M. Members Present: Hill, Jones, Kelley, Lacy Members Absent: Braun, Romans, Rudd Planning Commission City Rezoning Three Areas in Sceni c View To be Rezoned From P Zone, M-2 Zone and C-2 Zone to M-1, R-1-D and M-2. Hearing No. 4-58-E January 16, 1958 January 30, 1958 February 27, 1958 March 20, 1958 April 10, 1958 I The property having been properly posted and public notice given , a hearing was held regarding rezoning as shown in the following five land descriptions: Lots 21 through 2 8, inclusive of Block 77, Sheridan Heights Subdivision to be rezoned from "P" Zone to R-1-D. Lots 1 through 20, and Lots 29 through 48 of Block 77, Sheridan Hei ghts Subdivision to be rezoned from M-2 to R-1-D. A strip of land 130 feet east of and parallel to the center line of S. Tejon Street from the center line of the alley between W. Evans Avenue and W. Adriatic Ave nue, to the center line of W. Baltic Avenue to be rezoned from "P" Zone to M-2. A strip of land 130 feet east of and parallel to the center line of S. Tejon Street from the center line of W. Iliff Avenue to a line 786.1 feet south of and parallel to the center line of W. Harvard Avenue to be rezoned from "P" Zone to M-2. A parcel of land east of the north, north-east --south, south-west irrigation ditch, and west of a line 150 feet west of and parallel to the west line of S. Santa Fe Drive from the center line of W. Yale Avenue to the existing M-1 Zone, to be rezoned from C-2 to M-2. Chairman Jones stated that the ~earing was open and asked the Planning Director to review, for the benefit of all interested persons present, the areas as shown on the map and the proposed changes. After Mr. Lacy completed the clarification, Chairman Jones stated that any citizens who· wished to speak would be heard at this time. Mr. James Quinlan asked for a clarification o f the difference between original and proposed zones involved and same was explained by the Planning Director, Mr. Lacy. There being no further discussion or persons to be heard, Hill moved: Lacy, seconded: That the hearing be closed. Ayes: Hill , Jones, Kelley, Lacy Nays: None Absent: Braun, Romans, Rudd Mr. Braun entered and was seated with the Commission. Later in the meeting and after brief discussion, Hill moved: Braun, seconded: That the Planning Commission recommend to City Council that rezoning of Page 278 all of the subject areas be approved as proposed. Heariny No. 10-5 8 -A April 0, 1958 The subject area having been properly posted and public notice given, a hearing was held relative to a change of zoning from present R-1-B Zone District to R-3 Zone District. The Planning Director presented photo graphic slides of the area adjacent to the subject tract, and explained the present land usage of the subject and adjacent areas. Mr. Grant Williams of 500 West Grand Avenue appeared and spoke in opposition to the proposal. Mr. Williams stated that he could not officially represent any property owners other than himself since none of the neighborhru ng property owners other than himself were present but, others in the area had indicated to him that they were also against the propesed zoning change . Mr. Williams said that the multiple dwelling park type development as proposed by Mr. Andrews might be acceptable in the area proposed but that he felt that if this zone change were allowed it would be a be ginning of an encroachment into the R-1-B District with multiple family use which would not necessarily stop with this one development. ¥r. Williams stated further that after searching the En g lewood area to some great extent, he had purchased the property at this present location and constructed an• expensive home there- on, feeling that he had the full protection of the hi gh R-1-B Zone District classification surrounding his site. Mr. Williams stated that he felt that a rezoning to an R-3 Classification would lower property values in the area and that while Mr. Andrews' plat plan and proposals for building setbacks, etc., were much more restrictive than the present R-3 Zone District regulations call for, the City would have no absolute assurance that the plan would be carried out. Chairman Jones, at this time explained, for the ben ef it of all interested, that there is now before City Council a proposed amendment to the Zoning Ordinance, which if approved, will establish an R-3-A Zone District which will be much more restrictive than the present R-3 Zone District and for this reason would protect surrounding or adjacent property owners. The Planning Director, Mr. Lacy, pointed out that, since the subject area is bounded on the north by the Sinclair Junior High School property, on the east by commercial zoning and on the south by a proposed four lane State Highway, it is unsuitable for develo~ment with single family residences as now zoned, and it is his opini on, that holding it to it s present zoning would create nei ghborhood problems when developed into single family use. Mr . Andrews, proponent of the development, spoke briefly reiterating various phases of his proposal for restrictive type development, that the plan provided more than ample off-street parking facilities and that although he could not say how fast it would develop, the ultimate development would proceed along the lines of the apartment house park development. Mr. Andrews stated that any expedience used in proceeding with the rezoning, if favorable, would be appreciated for economic reasons. Hill moved: Lacy seconded: That the hearing be closed. Ayes: Braun, Hill, Jones, Kelley, Lacy Nays: None Absent: Romans, Rudd Later in the meeting, much discussion was devoted to whether or not the P lanning Commission could legally recommend this area for rezoning to R-3-A Zone District since there is, in fact, no R-3-A Zone District actually in existence to date. Braun moved: Kelley seconded: That the matter be deferred to give Commission time to contact the City Attorney relative to the legal aspects which might be involved in recommending the re- zoning of the area to a Zone District which Zone District is now only tentative in nature. The Planning Director presented photo graphic slides and a current land