That all existing trailer courts be required to comply with the provisions
of the regulatory ordinance within eighteen months following the effective
date of the ordinance or cease operations.
That a nominal fee be established for the registration of trailer courts
and an additional monthly inspection fee, based on the number of trailer
spaces, be established to be paid by the trailer court operator to the City,
with certification, and that provisions be made for a bond from the trailer
court operator guaranteeing payment

PLANNING COMMISSION
Date: May 22, 1958
Subject: Limitations on Service Stations
Recommendation: That the Supplementary Regulations of the Zoning Ordinance be amended
to provide that:
"Service stations shall not be placed within 500 feet of an entrance
to a school building or a playground nor within 500 feet of an existing
service station property line except that where a median strip is in-
stalled the 500 feet requirement shall not apply to service stations
located on opposite sides of the street in which the median strip
exists".

The subject area having been properly posted and public notice given, a hearing was held
relative to rezoning as follows:
Lots 20-25, Inclusive, Block 44, Evanston's Broadway Addition and
Lots 1-20, Inclusive, Block 45, Evanston's Broadway Addition, all
from R-1-D Zone District to R-3-A Zone District.
Lots 21-24, Inclusive, Block 45, Evanston's Broadway Addition,
from C-2 Zone District to R-3-A Zone District.
The hearing was opened by the Planning Director showing photographic slides of the area as
well as a land use survey and discussed the main points of difference between the present
R-3 Zone District and the more restrictive R-3-A Zone District which is proposed.
Chairman Jones next asked that any proponents of the proposal to speak.

There were no persons present to object to the proposed zoning change; however, Mr. E. R.
Pusard of 3460 South Clarkson did ask about what would be done to furnish off-street parking
for all the additional automobiles which, no doubt, would exist after construction of
apartment houses or clinics.

Mr. Braun explained the off-street parking requirements of the Ordinance to Mr. Pusard's
satisfaction.
Braun moved:
Rudd seconded: That the hearing be closed.

Later in the meeting and after some further discussion,
Lacy moved:
Braun seconded: That the Planning Commission recommend to City Council that the area
described above be rezoned as proposed, contingent upon the final passage
of the proposed ordinance creating an R-3-A District.

Mr. Schillinger and Mr. John appeared to present an application for rezoning of the subject
area from R-1-B to C-2 Zone District and a 70 foot wide P Zone in the south one-half of the
subject area. Mr. John also asked that a ~ortion (approximately one-fourth of the block)
of the block between South Acoma (extended) and South Bannock (extended) be rezoned from
R-1-B to R-1-D.
After considerable discussion, Planning Commission suggested and Mr. John agreed that any
change to R-1-D should not be requested at this time and deferred indefinitely. The Planning
Director stated that Mr. Schillinger had consulted him before making his rezoning application
and had agreed that the 70 foot wide P Zone would be ideally suited for maximum efficiency
in the a h rangement of off-street parking.
Braun moved:
Lacy seconded : That the Planning Commission proceed to legally advertise, post the
subject area and hold a public hearing, relative to the proposed zoning
change, on July 10, 1958.

Mr. Shockley appeared to present an application for rezoning of the subject area from C-2
and R-2-A to ~-3 -A . The formal application presented requested only both sides of the 3500
Block South Washington to be considered, but Mr. Shockley requested verbally that the
Swedish Sanatorium property, now zoned C-2, be also included. He also stated that he had
contacted all of the property owners involved and that all but two of them were in favor of
the rezoning which would allow Mr. Shockley to construct a 100 bed nursing home. He presented
an informal petition to substantiate his statements.
Rudd moved:
Kelley seconded: That the Planning Commission proceed to legally advertise, post the subject
area and hold a public hearing, relative to the proposed zoning change, on
July 10, 1958.

