to eliminate noise from the operation in the event the rezoning was allowed. Ayes: Barde, Braun, Jones, Rapp Nays: None Absent: Guilford, Romans, Rudd Af ter a brief recess, the matter was discussed further by the Commission and, Braun moved: Barde seconded: That the request for rezoning of the above described Harry Folkerts land be denied because of the proximity of the site to a residential district , a business development across the. railroad tracks and the City Park; and further, that a rezoning would permit any use set up in the present Zoning Ordinance and not necessarily a specific use only. Ayes: Barde, Braun, Jones, Rapp Nays: None Absent: Guilford, Romans, Rudd Mr. Rudd entered and was seated with the Commission. W. J. Plank See Below 945 South Downing Hearing No. 103 Mr . Plank appeared to make application for rezonin g of an area located between West Kenyon Avenue, West Mansfield Avenue, the Huron-Inca alley alon g with South Huron Street and the East line of the present M-1 Zone District from R-1-D Zone District to R-2-B Zone District. Mr. Plank stated that , because of the location of this land, near the M-1 Zone District and the Maddox School, building loan values have been greatly reduced and that it was his feel- ing that unless two family homes could be build in the area , a great deal of time will elapse beiore the land would be used and probably never as single family residential use. It was pointed out to Mr. P lank that the present zoning is a result of several years of study by the Planning Commission with the assistance of professional planning consultants using maps of actual existing land use and that it has been determined that presently there is ample R-2 type zoning in existance within the City. Benoit 4500 South Acoma 4505 South Broadway Hearing No. 98~A August 15, 1957 Mr. Benoit appeared to review with the Commission it's findings since the meeting of August 15 , 1957 , relative to variance which might have been granted by previous Planning Commission consideration , allowing the curb along the South side of West Stanford Avenue from South Broadway to the South Broadway-South Acoma alley to be constructed on th~ property line rather than on the normal curb line. Mr. Benoit indicated that it was his belief that this variance had been granted in 1953 in order for him to have off-street parking between the curb and his building at 4505 South Broadway, which building, he claims, was set back from West Stanford Avenue , more than necessary because of this alleged variance. The minutes of the meeting of the Planning Commission ofApril 30, 1953, which minutes were the only one dealing with the matter . Those minutes "The question of private angle parking off Stanford Ave. was discussed. Broadway was allowable." Rapp moved: were produced, read, in part: One curb cut on Braun seconded: That, since no variance can be found in the previous Planning Commission records, the Master Street Plan regulations of the City be followed. Ayes: Barde, Braun, Jones, Rapp, Rudd Nays: None Absent: Guilford, Romans Henry and Elvin Stander 5011 South Broadway See Below Hearing No. 104 The above named gentlemen appeared to request rezoning of the North One-half of Block 7, Harlem Addition, now vacated, from R-1-A Zone District to R-1-B Zone District. This tract is included in the newly annexed area near South Broadway and Belleview Avenue and is the North One-half of the block which is bounded by South Acoma Street extended, South Bannock Street extended, West Grand Avenue extended and West Belleview Avenue. I I I I I I PAGE 219 After some discussion, Rapp moved: Braun seconded: That the request for rezoning of the above located tract from R-1-A to R-l =B Zone District be received and that the Planning Commission recommends that a plat be submitted in accordance with the provisions of Englewood's existing Sub-Division Regulations and that the applicants be notified that a hearing relative to said plat will be held at the next regular meeting of the Planning Commission on September 12, 1957. Ayes: Barde, Braun, Jones, Rapp, Rudd Nays: None Absent: Guilford, Romans After discussion, Rudd moved: Braun seconded: That the Planning Commission, upon its own motion, recommend to Council, that relative to the newly annexed area near South Broadway and Belleview Avenue, all of the land East of South Acoma-South Broadway alley extended be rezoned to C-2 Zone District, and the remaining portion of t he area be rezoned to R-1-B Zone District. Ayes: Barde, Braunk Jones, Rapp, Rudd Nays: None Absent: Guilford J. A. Barton 4400 South Huron 4332 South Broadway Hearing No. 105 Mr. Barton appeared to inquire what procedure he could use to provide for off-street parking behind his business establishment at 4332 South Broadway or between the South Broadway- Lincoln alley and South Lincoln. Mr. Barton was advised that a P. Zone District (Off-street parkin g Zone) can be established through regular rezoning procedure, for an area which abuts a business or industrial district and is surrounded on at least two sides by residential areas; also, the land, if in P Zone, is not eligible for any other use. A letter from Mr. Fred Janssen, I.C.R.P.C. representative, was received relative to the recent street re-naming legislation in the City of Englewood. Chairman Jones stated that further consideration of this matter would be given at the next meeting of the Planning Commission. SE! of Section 33, Town- sh·p 4 South , Range 68 West of the 6th P. M. intersects the center line of Little Dry Creek as now located, which point is 237.6 feet West of the SE corner of the NE! SE! of said Section 33; thence Northwesterly and Northerly , along the center line of s a id Little Dry Creek as now located, a distance of 612 feet , to a po int which is 593.32 feet North and 323 feet West of the SE corner of the NE! Members Present: Barde, Braun, Jones, Rapp, Romans, Rudd Me mbers Absent: Guilford Others Present: J. M. Lacy, Planning and Traffic Regulations Director P. G. Lull 3870 South Fox See Below Hearing No. 103-A August 29, 1957 Mr. Lull appeared to discuss with the Commission the possibility of rezoning of the area near the 3700 Block South Inca Street, from the present R-1-D Zone District to an R-2 Type Zone District to allow construction of two family residences. Mr. Eull's specific site is known as Lots 13-14-15-16, Block 5, Logandale, which site has 100 feet frontage and 125 feet depth. Mr . Lull was advised that a similar request had been received on August 29, 1957 (See Hearing No. 103) for Planning Commission consideration for rezoning of a larger area which would include his ownership. Braun moved: Romans seconded: That the request by Mr. Lull be received and made a part of the original request for further study. Ayes: Barde, Braun, Jones, Rapp , Romans, Rudd Nays: None Absent: Guilford Henry and Elvin Stander 5001 South Broadway Stander Sub-division Hearing No. 104-A August 29, 1957 Mr. Henry Stander, Mr. Elvin Stander along with Mr. Costin, Engineer, appeared and presented a plat whi c h is a re-platting of the North One-half of Block 7, Harlem Addition, now vacated. The plat indicated eight building sites with 75 foot frontages and 133 foot depths, four sites fronting on South Acoma Street extended and four sites fronting on South Bannock Street extended. Thirty foot dedications were shown for all streets and Avenues involved and eight foot utility easements were shown along the rear lot lines of all sites. At the meeting on August 29, 1957 (Hearing No. 104), the Standers were advised to prepare this plat and present it at this session in accordance with the provisions of Engleood's existing Sub-division Regulations. It was discovered, in the discussion, that numerous phases of the Sub-division Regulations had been overlooked and as a result, the Planning Commission was not in position to make any definite decisions in connection with the plat.
