Members Present: Barde, Guilford, Jones, Rapp, Romans Members Absent: Braun, Rudd Other Officials Present: J. M. Lacy, Planning and Traffic Director Planning Commission City Planning Office Re-zoning Near South Broadway and West Belleview Hearing No. 106-B September 12, 1957 October 3, 1957 The Planning Commission continued the discussion relative to the rezoning of the subject area. Mr. and Mrs. E. P. Ruckman of 75 West Belleview Avenue attended the meeting to determine what action would be taken on the matter. The Ruckman property is described as Lots 23 and 24, Block 8, Harlem 2nd Addition and the structure thereon is a two family residence. The Ruckmans indicated that it was their understanding that the residence could no longer be used as a two family residence if the rezoning was for anything other than an R-2 type Zone District, and if this were true, they indicated they would prefer commercial zoning for their property. It was explained to the Ruckmans that, if the property has been a two family use within the past twelve calendar months, the use may be continued by proper registration as non-conform- ing use. Photographic slides were shown of existing land use along South Acoma Street from Belleview Avenue to Chenango Avenue. After aonsiderable discussion on various phases, Barde moved: Rapp seconded: That the recommendation to City Council under date of August 29, 1957, relative to rezoning of the newly annexed area near South Broadway and Belleview Avenue, be withdrawn, and pursuant to City Council instructions on September 3, 1957, and subsequent to a public hearing and restudy, including photographic slides, the following recommendations for rezoning be made: All of Van Meter's Addition except the west 100 feet and the east one half of Block 8, Harlem 2nd Addition be rezoned to C-2 Zone District. The west 100 feet of Van Meter's Addition and the west one half of Block 8, Harlem 2nd Addition be rezoned to P (Parking) Zone District. All of the Block formerly known as Block 7, Harlem 2nd Addition be rezoned to R-1-B Zone District. Ayes: Barde, Guilford, Jones, Rapp, Romans Nays: None Absent: Braun, Rudd Paul Franzman 3290 South Huron Tentative Sub-division Area along East side of South Huron Street from West Eastman Avenue to West Floyd Avenue. Hearing No. 109-A October 3, 1957 Mr. Paul Franzman, along with Mr. Costin, consulting Engineer, appeared to discuss a tenta- tive sub-division of the above property. The Planning Commission agreed that an easement instrument allowing temporary access to pro- posed Huron Street from extension of West Eastman Avenue would be sufficient to authorize the opening of Huron Street. Mr. Franzman and Mr. Costin indicated that property on the West side of proposed Huron Street, owned by Mr. Harry Folkerts, would probably be included in the sub-division. Photographic slides of the area were viewed. No formal action was required at this time. Mr. Braun entered and was seated with members of the Commiffiion. W. J. Plank -945 Down:hg Street P. G. Plank appeared to determine whether the Planning Commission had taken action relative to rezoning subject area from R-1-D Zone District to R-2 Zone District. I I I I I I PAGE 229 After viewing photographic slides of the area and discussion was held relative to possible benefits of rezoning to M-1 Zone District and P (Parking) Zone District, Mr. Plank was asked to discuss the following tentative proposal with other interested property owners:' 1. Rezone the east one half of Blocks 6 and 13, Logandale to M-1 Zone District. 2. Rezone the West one half of Blocks 5 and 14, Logandale to P (Parking Zone District. No further action was required at this time. 0. K. Insley 355 West Belleview Rezoning Area between the Delaware-Elati alley extended and the Cherokee-Delaware alley extended from the center line of West Grand Avenue extended to the center line of West Belleview Avenue. Hearing No. 111 Mr. 0. K. Insley appeared to determine the possibility of rezoning subject area from R-1-B Zone District to an R-2 Zone District. The ensuing discussion revealed that such zoning would clearly constitute "spot zoning" and this along with other reasons would probably lead to unfavorable consideration of the proposal. The possibility of sub-dividing the subject area into building sites under the present zoning was then discussed. Mr. Insley was advised to continue to work with the City Planning Office as well as other parties interested in preparing a sub-division plan of the area if he so desires. No formal action was required at this time. Mr. Braun was excused from the meeting at this time. Box 178 Englewood, Colorado Attention: Mr . Joe Lacy Gentlemen: We are owners of Lots 46, 47-48-49, Block 1, Taylors Addition, also known as 3001 South Galapago. We also own the property located ad- jacent to and directly west of this