The Planning Director presented a report on the requested a lley vacation as follows:
1. Colorado Central Power, Dick Green, Phone 8 :50 A.M., May 27 . Six poles along center-
line of block (east line of alley portions) five owned by Mountain States Tel. and
Tel. and one by Power Company. All six used by both utilities. No problem to them
to vacate subject to existing utilities.
2. Joseph Esch, City Attorney, Phone May 26, 1958. Should find out what document by
type used to dedicate or deed the alleys to City in order to see if land can revert ':
to original deeders or will have to split half and half.

3. Arapahoe Abstract Co., phone May 27, 1958. First search shows only that areas have
been set up as alley. Would take a thorough search (will be an expense) to determine
by what document, off what property, by whom and when.
4. Mr. Oliver, Arapahoe County Assessor's office, May 27, 1958. Says records show
Both portions as part of alley but does not indicate how dedicated.
5. Visual inspection Friday May 23, 1958. Houses and out buildings sitting in dedication
all along the block. Appears never to have been used as alley and seems never could
be. No practical problem of vacation unless it might increase taxes of owners to which
reverts and they object.
Mr. Hall presented a letter from the Shamrock Oil Company which states that the Company
is in favor of the alley vacation as requested.
Planning Commission discussion which followed revealed no reason for not vacating the two
alley portions as requested.
Kelley moved:
Braun seconded: That the Planning Commission recommend to City Council that the two portions
of alley in the 2700 block between South Logan and South Pennsylvania
Streets be released, relinquished or vacated by whatever means deemed
necessary by the City Attorney.

Mr. William W. Noll, Jr., representing Mr. Insley who was ill, appeared and presented a
preliminary plan for subdivision of the subject area. The Planning Commission studied the
proposal and noted that that it proposed only a fifty-two foot street width rather than
the sixty foot required street width. Mr. Rudd and Mr. Braun worked over the drawing to
show angling of the entire street in such a way that it would by-pass existing structures
and provide the specified sixty foot width. It was indicated that since only one lot in
the southwest corner of the subdivison would be shorted in area, this shortage could be
waived.
The possibility of requiring submission of a paving petition to satisfy the required paving
requirements was discussed and it was agreed that it would be reasonable in light of
Mr. Insley's plans for development and in light of the time element involved.
Braun moved:
Rudd seconded: That the preliminary plan as modified be accepted and ref erred to the
Planning Off ice for detailed perusal and that the subdivider be notified
that the preliminary plan, as submitted, will be acceptable when the
following conditions are met:
1. That the sixty foot dedication as proposed by the Planning
Commission, be dedicated in place of the originally proposed
52 foot dedication.
2. That a paving petition for the 5000 block on South Delaware
Street ~extended) be submitted immediately upon acceptance of
the subdivision plat by the City Council.
3. That the subdivider indicate in writing his awareness of
the developers responsibility for utilities.

The Planning Director reported that only two of six planning consultants contacted by letter
to negotiate for work on the City's Master Plan had replied to date. Both consultants,
S. R. DeBoer and Development Planning Associates, had met with the Planning Director and
will be prepared to present preliminary proposals at the June 19th meeting. It was suggested
that each consultant be given a specific time of arrival so that the two will not be present
at the same time.
Mr. Braun was excused from the meeting at the beginning of the above report and discussion.

The Planning Director reported that a proposed regulatory ordinance covering trailer courts
is now being studied by various City Departments concerned with it's enforcement. When
this has been completed, a tentative ordinance will be prepared and submitted by the
Planning Director to the Planning Commission for detailed consideration. It is expected
that this may be accomplished prior to the June 19th meeting.

adjourned at 10:20 P. M.

Four planning consultant firms, which had contacted the Planning Office as a result of action
taken May 22, 1958, appeared to present proposals on the City's Master Plan. Each of the
consultants had had prior contact with the Planning Office in order to determine the scope
of the work before submitting these initial proposals. Each consultant was allowed approxi-
mately one-half hour for his presentation. The consultants and their proposals were as
follows:
1. S. R. DeBoer.
$25,000.00 to do the whole job in eight months plus a recommended $250.00 retaining
fee for each month for two years following the completion of the plan.

4. Trafton Bean & Associates:
