Recommendation: That the subject area, further described here below, be rezoned from R-1-B

the proposed ordinance creating an R-3-A Zone District:

The Planning Director presented a proposed schedule of planning details to be considered as
Englewood's planning needs. The proposal was read and discussed in full and one addition
made.

Discussion was held on the motion previously accepted by the Planning Commission relative
to above subject on April 24, 1958. A written proposal by Mr. Rudd embodying the elements
of the ori g inal motion was then discussed in detail.
Consideration was given to the feasibility of specifying a certain percentage allowable for
trailer court expansion as oppo se d to setting a genera l standard by which the Zoning Board
of Adjustment could determine required expansion area. The matter of securing non-conforming
use registrations which would show the existing number of spaces available for trailer sites
was also discussed and it was agreed that the Building Inspector should proceed to complete
this registration as soon as pos sible.

Lacy seconded: 1. That the Planning Commission recommend to City Council that the
present zoning ordinance be amended to recognize existing trailer
courts as "non-conforming uses" in their present zones, i.e., C-2
and M-1.
That a regulatory ordinance substantially the same as the present
Aurora and Sheridan ordinances be adopted.
That any expansion of area used by an existing trailer court be
allowed only for the purpose of complying with the regulatory
ordinance and in no case to allow an increase in the number of
trailer spaces over and above the number available for use as
s.hown by the nonconforming use registration on file with the
City Building Inspector.
That any expansion granted be only into a C-2 or M-1 zone and
with t he express permission of the Zoning Board of Adjustment
which shall specifically determine and limit the amount of area
necessary for expansion to comply with the regulatory ordinance.
That all existing trailer courts be required to comply with the
provisions of the regulatory ordinance within eighteen months
following the effective date of the ordinance or cease operations.
That a nominal fee be established for the registration of trailer
courts and an additional monthly inspection fee, based on the
number of trailer spaces, be established to be paid by the trailer
court operator to the City, with certification, and that provisions
be made for a bond from the trailer court operator guaranteeing
payment.
2. That, in the event that City Council favorably considers the above
recommendation, the matter of preparing the regulatory ordinance be
undertaken immediately by the Planning Office and the City Manager's
Office.

Discussion on the above subject matter was reopened by the Planning Director by presentation
of a report on provisions in the Aurora Zoning Ordinance which have proved successful in
limiting the number of service stations on the basis of public safety .
It was agreed that inasmuch as City Council had requested a recommendation on this matter
that provisions of the Aurora Zoning Ordinance would come closer to solving En g lewood's
problems than any of the solutions previously considered .

Rudd seconded : That the Planning Commission recommend to City Council that the
Supplementary Re gulations of the Zoning Ordinance be amended to
provide that ''Service stations shall not be placed within 500 feet
of an entrance to a school building or a playgr ound nor within
500 feet of an existing service station property line except that
where a median s trip is installed the 500 feet requirement shall
not apply to service stations located on opposite sides of the
street in which the median strip exists."

The Planning Director reported on the pertinent actions taken at the I.C.R.P.C. monthly
meetings in April and May.

The I.C.R.P.C. needs only $3000.00 more in contributions to meet the $11,000.00 deficit
incurred when Denver withdrew participation. The I.C.R.P.C. office will move out of Denver
to 20th and Kipling in Jefferson County on June 1, 1958. The move will not entail payment
of doub 1 e rent but, in fact, will mean a saving since the new site is provided rent free by
Jefferson County.
The final recreation plan is substantially the same as the preliminary plan and still
rec ommends a regional park Authority with taxing powers rather than local implementation
as preferred by the City of Englewood (See Planning Commission Minutes of October 17, 1957.)
The final transportation plan has been modified as to routes substantially according to
recommendations by the City of Englewood. However, financing proposals remain the same
as originally proposed (See Resolution adopted by City Council October 14, 1957).
A report on the first meeting of the transportation guidance committee revealed that the
new committee is having difficulty in determining the scope of it's work. The second
meeting will be for the purpose of explaining each communities plans in the transportation
area to other delegates.

Mr. Jones, Planning Commission Chairman, reintroduced the above matter by reporting that Mr.
Dowdle, present owner of the subject area, is bringing suit against the State Highway Depart-
ment and possibly the City of Englewood on the allegation that he has been denied curb cut
access to the subject area and that an agreement existed in the past whereby he was to be
granted C-2 zoning in the subject area. Mr. Jones reported that a thorough records search
and extensive consultation with previous Planning Commission members had revealed no agree-
ment for C-2 zoning Tas alleged. Mr. Jones suggested that a letter be sent to Mr. Dowdle
grainting him curg cuts at the proper distances from the highway radius in order th show
that curb cuts, as such, are not being arbitrarily denied.
The Planning Director presented and explained a tabulation by the City Engineer's office,
as requested by Mr. J ones, revealing the relative amounts of land vacated in favor of the
previous owner of the subject area (Mr. Colesman). The tabulation reveals that the previous
owner received more than 7,000 square feet of land more in vacations that he dedicated for
highway purposes and that additional right-of-way subsequently acquired was either paid for
in cash or exchanged on a comparable square footage basis.
After considerable discussion, it was agreed that rezoning of the subject area to a C-2 zone
would not adhere to tenets of go od planning since it endangers public safety by allowing
drive-in type businesses along a major highway.

Mr. Jones, Chairman, read a letter from the Building Inspector which requested an interpreta-
tion of the zoning ordinance or the building code which would authorize him to deny construc-
tion of metal accessory buildings in residential zones, such as sheet metal garages . The
letter also stated that consideration should be given to requiring the installation of curb
and gutter in front of all homes at the time of construction.
It was agreed that the letter should be turned over to the Planning Off ice and that the
Planning Director confer with the Building Inspector on these problems.
There being no further business to come before the Planning Commission, the meeting was
adjourned at 11:30 P. M.

The subject area having been properly posted and public notice given, a hearing was held
relative to rezoning as follows:
Lots 20-25, Inclusive, Block 44, Evanston's Broadway Addition and
Lots 1-20, Inclusive, Block 45, Evanston's Broadway Addition, all
from R-1-D Zone District to R-3-A Zone District.
Lots 21-24, Inclusive, Block 45, Evanston's Broadway Addition,
from C-2 Zone District to R-3-A Zone District.
The hearing was opened by the Planning Director showing photographic slides of the area as
well as a land use survey and discussed the main points of difference between the present
R-3 Zone District and the more restrictive R-3-A Zone District which is proposed.
Chairman Jones next asked that any proponents of the proposal to speak.

There were no persons present to object to the proposed zoning change; however, Mr. E. R.
Pusard of 3460 South Clarkson did ask about what would be done to furnish off-street parking
for all the additional automobiles which, no doubt, would exist after construction of
apartment houses or clinics.