property, known as 3002 South Huron. We are planning at some future time the construction of a modern, two story office building with parking lot, on the Galapago Street property. It is respectfully requested than an application for a change in the zoning of this property be considered in order to permit the planned construction. Ayes: Barde, Guilford, Jones, Rapp, Romans Nays: None Absent: Braun, Rudd Planning Commission City Planning Office Amendment to Zoning Ordinance Hearing No. 108-A Re: Fertilizers from animal by-products September 12, 1957 Mr. Lacy, as formerly directed, presented the following proposed amendment to the Zoning Ordinance which would prohibit the manufacture and processing of fertilizers in which animal wastes are used: PAGE 230 Amend the Zoning Ordinance, Ordinance No . 45, Ser~es of 1955 by adding to paragraph a, Section 12, the following words, to wit: "except animal by-products, basic manufacture and processing or of any organic type fertilizer." Ayes: Barde, Guilford, Jones, Ra pp, Romans Nays: None Absent: Braun, Rudd Joe Clapp Re-zoning Hearing No. 113 975 South Vine Street 2700 South Platte River Drive Mr. Lacy reported that on the basis of a letter directed to the Zoning Board of Adjustment and referred to his office, action has been authorized to allow construction of a proposed concrete prefab plant as requested in said letter copy of which is reproduced below: Zoning Board of Adjustment City of Englewood Englewood, Colorado Gentlemen: October 8, 1957 I am committed to lease and, at their option, to se l l to Flexite, Inc., a ten acre parcel of land as shown on the attached map. The address of said land, according to advise from the Building Inspector , City of Englewood, is 2700 South Platte River Drive. Since my lease-sell agreement can only be executed subject to proper zoning of the above mentioned land it is respectfully requested that the Board of Adjustment zone the land for "heavy industry". I will attend the meeting of the Board Wednesday, October 9, 8:00 P. M., at City Hall to answer any questions of the Board, Representatives of Flexite have advised me that they will also be in attendance. Anything you can do to hasten the granting of this request will be very much appreciated. Lacy October 14 , 1957 ISSUANCE OF BUILDING PERMIT FOR CONCRETE PREFAB PLANT Lee Jones, Chairman of the Englewood Planning Commission contacted me Thursday, Oc tober 10, 1957 , and stated that he had contacted members of the Planning Commission regarding authority to build a concrete prefab plant near the Englewood Sewer plant on the former Clapp property. Jones stated that it was the majority opinion of the Planning Com- mission members that such a permit should be issued if applied for even though the building site is now zoned M-1 and there is some question as to whether the proposed plant would fully qualify for M-1 zoning. However the area is to be studied for rezoning shortly and all indications are that it will be rezoned M-2. On these surmises, you are authorized to issue a building permit for such a plant as it is applied for. /S / Joe M. Lacy Planning Director Analysis of Regional Park Reservation Plan, ICRPC Hearing No. 114 Mr. Lacy presented a tentative analysis of the Regional Park Reservation Plan by ICRPC for discussion and additional comments. Subject: "ANALYSIS OF REGIONAL PARK RESERVATI ON PLAN, ICRPC" I. The preliminary plan for regional parks specified three types of parks to be considered: 1. Regional Reservations which are tracts 1,000 to 5,000 acres in area, within one hour's drive of homes to be served. Includes recreational possibilities but should be left in natural condition in every way possible. 2. Regional Parks which are tracts 500 to 1 ,000 acres in area, within one half hour's drive of homes to be served. More fully developed for recreation including ball playing areas , picnicking and perhaps swimming in natural body of water. Generally retaining natural features insofar as possible. 3. Parkways which are low speed drives through scenic country, usually linking regional parks with each other and the urban areas. They follow scenic routes such as stream bed or ridge, commercial vehicles normally excluded. It should be noted that the plan considers only these area type parks an d not local urban parks or recreational facilities. II. Five recommendations were made by the ICRPC. They are: 1. Establishment of new Regional Parks and Reservations, 2 . Further development and extension of regions parkway system, 3. Establishment of local park areas along stream channels to provide recreational facilities and to protect urban development from flood conditions, 4. Establishment of a public regional agency to develop a regional recreation system, 5. Cities and towns and unincorporate d communities of the region continue to establish and develop local recreation facilities. Comments of each of these recommendations will be found under the form questions in the following section or as additionalcomments, if applicable. III. The City o f Englewood is asked to evaluate the preliminary report under each of four question-headings suggest e d by the ICRPC. These questions and comments of the Planning Director on each are as follows: 1 . (Q) Do you agree with the statement of park needs? (A) Yes, and the reasons are self-evident. 