use survey of the area. Mr. Robert Close, Attorney, 3485~ South Acoma, Englewood, was recognized as a representative of various property owners, in the block, who were protesting the change of zoning. I I I I I I Page 279 Mr. Langendoerfer, representing Mrs. Seabert, was next recognized and introduced the follow- ing property owners: Mrs. A. B. Martin, 3300 South Logan, who stated that she presently owned a single family residence which she wished to remove and use the site, along with the vacant land adjacent, to construct a duplex. Mr. R. N. Tafoya, 3361 South Lo gan , who stated that he was non-committal and did not wish to take a stand on the issue. Kelley moved: Hill seconded: That the hearing be closed. Heariny No. 12-58-A April o, 1958 The subject area having been properly posted and public notice given, a hearing was held relative to a proposed zoning change from present M-1 to M-2 Zone District for the purpose of enlargement of the existing Axom Automobile Wrecking Company activities which are presently located southeast of the subject area and presently fronts on West Hampden Avenue. The Planning Director presented photographic slides and a land use survey of the area. Mr. Dutcher, Realtor, representing Mr. Axom, wa s the only person who desired to be heard and he simply stated that the proposal for use of the area for rezoning was for storage of automobiles and the rehai l of parts. Heariny No. 13-5 8 -A April 0, 1958 The subject property having been properly posted and public notice given, a hearing was held relative to rezoning from present R-1-D Zone District to R-3 Zone District for the purpose of allowing construction of a medical clinic. The Planning Director presented photographic slides and land use survey of the site under study as well as surrounding land including the block to the south which has also been under study by the Planning Commission for possible rezoning to the proposed new R-3-A District . There were no persons present who desired to protest the proposed zoning change. Hill moved: Braun seconded: That the hearing be closed. Ayes: Braun, Hill, Jones, Kelley, Lacy Nays: None Absent: Romans, Rudd Page 280 Immediately following the closing of this hearing, Mr. J. C. Frazier of Cline & Hardesty Realty, 111 Broadway, representing Mrs. Maude DeVault of 3380 South Clarkson and Mrs. V. I. Kurtz of 3410 South Clarkson, asked that the Planning Commission indicate, at this time, their feeling on the above rezoning proposal. The P l anning Director pointed out on the Zoning Map that allowing a rezoning of only five lots, as proposed, would not only deviate from rezoning policy but accepting too small an area, but would also tend toward spot zoning by allowing a "jut" into a single family area. As an alternative, he proposed that the East ~ of the 3400 block South Clarkson also be considered for rezoning to the proposed new R-3-A Zone District. This movement, if accepted, would change the zoning break line over to an alley rather than on a street as now exists. Mr. Frazier stated that this suggestion would be satisfactory with them and on the basis of the presentation just made he presented an application for the rezoning of the East one-half of the 3400 Block South Clarkson, and the five lots presently under consideration, from present R-1-D Zone District to proposed R-3-A Zone District. After some further discussion, Braun moved: Kelley seconded: That the matter be deferred to give the Commission time to contact the City Attorney relative to the legal aspects which might be involved in recommending the rezoning of the area to a Zone District which Zone District is only tentative in nature. Ayes: Braun, Hill, Jones, Kelley Nays: None Absent: Romans, Rudd, Lacy~': Donald Hall r 2725 South Pennsylvania Alley Vacation That portion of an alley which exists in the 2700 Block between South Logan and ,' South Pennsylvania Hearing No. 17-58 Mr. Donald Hall of 2725 South Pennsulvania Street appeared and presented a survey showing the northern part of the 2700 block between South Logan and South Pennsylvania Streets and the alley that exists therein. Mr. Hall pointed out that the alley is not used since it does not go completely through the block and some structures are located partially in the alley. It was also pointed out that there does exist other portions of dedicated alley further south in the block which is not connected to the portion in question but which cannot be used for alley purposes. After some discussion, Braun moved: Hill seconded: That the request for the alley vacation be received and referred to the Planning Off ice for study and to determine whether or not the vacation of the alley throughout the block would be desirable. Ayes: Braun, Hill, Jones, Kelley, Lacy Nays: None Absent: Romans, Rudd City Council City Future Planning Matter Downtown Commercial Area Hearing No. 18-58 A request from Mr Robert McDougal as to the City's feeling on ultimate development of the downtown commercial area was received by City Council. City Planning Commission opinion was sought in the matter. Braun moved: Hill seconded: That consideration of thi s matter be deferred to a future Planning Commission session. It was the feeling of the Corrnnission that the matter should be recorrnnended to City Council for rezoning with certain safeguards provided that the development, as proposed by the applicant, be made a reality. Braun moved: Hill seconded: That the Planning Corrnnission recorrnnend t o City Council that the subject area be rezoned from R-1-B Zone District to R-3-A Zone District, contingent upon the final passage of the proposed ordinance creating an R-3-A Zone District. In addition to the information already discussed at the hearing held May 8, 1958, the matter of bringing the R-3-A Zone District all the way south to Hampden Avenue was discussed. It was pointed out that the present usage at the northeast corner of East Hampden Avenue and South Clarkson is now single family residential and that a practical use of the corner site for a drive-in corrnnercial operation would be unlikely because of the topography with a sharp up-slope on South Clarkson Street.
