After discussion, Rapp moved: Braun seconded: That, since some of the provisions of the proposed Public and Semi- Public Swimming Pool Ordinance are considered to be difficult to enforce without a City Sanitation Officer and s~nce there are other phases of public health investigations needing like attention, it is recommended that Council, within the foreseeable future, consider the creation of such a function, for the City of Englev.ood, according to State Statutes. Ayes: Barde, Braun, Jones, Rapp, Romans, Rudd Nays: None Absent: Guilford Planning Commission City Amendment Zoning Ordinance Hearing No. 108 A discussion was held, by the Commission, relative to amending the Zoning Ordinance to pro- hibit the processing and manufacturing of fertilizer in which animal wastes are used. Mr. Lacy was asked to prepare a draft for an amendment for Planning Commission consideration. There being no further business to come before the Englewood Planning Commission, the meeting was adjourned at 10:25 P. M. Approved: John D. M. Members Present: Barde, Braun, Guilford, Jones, Romans, Rudd Members Absent: Rapp Other Officials Present: J. M. PAGE a23 Hearing No. 106-A September 12, 1957 The property having been properly posted and public notice given, a hearing was held re- garding the re-zoning of the newly annexed area near South Broadway and Belleview Avenue. All of the land East of South Acoma-Broadway alley extended had been proposed for C-2 (Commercial) Zone District with the remaining portion proposed for R-1-B Zone District. Mr. M. 0. Shivers, owner of a tract of land just south of West Chenango Avenue , fronting on South Broadway and extending through to South Acoma Street was first to be heard. Mr. Shivers stated that he fel t the zoning should continue through the 4900 block from South Broadway to South Acoma Street rather than have a zoning break at the North-South line in the middle of the block. He pointed out that a number of the ownerships in the block, like his, extend through from South Br oadway to South Acoma Street and that in some cases there are existing permanent buildings over the projected alley or proposed zone line. Mr. E. P. Ruckman, owner of a 50 feet by 125 feet site at the corner of South Acoma Street and West Belleview Avenue, known as 75 West Belleview Avenue, stated that he would prefer that Planning Commission give consideration to rezoning to the west half of the 5000 block D~T ween South Broadwa~ and South Acoma Street as a commercial district : There being no other citizens to be heard, Braun moved: Romans, seconded: That the hearing be closed. Ayes: Barde, Braun, Guilford, Jones, Romans, Rudd Nays: None Absent: Rapp Discussion later in the meeting indicated that approximately the west one-half of the 4900 block might well be zoned for accessory parking only, while the remaining area in the pro- posed re-zoning should probably remain as originally proposed. Braun moved: Romans seconded: That this re-zoning matter be tabled for further study with report to be submitted, by the Planning Office, in time for Commission action on October 17, 1957. Heltman -3897 South Inca See Below Hearing No. 103-B August 29, 1957 Sept . 12 , 1957 Messrs. Lull and Heltman appeared to determine whether the Planning Commission had taken action on Hearing No. 103-103-A, under original date of August 29 , 1957, relative to re- zoning consideration for an area near the 3700 block South Inca Street from present R-1-D Zone District to an R-2 type Zone District . It was determined that all of the members of the Commission had not yet been able to view the area personally. Romans moved: Braun, seconded: To extend the study time on this re-zoning consideration to October 17, 1957, to allow all members of the Commission an opportunity to view the area. Ayes: Barde, Braun, Guilford, Jones, Romans, Rudd Nays: None Absent: Rapp Mr. Rudd suggested, at this time, that when a specific future meeting date has been set for taking action on a proposal in which it is necessary to inspect a certain location, the members of the Plannin g Commission make a coordinated effort to view the location prior to the deadline meeting date or cause photographs to be made for study at the dead- line meeting. Paul Franzman Dedication Offer East side of South Huron Street from West Don Franzman Eastman Avenue to West Floyd Avenue. Hearing No. 109 3290 South Huron The above named gentlemen appeared to ask forinformation as to the likelihood of City acceptance of a 30 foot