2. (Q) Are the standards for park land needs, as defined in t his report, reasonable? (A) Up to a point. The recommendation of 10 acres for each 1,000 people (Page 11) in urban areas seems well in order for local µi.rks , but the criteria for regional reservations of 15 acres for each 1,000 persons seems a bit high for this area inasmuch as so many acres of national forest are near the entire area. It is suggested that this ratio be lowered pending further investigation as to the possibility of developing mo r e of the national park areas in cooperation with the National Park authoritie s , wlth such development financed locally, if pot possible through the Park Service. 3. (Q) Do the proposed park locations meet the needs of your area and the region . as a whole? (A) The overall plan seems quite good, and plots the desired areas well for use by region residents. Four of the proposed areas are located within 10 miles of Englewood with two others, the Two Forks Reservoir area and Roxborou g h Park further south but easily accessible. About three-fourths of the pro- posed parkways would be easily accessible to Englewoodites. The answer to this question should be a full agreement. 4. (Q) Additional Comments? (A) (1) No comment on recommendations 1 and 2 is necessary since we agree that parks are desirable for tneruture of the region. (2) Recommendation 3 fits completely with what is felt to be the only reasonable answer to Englewood's drainage problems. This recommendation should be heartily endorsed in the hope that all regional governments will take steps to implement it both for park and drainage purposes to control drainageproblems of the present and future. (3) Recommendation 4 is the only one which we should seriously question. As proposed, a regional Park authority , with the power of taxation , would take over the development of the reservations and their opera- tion. This should be left to the local governments involved, even to the financing by whatever means deemed most feasible by each of the governments. However, this alternate plan presumes that the local government would develop the suggested areas along lines recommended in the park plan. Reides el 201 West Belleview Avenue Mr. and Mrs. E. E. Andrews 245 West Belleview Avenue Rezoning North side West Belleview Avenue, East of So. Bannock Street Extended. Hearing No. 115 The above named owners appeared to request Planning Commission consideration for rezoning of two building sites on the north side of West Belleview Avenue, located just west of South Bannock Street extended with 366 feet total frontage on West Belleview Avenue and approximately 135 feet depth, from present R-1-B Zone District to R-3 Zone District. After considerable discussion, Romans moved: Rudd seconded: That the request for rezoning be received and tabled until further study can be made with the applicants to be notified when the Commission is in a position to make a decision. Ayes: Barde, Jones, Romans , Rudd Nays: None Absent: Braun, Guilford , Rapp Sub-division Paul Franzman 3290 South Huron Harry Folkerts Area along both sides of South Huron Street from West Eastman Avenue to West Floyd Avenue 1132 South Pennsylvania Hearing No. 109-B Mr. Paul Franzman, along with Mr. Costin, Consulting Engineer, appeared and presented the Preliminar y Plan and vicinity sketch of the Franzman-Folkerts Sub-division , Mr . Folkerts having decided to join the plat with property located along the west side of proposed South Huron Street between West Eastman Avenue and West Floyd Avenue. (See Hearing No. 109-A, Octob er 17, 1957.) Five items were noted by Planning Commission as needing clarification before the final plat can be accepted: 1. Securing of right =of ~way 3 0' x 30' at the intersection of West Floyd Avenue and South Huron Street extended from Mr. W. G. Fields, owner, 82& West Hampden Avenue. 2. Evidence of arrangements for water and sewer service to the proposed building sites . 3. Legal instrument to allow access across proposed lots 8 and 9 between South Huron Street extended and West Eastman Avenue. 4. Provision for proper utility easements at rear of building sites. 5. Physically setting monuments and marking same on p a at. After the discussion, Rudd moved: Barde seconded: That the preliminary plan and vicinity sketch be approved subject to full compliance with the Sub-division requirements.