dedication on the East side of South Huron Street from West Eastman Avenue to West Floyd Avenue for street purposes . It was mentioned that a well, now being used, is located near the intersection of West Floyd Avenue and South Huron Street extended add would be in the eastern portion of the proposed dedication. It would be necessary to continue to use this well until City water is available. Ensuing d~scussion revealed that the Franzmans desire to sub-divide abutting property to the east of the proposed dedication. PAGE 2.24 (A similar proposal for dedication and sub-division has been .mentioned by owner of property adjacent , on the west to the above described land, owned by Mr. Harry Folkerts , 887 South Broadway.) Braun moved: Romans seconded: That the Franzman proposal be received and the gentlemen be advised to proceed with a preliminary plan of the area according to City Sub- division Regulations after contacting CityPlanning and Engineering offices . Ayes: Barde, Braun, Guilford , Jones, Romans , Rudd Nays: None Absent: Rapp Fred Haverkate Re-zoning 3150 South PlatteRiver Drive Hearing No. 93-B August 1, 1957 Mr. Haverkate presented an application requesting Planning Commission consideration for proper zoning to allow trailer court operations in an area east of Platte River Drive and South of We s t Dartmouth Avenue. The applicant now operated a trailer court at this location and wishes t o expand. (The land in quest ion lies in the tentatively annexed "Scenic View" area and will be surveyed as soon as practical.) Braun moved: Romans seconded: That the application for re-zoning request by Mr. Haverkate be received and a study made along with that of Mr. James F. Laws of 2727 South Santa Fe Drive, received August 1, 1957, under Hearing No. 93. Ayes: Barde, Braun , Guilford, Jones, Romans, Rudd Nays: None Absent: Rapp Henry and Elvin Stander Y 5001 South Broadway Stander Sub-division Hearing No. 104-B Au g ust 29 , 1957 Sept. 12, 1957 Mr. He nry Stander a n d Mr. Elvin Stander, accompanied by Mr. Costin, Consulting Engineer, appeared relative to the proposed replattin g of the north one half of Block 7, Harlem Addition, now vacated, said replatting to be known as Stander Sub-division and is the north one half of the 5000 block between South Acoma Street and South Bannock Street ex- tended. The modified preliminary plan, as submitted, was rechecked by the Commission for final plan approval. It was determined that the final plan adhered to all necessary requirements of the Englewood Sub-division Regulations. A check for $56.00 for required fees , was deposited with Mr. Lacy . Braun moved: Romans seconded: That the Planning Commission recommend to City Council that th P plat of Stander Sub-division be approved as presented. Ayes: Barde, Braun, Guilford , Jones, Romans, Rudd Nays: None Absent: Rapp Mrs. Romans was excused from the meeting at this time. Planning Commission City Planning Office Swimming Pool Inspection Hearing No. 100-B-1 Planning Office contact with theTri-County District Health Department revealed that the Tri- County Inspectors are in a position to inspect private swimming pools at the request of the City only; however, semi-public and semi-private pools can be inspected on a regular and continuing basis. (The source of information -Jack Towle, Tri-County District Health Depart- ment, September 23 , 1957.) Planning Commission City Planning Office Land Use Survey "Scenic View" Hearing No. 110 The Planning Office reported that preparations are underway to conduct a land use survey of the "Scenic View" area as soon as maps are available. Mr . Rapp arrived and was seated with the Commission. I I I I I I PAGE 2.25 Planning Commission City Planning Office Street Re-naming Hearing No. 92-A July 11, 1957 The Planning Commission reviewed proposed changes and additions to the new street renaming Ordinance along with letters and petitions to City Council concerning amendment. Braun moved: Rapp seconded: In view of the number of signatures of property owners protesting the proposed name changes involving Bates Parkway from East Bates Avenue around to South Franklin Street, proposed to be changed to East Bates Drive, and Bates Parkway from South Ogden Street to South Downing Street, proposed to be changed to East Amherst Place, it is recommended that they be allowed to remain as presently named. ~yes: Barde, Braun, Rapp Nays: Jones, Rudd Absent: Guilford, Romans (Mr. Guilford was excused prior to completion of the above discussion.)
